COMMISSION STAFF'S FIRST REQUEST FOR INFORMATION TO
DCP AUSTIN GATHERING, LLC
STAFF NO. 1-1 THROUGH STAFF NO. 1-13
DCP Austin Gathering, LLC ("DCP Austin") submits the following responses to the
Texas Public Utility Commission ("Commission") Staff's First Requests for Information to DCP
Austin.
STAFF RFI State whether there are any Habitable Structures on your property that are near
one or more of the segments of the proposed routes for the Houston Import
NO. 1-1
Project. If There are Habitable Structures near one or more of the segments of the
proposed routes for the Houston Import Project:

Identify the segments of the proposed routes that affect your Habitable
Structure(s); and
Estimate the distance between your Habitable Structure(s) and the
segments you identified in response to Staff No. 1-1(b).
RESPONSE: There are no habitable structures in relation to the proposed crossing of DCP
Austin's pipeline easement.
STAFF RFI State whether any segments of the proposed routes for the Houston Import
Project cross your property. If any segments of the proposed routes for the

Houston Import Project do cross your property:

Identify any features, including but not limited to, property lines,
pipelines, power lines, or roads that such segments follow on to your

RESPONSE: Although DCP Austin does not own the property as fee property, a portion of the
project does cross one of DCP Austin's pipelines and easements.
i. Segment V2A crosses DCP Austin's pipeline just south of FM 149.
ii. This segment follows an existing power line across DCP Austin's pipeline
easement.
STAFF RFI State whether any existing transmission or distribution lines cross your property.

If any existing transmission or distribution lines cross your property, describe how
and where such lines cross your property.
RESPONSE: An existing electric transmission line does cross the DCP Austin pipeline
easement. It crosses the line going north and south.
STAFF RFI State whether any existing transmission or distribution lines are visible from your

property? If any existing transmission or distribution lines are visible from your
property:

State the distance that the existing transmission or distribution lines are

RESPONSE: Yes, there is a line crossing.
i. The crossing is directly perpendicular to DCP Austin's pipeline crossing.
ii. Approximately 30 feet +/-.
iii. This electric line crossing does not affect DCP Austin's facilities.
STAFF RFI Have you discussed or requested any modifications of the proposed routes for the

Houston Import Project? If so, what were the modifications that you discussed or
requested and what was the response by CenterPoint Energy?
RESPONSE: No. The second question is not applicable.
STAFF RFI Detail your specific concerns about the Houston Import Project.
NO. 1-6
RESPONSE: DCP has only two specific concerns with the project. DCP Austin stated in its
motion to intervene that it supports the project.

As DCP Austin stated in its motion to intervene, DCP Austin requests that
the Commission's project approval order clarify that the Applicant's easements
for the project will be non-exclusive easements that will not interfere with other
easement holders' uses of their easements for underground pipelines and the like.
We believe that the Applicant's intent was to acquire non-exclusive easements for
the project rather than pay the much higher costs that would be necessary to buy

out all landowner interests and all other existing easement holder's interests in the
lands crossed by the electric transmission line in order to acquire exclusive
easements.

DCP Austin also does request that the Applicant CenterPoint Energy place
all transmission line poles and towers in positions that stay at least 30 feet away
from DCP Austin's pipelines and others' pipelines. DCP Austin believes this
requirement can easily be met, and is likely consistent with the Applicant's
construction planning.
STAFF RFI Did you attend any open houses presented by CenterPoint Energy regarding the

Houston Import Project? If so, when and where? Did you provide written
comments to CenterPoint Energy at or after the open house? If so, provide a copy
of these written comments.
RESPONSE: No, DCP Austin representatives did not attend any of the open houses nor submit
previous written comments.
STAFF RFI Are the property boundaries for the property you own represented accurately on
NO. 1-8
the maps, including supplemental maps, provided by CenterPoint Energy in its
application? If not, explain any discrepancies and provide a map or drawing that
indicates the discrepancies.
RESPONSE: The DCP Austin pipeline locations are referenced on the maps
provided by
CenterPoint Energy.
STAFF RFI What is the primary use for your property and, in your opinion, will this use be

impacted by the proposed routes for the Houston Import Project?
RESPONSE: DCP is not the fee owner of the properties where its Austin Gathering System
pipelines are located. However, DCP uses various easements for the gathering of
natural gas and associated hydrocarbons. DCP does not believe this transmission
line would materially affect the DCP Austin pipeline facilities as long as the
Commission grants the two clarifications that DCP Austin has requested in
response above to Staff RFI No. 6 to DCP Austin.
STAFF RFI Is there any feature about your property that you believe should be considered

when routing a transmission line on your property? If so, please explain.
RESPONSE: No, except as stated in DCP Austin's response
above to Staff RFI No. 6 to DCP
Austin.

STAFF RFI Identify all persons or entities with an ownership interest (legal or beneficial) in

your property.
RESPONSE: DCP Austin is not the fee owner of the properties, however DCP Austin is the
owner of the easements that the transmission line project will cross. DCP Austin
lacks current land ownership records regarding the identities of all current fee
landowners and of other easement holders for the properties affected by DCP
Austin's pipeline easements.
STAFF RFI If a transmission line for the Houston Import Project is routed on your property,
NO. 1-12
identify the specific location that you would prefer for the right-of-way of the
line.
RESPONSE: DCP Austin would prefer that the proposed transmission line project cross DCP
Austin's easement and pipeline parallel to the existing power transmission line.
STAFF RFI State whether Route IA crosses your property.

RESPONSE: Yes, the proposed transmission line does cross DCP Austin's
pipeline and related
easement.
