NOTICE INVITING BID
Sub: for Replacement of existing Old lights with LED Lights and Supply,
Installation and commissioning of Airconditioners in DERC
1.
Sealed Bids are invited under two bid system of Biding i.e. Technical and Financial
bid for Replacement of existing Old lights with LED Lights and Supply, Installation
and commissioning of Airconditioners in DERC as per the details given in the Bid
Document. The terms and conditions governing the instant Bid are given in
Annexure- I
2.
The Bid document may be obtained from (11.00 AM – 5.00 PM) from 22.07.2016
to 22.08.2016 on all working days on payment of Rs. 500/- (Non- Refundable)
from the Reception Counter of the DERC on cash payment or by submitting a
demand draft in favour of “The Secretary DERC”, payable at New Delhi. The
Bid document can also be downloaded from the DERC website (www.derc.gov.in)
for which bidder has to submit additional fee of Rs. 500- (Non- Refundable) along
with EMD.

Submission of Bid :- Bidders are required to submit their bids in three Envelope
system as detailed under :(i) EMD Envelope: The bidder shall submit EMD in the form of Demand Draft
only in this Envelope and superscribe it with “EMD Envelope”. The bidders who are
registered with NSIC/MSME are exempted from paying EMD. They shall submit
their exemption certificate in this Envelope.
(II) Technical Bid Envelope: In this Envelope, the bidder shall submit the
technical bid, in prescribed format duly stamped and signed on each page, in
token of their unconditional acceptance to the terms prescribed by the DERC.
Details/supporting documents wherever applicable, attached with the Bid shall be
duly authenticated by the bidders. No over-writings shall be accepted unless
authenticated with full signature of the bidders.
(III) Financial Bid:- Each bidder shall submit its Financial Bid in a
sealed Envelope superscribed with “Financial Bid”.

(IV) All the above 03 Envelopes shall be kept in fourth Envelope and fourth
Envelope shall be sealed before submission to the commission.
(V) Earnest money deposit shall be in the form of Account Payee’s Demand Draft
of Rs. 30,000/- (Rupees thirty thousand only) in favour of Secretary, DELHI
ELECTRICITY REGULATORY COMMISSION payable at New Delhi, and the same
will be refunded to unsuccessful bidders after award of work.

