Board the 75TH Annual Report of the Mobile County Merit System as prepared by our Director
and Staff.
The Staff at the Personnel Department continues to focus on customer service as a
primary objective. Our ability to focus on improved customer service is enabled through
employing new technology and software. We will continue to seek opportunities in this arena to
increase efficiency and responsiveness.
Our task continues to be one that seeks and employs more efficient and effective ways

The Personnel Board for Mobile County, Alabama
Dear Members,
2014 encompasses a second full year of application submittals, processing of
applications, and referral lists which are sent electronically versus hardcopy mail to all
Appointing Authorities.
Activities within the Department reflect a variety of initiatives: from
employee and department engagements with our Job Analysis Programs to focus on immediate
feedback to varied requests from Jurisdictions. The chart below lists areas of activities with
comparative data for 2013 versus 2014.

The data reveals decreases in the number of promotional examinations announcements,
number of applicants, and appointments made from certifications; however, increases are noted
in the number of Certifications Issued (598 compared to 621), the number of Oral Examinations
(1 compared to 69), and the number of Successful Applicants (5,434 compared to 8,906).

PERSONNEL BOARD
At the annual meeting of the Supervisory Committee held June 10, 2014, the Committee
elected Mrs. Stephanie K. Alexander as Board Member Number Two to represent Personnel
Board District Two as successor to Annie S. Galloway whose term expired September 15, 2014.
Mr. Sydney Raine currently serves as Chairman and Mr. Frank Sullivan serves as ViceChairman of the Personnel Board.

The Board held 12 regular meetings and 15 special meetings during 2014, including 19
meetings at which public hearings were held, for a total of 27 meetings. The Board also held 38
public hearings on disciplinary matters.
HEARINGS ON APPEALS
During the year 2014 the Board held sixteen hearings on appeals from dismissal. The
Appointing Authority was upheld completely in nine cases.
Three hearings convened and
settlement agreements were read into the record. At one hearing the employee withdrew his
appeal. In two cases, one dismissal was altered to a suspension and one dismissal reversed to
a reprimand. The Board rendered one order that carried a dissenting opinion. One decision
was appealed to Circuit Court.
There were ten suspension hearings held by the Board. The Appointing Authority was
upheld completely in six cases. One suspension was set aside completely. One case was
dismissed due to an employee who failed to appear. At one hearing the employee withdrew his
appeal.
One hearing was held that included two suspensions. The employee withdrew his first
appeal. The Board convened the hearing, and a settlement agreement was read into the record
for the second appeal.
Seven hearings held by the Board were for appeals from demotion. In five cases the
Appointing Authority was upheld and in one case the demotion was reversed and the employee
was reinstated. In one case the employee withdrew his appeal. Three decisions of the Board
were appealed to Circuit Court.
The Board held five hearings that were appeals to step three of the grievance procedure.
The Appointing Authority was upheld in two cases. One employee withdrew his appeal, and
one case was dismissed due to want of prosecution for failure to appear by the employee. In
one hearing, the decision was reversed to a satisfactory rating. One decision of the Board was
appealed to Circuit Court.

LEGAL
Listed below is a summary of all court cases filed or continuing in 2014. The Attorney and
Assistant Attorney for the Board also rendered legal opinions on the application of laws, rules
and regulations, and conducted hearings on appeals from dismissal, demotion, suspension, and
grievances.
CITY OF MOBILE POLICE DEPARTMENT V. MOBILE COUNTY PERSONNEL BOARD AND
CASSANDRA MATTHEWS (Case No. CV-2011-1196)
The Public Safety Dispatcher II with the City of Mobile Police Department was
suspended from her employment for a period of 24 working hours without pay effective
February 21, 2011, for insubordination. On February 15, 2011, the employee appealed the
suspension to the Board.
Subsequently, the employee was then terminated from her
employment effective May 2, 2011, for conduct unbecoming an employee in the public service,
incompetency, and violation of any lawful or reasonable regulations or order made and given by
a superior officer. On May 13, 2011, the employee appealed this termination to the Board, and
the matter was heard on July 12, 2011. The Board entered an Order dated July 26, 2011, which
modified the termination to a suspension and reinstated her employment effective July 30, 2011.
On July 28, 2011, the City of Mobile Police Department appealed the Board's Order of
July 26, 2011, which amended and modified the termination of Cassandra Matthews. The
certified transcript of the proceedings before the Board was filed in the Circuit Court on
September 8, 2011.
On March 12, 2014 the Hon. Ben Brooks ruled that the termination hearing for Matthews
was not held in compliance with Rule 14.3(a) and reinstated Matthews to her position effective

