The total number of respondents to the above questionnaire was 35 of which 15 replied YES, 14 replied NO and 6 made NO COMMENT. CONTRAVENTION OF BUFFALO CITY METRO MUNICIPAL ZONING It is of great importance to ensure that the property you are marketing actually has the correct zoning for whatever activity it is to be used or otherwise, check that the subject property is within the Special Development Planning for rezoning – if in doubt, always check with BCMM Town Planning. PROCESS TO BE FOLLOWED FOR APPLICATIONS BEING SUBMITTED THAT HAVE EXISTING ILLEGAL LAND USE(S) Reference is made to Section 39, subsections (1) & (2) of the Land Use Planning Ordinance 15 of 1985. The applicant will be informed that due to the fact that the land use is illegal and in contravention of the Zoning Scheme, the application is returned and cannot be processed until the illegal land use has ceased. • Once the illegal land use has ceased the applicant must notify City Planning. This will be verified through an inspection and when it is found that the illegal land use has ceased, only then will the applicant be informed to resubmit the application for processing. The objective of this proposal is to send out a clear message to applicants / land owners and developers that they should not start operating illegally and then submit their proposals. Often applications are only received when City Planning informs the Land Owner that they are operating illegally, until then they will ignore it. The objective of this proposal is to make sure that staff can concentrate on the applications where the current land use is legal and in line with the zoning scheme as currently staff are spending lot of time on applications where the land use is illegal, which is not fair to the applicants who are doing it correctly from the start, as their applications are delayed due to the volume of work. The Wills Act 7/1953 If you die without leaving a valid will your estate will be split up according to the Intestate Succession Act, No. 81 of 1987. Many people do not have a Will and when they die, their estates fall under the Intestate Succession Act, No 81 of 1987. This means that the court will determine the division of their estates and appoint a guardian for their children. This could lead to extensive tax, administrative, legal and financial consequences for their families. Consider advising your sellers and buyers when dealing with property transactions, they will be most grateful and thankful to you for bringing it up. There are many reasons why you may put off drafting your Will. You may feel that you are tempting fate, your family will handle all the affairs, you’re not wealthy enough for it to make a difference or you have plenty of time to worry about it later on in life. The hard truth is that every single person should have a Will and as your life changes you need to make sure that your Last Will and Testament changes too. Ensure that you either draft a will as soon as possible or otherwise update your existing will. Now is the best time....today! When do you need to update your Will? • • • • • • If you own assets or have acquired any new assets If there’s been a change in your marital status i.e. divorce If you’ve had a child or children If one of your beneficiaries has passed away If you wish to nominate a new guardian for your children If your health or medical situation has changed. Challenging the validity of a will Section 2(1)(a) of the Wills Act provides the formal requirements for the execution of a valid will. These requirements can be summarised as follows: • • • • The will must be signed at the end thereof by the testator. The signature of the testator must be made in the presence of two or more competent witnesses who are present at the same time. The will must be signed by each witness in the presence of the other witnesses and the testator. If the will consists of more than one page, each page other than the page on which it ends must also be signed by the testator anywhere on the page. However in practice the testator and witnesses are generally asked to sign every page at the end thereof. A will which is concluded in the normal course of events is presumed to be valid until the contrary is proven. Therefore, if all the formal requirements for a will have been met, the person questioning the validity must prove that it is not valid. The validity of a will can however be affected by undue influence, duress, mistake, old age, illness or mental incapacity. In this article we will focus on old age, illness or mental incapacity as possible grounds for declaring a will invalid. Box 15314 Beacon Bay 5205 www.ieasa.co.za [email protected] Glynis Heger T • 043 748 1156 F • 043 748 2839 PG 8 DUODECAD Section 4 of the Wills Act provides the following in connection with the required competency of a testator to make a will: “Every person of the age of 16 years or more may make a will unless at the time of making the Will he is mentally incapable of appreciating the nature and the effect of this act and the burden of proof that he was mentally incapable at the time shall rest on the person alleging same.” Accordingly, in order to prove that a testator was not competent to make a will due to old age or illness it must be proven that such a testator was mentally incapable of executing a will. In order to show that the testator did not have the required mental capacity, our courts may take account of the following factors amongst others: • • • • • The testator did not understand the nature of the testamentary act and its consequences. The testator could not remember what he possessed, and thus did not know what he was disposing of. The testator could not differentiate between people who would ordinarily have a claim upon his estate and