The sealed Bid duly superscribed, “Bid for replacement of existing Old
lights with LED Lights and Supply, Installation and commissioning of
Airconditioners in DERC”, and shall be addressed to The Secretary, DERC and sent
at the DERC’s address given below either by registered post/speed post/or by
dropping in the Bid box placed at ground floor of DERC’s Office & must reach on or
before 4:00 PM of 22.08.2016. Bids received after the stipulated date and time shall
not be entertained. DERC shall not be liable for any postal delays, whatsoever and Bid
received after the stipulated time/date shall be rejected summarily without giving any
reason.
5. The Technical Bid shall be opened on 22.08.2016 at 04:30 PM in the Office
of the DERC Viniyamak Bhawan, C-Block, Shivalik, Malviya Nagar, New Delhi – 110017
in the presence of those bidder(s), who wish to be present. No separate
communication will be sent in this regard. In the event of due date being a closed
holiday or declared Holiday, the due date for opening of the bids will be the following
working day at the appointed date, time and venue. Schedule of opening of bid,
technical evaluation and opening of financial bid is enclosed as annexure IV
6. Manner of Opening of Bid: The committee shall open the EMD Envelope first.
Thereafter, the technical bid of only such bidder shall be opened who have submitted
valid EMD of the prescribed amount or the certificate of exemption from competent
authority. The Financial bid of only such bidders shall be opened who are declared
technically qualified by the committee.
7.
The Bidder will be evaluated technically on the basis of information supplied by
them in the Bid document and demonstration of the product, if required, up to the
entire satisfaction of DERC. DERC shall have the right to assess the competencies and
capabilities of the Bidder. DERC may reject/accept the candidature of the Bidder
without assigning any reason.
8.
Prices quoted shall be Firm and strictly as per specifications and shall be
inclusive of all taxes and would be valid for atleast 90 days from the last date of
submission of bids.
9.
Though DERC prefers to deal with manufacturers/principal manufacturers
directly, it may also consider the offers received through authorized channel partners,
provided the principal manufactures authorizes the said channel partner in this regard.
10.
The Bidder shall ensure that they have rendered satisfactory performance
during the last three years and the order/orders placed subsequently should not have
been cancelled and closed by any department of Government of India or Public Sector
Undertakings in the last three years due to unsatisfactory performance. All such firm
whose orders/contract have been cancelled or closed or the firms debarred, are not
eligible to apply. Any suppression of material facts or discrepancy in this respect will
lead to disqualification of the bid.
11. The bidder shall submit all the documents as indicated in the Technical Bid
Performa in support of their eligibility failing which the bidder will be disqualified.
12.
Delivery and installation period shall be mentioned clearly in the proposal.
Penalty for the late delivery and installation would be levied at the rate of half
percent per week or part thereof subject to a maximum of 10 (Ten) percent of the
value of the balance order which has not been supplied during the stipulated
period.
13.
While Annexure- II describes specifications for the LED Lights and
Airconditioners, bidders may quote for better specifications, which may be
considered at the sole discretion of the DERC.
14. The rates quoted shall be valid for at least 90 days from the last date of
submission of bids.
15.
The bidders are required to deposit an earnest money of Rs. 30,000/(Rupees Thirty Thousand Only) by way of demand draft drawn in favour of “The
Secretary, DERC”, payable at “New Delhi”. The bid not accompanied with earnest
money shall be rejected summarily and their technical and financial bid shall not
be opened. The earnest money of unsuccessful bidders will be refunded without
any interest/bank commission/collection charges, after the order has been issued
in favour of successful bidder. However, firms registered with NSIC/MSME are
exempted from submission of EMD for which Bidder is required to attach certificate
from them.
16.
Warranty for a period of one year shall include in the quoted price.
17. DERC reserves the right to accept or reject any or all Bids including the lowest
Bid/s without assigning any reason at its sole discretion and the decision of the
DERC will be final and binding on all concerned. The prices quoted by the bidder
should be firm and definite.
18. Bids are liable to be summarily rejected due to incomplete information /
incorrect information / non fulfillment of technical qualification. DERC’s decision in
this regards shall be final.
19. The quantities indicated in Annexure - II are tentative and may be
increased/decreased at the sole discretion of the DERC and the Bidder shall have no
right to claim any minimum/definite volume of business.

