RULES AND REGULATIONS FOR THE RENTAL OF BIKES (NPO) “studentENmobiliteit” 2016 Art.1: Conditions §1. Bicycles are only lend to students who are registered at a University College in Ghent or at the Gent University. At registration, the candidate-renter has to carry his/her identity card and Belgian bank account number. Students who are registered at a University College also have to present their student card. Students that are registered at a Ghent University need to present their certificate of enrolment or a valid student card of the running academic year. §2. A student can hire only one bike. If a renter wants to exchange his/ her bike, an amount of 15 euros is charged. §3. The bicycle is used for cycling in Ghent and in suburbs (with the exception of folding bikes). §4. The bike always remains the property of the NPO “studentENmobiliteit”. Reselling, subletting and lending is forbidden. The renter always remains personally responsible for the observance of the rental regulations. §5. The renter is responsible for the follow- up of the contract. He/ she must follow the lease terms. Art. 2: Duration §1. Bicycles are lend for a period of three, six, ten, twelve or fourteen months. The expiration date of the rental agreement may not exceed October, 31 of the running academic year. §2. A prolongation of the rental agreement is only possible when a competent instructor has checked the bicycle at the bike repair shop. Possible repair costs will be charged. You will not be charged an additional deposit. The prolongation is only possible when you come over to the bike repair shop. A prolongation after October, 31 of the running academic year is only possible after presenting a valid certificate of enrolment for the coming academic year. Art. 3: Price §1. The rental price is determined by the tariffs that are published on the website of the NPO “StudentENmobiliteit”. §2. A deposit of 60 euros has to be paid when reserving or collecting the bike. Art. 4: Liability of the NPO “StudentENmobiliteit” The non- profit organization “StudentENmobiliteit” is under no circumstances liable for any accidents resulting from usage of the bike. Art. 5: Obligations of the renter §1. The renter will handle and administer the bike with the care of a “reasonable man/woman”. The renter is responsible for each damage to the bike or the locks. Hidden faults which are recorded during the first rental week are repaired free of charge by the NPO “StudentENmobiliteit”, regardless of the fact that the repairs are small or large. The renter will have to go to the NPO “StudentENmobiliteit” within the same period. This arrangement does not apply to failures due to bicycle misuse by the renter. §2. The renter should always lock the bike with both locks. NPO “StudentENmobiliteit” reserves the right to collect any bike that is found unattended and not properly locked (whether on public domain or on private property of the schools). The bicycle will be returned after paying a compensation fee of 10 euros (2nd time 20 euros, 3rd time 30 euros) when one of the two locks was used and 25 euros when the bike was found with the key still in the lock. §3. When the bike is found unattended during the rental period, the NPO “StudentENmobiliteit” can collect it. The renter can collect the bike in the central bike rental location. If the bike is not recovered within a period of 2 months, the contract will be terminated. In that case, the cost of the rent will not be refunded. The following expenses will be deducted from the rental guarantee: a new lock, possible repair costs and administrative costs. §4. The renter should bring the bicycle back at the end of the contract or can prolong the contract (art. 2, §2) §5. Communication is mainly done by e-mail. The renter is responsible for giving a correct e-mail address and he should communicate a change of his e-mail address in time via his online account. Art. 6: Insurance The student can take out an insurance against theft and vandalism. The price is 10 euros for folding bikes and bikes with a hub gear. For all the other bicycle types, the price is 5 euros per academic year. A franchise of 60 euros still needs to be paid. Art. 7: Theft and vandalism §1. Loss or theft of the bicycle is to be reported to the Local Police and the NPO “StudentENmobiliteit” within 24 hours after notification. Within five days after reporting the loss or theft, the renter must hand in an official proof of the report as well as the keys of the matching bicycle locks to the NPO “StudentENmobiliteit”. §2. If the described procedure has been followed correctly and the renter has an insurance against theft, a replacement bike will be put at his disposal (only once) during the remainder of the rental period. However, in such case the renter has to pay a new deposit of 60 euros. If the bicycle is recovered during the rental period or within six months after termination of the agreement, the initial deposit will be reimbursed after deduction of repair costs (replacement of the locks included) and 25 euro administration (when there is no insurance). §3. When failing this procedure or when the renter doesn’t’ have an insurance against theft, the renter will pay a lump reimbursement of 275 euros for a bike with hub gears and for a folding bike and 175 euros for other bike types. The rental guarantee will be withheld. Outstanding rent will be charged until the moment when the contract is stopped with an agreement signed by both parties. §4. Renters will have to pay all current costs resulting from the loss or theft of the locks or the keys. The prices are indicated on the website. Art. 8: Termination of Agreement §1. The renter is responsible for returning the bike (a clean bike!) at the NPO “StudentENmobiliteit” not later than the last day of the agreed rental period. If the bike is not clean, a lump sum of 5 euros will be charged. The bike will be checked completely and possible repair costs will be deducted from the rental guarantee. A price list of bike parts can be consulted at the NPO “StudentENmobiliteit”. Under no circumstances, the rent will be reimbursed if the bicycle is returned ahead of time. §2. For any belated bicycle return or belated prolongation of the contract, the renter has to pay the outstanding rent, which is based on the current prices that are indicated on the website. Every fraction of the month will be charged as an entire month and increased with possible repair costs. §3. In case the renter has not returned the bicycle on the due date, has not concluded an agreement in accordance with article 2 (§2 ) or has not observed the procedure in accordance with article 7 (§1), the sanctions as described in article 7 (§3) will be applied, even when the renter took out an insurance. §4. At the end of the agreement, the deposit or the remaining balance will be reimbursed. Following items will be deducted from the deposit : -the bicycle repair expenses or maintenance expenses; -a lump reimbursement when the bicycle has been left abandoned or not properly locked; -the fine for late returning of the bikes or for late prolongation of the agreement; The renter will receive a receipt. If there’s a deficit, the renter will receive an invitation to pay the outstanding balance within 10 days. Art. 9: Disputes All disputes will be handled under Belgian law. The competent courts are the courts of the Arrondissement of Ghent and the justice of the peace court of the first canton in Gent. Art. 10: Sanctions §1. When one or more of the above- mentioned obligations are neglected, the renter will have to pay a reimbursement of 10% on the total amount due, with a minimum of 75 euros. §2. Without prejudice to the sanctions mentioned in these regulations, the NPO “StudentENmobiliteit” has the right to sanction each violation of these regulations by means of an admonition, a temporary or a definitive reclamation of the bicycle.