others. The testator suffered from a disorder of the mind that may have poisoned his affections and affected his sense of right and wrong or prevented the exercise of his natural faculties. The testator, if of a sound mind, would not have disposed of his property in the way that he did. A person wishing to question the validity of a will in court must be able to provide evidence to prove on a balance of probabilities that the testator, at the time that the will was executed, did not possess sufficient capacity and did not have a sufficiently sound mind and memory for him to understand and appreciate the nature of his testamentary actions. To do this, evidence must be provided by persons close to the testator who can testify about the testator’s condition at the time of the execution of the will and the testator’s condition in the time leading up to the execution of the will as well as thereafter. Additionally, the evidence of an expert witness, such as a psychiatrist or a medical doctor who can attest that the testator did not or could not have had the requisite mental faculties. The process of capturing of these auditor’s reports is continuing and is anticipated to be finalised by the end of September 2014. At this stage, not all 2014 auditor’s reports received in May and June 2014 have been captured and estate agents who are informed that their auditor’s report is not yet on the system are requested to bear with us as we finalise the internal processing of the submitted auditor’s reports. The large volumes of auditor’s reports received that are awaiting internal capturing means that the 2015 Fidelity Fund Certificates will be issued as and when the 2014 auditor’s report has been captured. For those estate agents who have submitted their 2014 auditor’s reports before the deadline of 30 June 2014 and their reports have not yet been captured, it should be noted that their 2015 Fidelity Fund Certificate cannot be issued at this stage. Again, we request that you kindly bear with us during this process. With regard to the issue of Fidelity Fund Certificates for 2015, please contact the EAAB Registrations Department around 01 October 2014. Please note that Fidelity Fund Certificates for 2015 will only be issued to estate agents where the estate agency firm has submitted all outstanding auditors’ reports up to and including the 2014 financial year. Issued by: Audit Compliance Department | Email: [email protected] SUBMISSION OF AUDITOR’S REPORTS TO THE ESTATE AGENCY AFFAIRS BOARD In terms of section 32(4) of the Estate Agency Affairs Act, auditors are required to submit the audit reports within the prescribed time-frame of four months and transmit the audit report to the Estate Agency Affairs Board in the form determined by the EAAB from time to time. In compliance with the provision of this section, the format of the audit report to be submitted can be downloaded in the link below. In addition, EAAB has determined the manner of transmission of the audit report to EAAB by the auditor to be the MyEAAB Auditors Portal, accessible through this website. All auditors are required to register on the MyEAAB Auditors Portal and they will receive a password once they have registered. The auditors will then be required to log-in on this portal and electronically submit the audit report online. Once the audit report has been completed and submitted online, it will in real time update the EAAB system and a confirmation email is sent to the auditor and the principal estate agent of the firm. In submitting auditor reports, estate agencies and auditors are to note that receipt of the auditor report does not constitute acceptance of the auditor report as being compliant in respect of the provisions and requirements, as set out in the revised form and read with the provisions of Sections 29 and 32 of the Estate Agency Affair Act, 112 of 1976 (“the Act”). Principals and auditors are advised that EAAB only accepts audit reports in the format determined by EAAB and that the audit should cover the following accounting records, as stipulated by section 29(b) of the Estate Agency Affairs Act: a. b. c. All monies received and expended by the estate agent, including monies deposited to a trust account referred to in section 32(1) or invested in a savings or other interest-bearing account referred to in section 32(2)(a); All assets and liabilities of the estate agent; and All financial transactions and the financial position of the estate agent’s business. The EAAB has been receiving numerous requests for the extension of the period for the submission of the audit report. Please note that the Estate Agency Affairs Act prescribes the manner and time-frame within which the audit reports are to be submitted and EAAB has no discretion to grant extensions and consequently, such requests for extensions will not be entertained. The EAAB has also been receiving correspondence from estate agents and auditor requesting an exemption from submitting the audit report in the required format on the basis that the estate agent was dormant or had no transactions during the financial year and therefore no audit could be done. The requirement to have an audit performed on the trust account and business and submit the audit report to EAAB in the required format remains irrespective of the level of activity on the trust account or the business and as long as the estate agency firm is not deregistered with EAAB. EAAB has no discretion in terms of the Estate Agency Affairs Act to grant exemptions from the audit requirement to a registered estate agency firm. The EAAB reserves the right, at its sole discretion and in addition to any administrative penalty having been levied, to institute formal processes relating to any non-compliance with the provisions of the Act.