Terms and Conditions:
1.
Description of Work. Replacement of existing Old lights with LED Lights and
Supply, Installation and commissioning of Airconditioners in DERC.
2.
Manner of depositing the Bids. The bidder has to submit complete proposal
in the form annexed as Annexure III. Each page of the bid shall be numbered and
signed by the authorized signatory with the seal of the firm and the forwarding letter
must indicate the details of enclosures attached. No change in the amount of bid shall
be permitted after submission of the bids. All the documents shall be duly signed and
stamped by authorized person of supplier. Sealed Bids should be either dropped in the
Bid Box placed at Commission’s Reception or sent by registered post at the address of
Commission so as to reach on 22.08.2016 by 1600 Hrs. Late Bids will not be
considered. No responsibility will be taken for postal delay or non-delivery/non-receipt
of Bid documents. Unsealed bids sent by FAX or e-mail, will not be considered.
3.
Specifications. Replacement of existing Old lights with LED Lights and Supply,
Installation and commissioning of Airconditioners shall strictly conform to the technical
specifications as per annexure II. Product should be genuine and new. Spurious items
shall not be accepted.
4.
Time and date for opening of Bids. The bids will be opened on 22.08.2016
at 1630 Hrs If due to any exigency, the due date for opening of the Bids is declared a
closed holiday, the Bids will be opened on the next working day at the same time or on
any other day/time, as intimated by the Buyer. The Bidders may depute their
representatives, duly authorized in writing, to attend the opening of Bids on the due
date and time. Rates and important commercial/technical clauses quoted by all Bidders
will be read out in the presence of the representatives of all the Bidders. This event will
not be postponed due to non-presence of your representative.
5.
Rejection of Bids. Canvassing by the Bidder in any form, unsolicited letter and
post-Bid correction, unsigned bids shall be summarily rejected and may lead to
forfeiture of EMD. Conditional Bids will be rejected. Bid submitted in violation of any of
the terms and conditions may be rejected.
6.
Validity of Bids. The prices quoted in the Bids shall remain valid for 90 days
from the last date of submission of the Bids.
7.
Earnest Money Deposit. Bidders are required to submit Earnest Money
Deposit (EMD) for amount of Rs. 30,000 (Rupees Thirty thousand only) along with the
bids. The EMD may be submitted in the form of an Account Payee Demand Draft in
favour of The Secretary, Delhi Electricity Regulatory Commission payable at New Delhi
from any of the public sector banks. EMD of the unsuccessful bidders will be returned to
them at the earliest but on or before the 30th day after the award of the contract. The
Bid Security of the successful bidder would be returned, without any interest
whatsoever, after the successful Supply, installation and commissioning Air purifiers.
Quotation without earnest money will be rejected as non participative. However, firms
registered with NSIC/MSME are exempted from submission of EMD for which Bidder is
required to attach certificate from them.
8.
Bid quotation amount, Taxes and Duties. Price shall be inclusive of cost of
product, all statutory taxes, duties, levies and cartage charges. Bid price shall be firm
and final. No escalation whatsoever shall be payable. The bidder will be entirely
responsible for all taxes and levies payable by him to the respective authorities.
9.
Warranty: The product supplied shall remain under warranty for one year.
10.
Terms of Delivery.
(a)
The successful bidder will have to supply items within 30 days from the
date of supply order, unless the period is extended by mutual agreement.
(b)
The items should be supplied in good condition without any damages
visible/non visible. Damaged items will be replaced by the contractor immediately
with new item in good condition at its own expenses.
(c)
The Warranty/Guarantee shall commence from the date of successful
installation and commissioning.
11.
Liquidated Damages. The replacement of existing Old lights with LED Lights
and Supply, Installation and commissioning of Airconditioners shall be completed within
the time schedule to be reckoned from the date of supply order/ award letter failing
which the contractor shall be liable to pay liquidated damages as compensation for an
amount equal to 0.25 % per week or part thereof of the balance value of the
incomplete work or such amount as the Commission may decide on the balance value
of price of the incomplete work but not exceeding 10% on the total value of the order.
12.
Payment terms.
(a)
No advance payment will be made.
(b)
The invoice shall be raised in favor of The Secretary, Delhi Electricity
Regulatory Commission.
(c)
Payment will be released through cheque in the name of successful bidder
after satisfactory supply, installation and commissioning of Air Purifier.
(d)
Payment shall not be more than the contracted value as given in the
award letter.
13.
Termination of supply order. The Commission shall have the right to cancel
the Supply order in part or in full in any of the following cases :(a)
The supply is delayed for causes not attributable to natural calamity for
more than 15 days after the scheduled date of Work Order.
(b)
The bidder is declared bankrupt or becomes insolvent.
(c)
For any other reasons which , in the opinion of Commission, warrants
Cancellation of supply order.
14 The sealed proposal should be submitted to The Secretary, Delhi Electricity
Regulatory commission, Viniyamak Bhawan, C-Block, Shivalik, Malviya Nagar, New
Delhi-110017.
15. DERC Reserve the right to accept or reject any/all proposal without assigning any
reason or incurring any liability whatsoever.

Rates Quoted should be Net Unit Rate. (Inclusive of all charges such as packing,
forwarding, freight, labour, and excise duty as applicable in various states and installation
charges at sites, excise duty and sales tax / VAT as applicable should also be included