On May 23, 2014, Matthews filed an appeal with the Alabama Court of Civil Appeals
regarding a post-judgment motion to alter, amend or vacate the court’s Order of April 14, 2014,
in the Mobile County Circuit Court Case No. CV-2011-1196.
CASSANDRA MATTHEWS v. MOBILE COUNTY PERSONNEL BOARD AND THE CITY OF
MOBILE POLICE DEPARTMENT (Case No. CV-2012-844)
The Public Safety Dispatcher II with the City of Mobile Police Department filed a Step III
Grievance against the MPD on March 15, 2012, regarding an unsatisfactory service rating. The
matter was heard on May 1, 2012, and the Board entered an Order dated June 5, 2012, denying
the employee’s Step III Grievance.
On June 15, 2011, the employee appealed the Board's Order of June 5, 2012, which
denied the employee’s Step III Grievance. The certified transcript of the proceedings before the
Board was filed in the Circuit Court on November 1, 2012. On August 27, 2013 the court, based
on Mobile County Personnel Board v. Mobile Area Water, 2013 WL 3482210 (Ala. Civ.App.
2013), found that the MCPB did not have standing in this case, and rendered MCPB pleadings
moot, and ordered the City of Mobile to file its own pleadings. The matter is pending before the
Honorable Sarah H. Stewart for legal argument.

affirmed the employee’s termination. The certified transcript of the proceedings before the
Board was filed in the Circuit Court on September 16, 2013. The City of Mobile filed its trial brief
on November 14, 2013 and Matthews filed her trial brief on November 15, 2013. The matter is
pending before the Honorable Sarah H. Stewart for legal argument.
CARLA LONGMIRE v. CITY OF MOBILE POLICE DEPARTMENT (Case No. CV-2014-113)
The Police Captain with the City of Mobile Police Department was demoted to Police
Lieutenant effective December 17, 2013, for conduct unbecoming. On December 20, 2013, the
employee appealed the suspension to the Board. The matter was heard on March 6, 2014, and
the Board entered an Order dated March 20, 2014, affirming the demotion.
On April 2, 2014, the employee appealed the Board's Order of March 20, 2014, which
affirmed the employee’s demotion. The certified transcript of the proceedings before the Board
was filed in the Circuit Court on May 29, 2014. Longmire filed a Motion for Summary Judgment

pursuant to Rule 56 on June 26, 2014, and a hearing on all pending motions was set for
September 3, 2014. The City of Mobile filed its trial brief on August 15, 2014, and Longmire
filed her trial brief on August 15, 2014. Judge Ben Brooks entered an Order that the matter will
be taken under submission and set a status hearing on December 3, 2014. He further ordered
that each party file a Proposed Order no later than September 24, 2014. Both Longmire and the
City of Mobile filed their proposed Orders on September 23, 2014. The matter is pending before
the Honorable Ben H. Brooks for legal argument and is set for hearing on May 1, 2015.
DAVID JAY MILLER v. CITY OF MOBILE POLICE DEPARTMENT (Case No. CV-2014-138)
The Public Safety Dispatcher II with the City of Mobile Police Department was demoted
to Public Safety Dispatcher I effective November 13, 2013, for failure to obey a direct order. On
November 18, 2013, the employee appealed the suspension to the Board. The matter was
heard on March 20, 2014, and the Board entered an Order dated April 3, 2014, affirming the
demotion.
On April 15, 2014, the employee appealed the Board's Order of April 3, 2014, which
affirmed the employee’s demotion. The certified transcript of the proceedings before the Board
was filed in the Circuit Court on May 29, 2014.
The matter was set for a bench trial on
November 24, 2014. On October 1, 2014, Miller filed a Rule 60(b) motion. The City of Mobile
filed its trial brief on November 5, 2014, and Miller filed a continuance on November 19, 2014.
The trial was reset to March 18, 2015. Wanda Rahman, attorney for the City of Mobile Police
Department, and James Brandyburg, attorney for the Mobile County Personnel Board,
appeared in court on March 18, 2015; Miller nor his attorney, Carrol Ogden, appeared for trial.
Judge Robert Smith ordered that each party file a Proposed Order no later than April 1, 2015.
The matter is pending before the Honorable Robert H. Smith.

BARBARA JOHNSON v. CITY OF MOBILE
The Environmental Patrol Officer II with the City of Mobile Municipal Enforcement
Department filed a Step II Grievance with the Mobile County Personnel Board on December 9,
2013, regarding her annual service rating and working conditions. The matter was heard by the
Board on July 29, 2014. The Board entered an Order dated August 12, 2014, denying the Step
II grievance.
On August 15, 2014, the employee appealed the Board's Order of August 12, 2014,
which denies the employee’s Step II Grievance. The certified transcript of the proceedings
before the Board was filed in the Circuit Court on September 26, 2014. The employee failed to
pay the required filing fee to the court and the transcript was remanded back to the Board by
Order dated December 9, 2014.
TY CRISWELL, ET AL v. MOBILE HOUSING BOARD AND THE PERSONNEL BOARD FOR
MOBILE COUNTY, ALABAMA (Federal Court Case No. 1:14-cv-447)
Ty Criswell, Ronald Coffman, Eric Knight, Samuel McCord, Denisa Peacock, Joe Frank
Smiley, Jr. and Christopher Weaver filed a Complaint in the District Court of the Southern
District of Alabama, Southern Division on September 26, 2014, against the Mobile Housing
Board, seeking relief pursuant to the Fair Labor Standards Act of 1938. Then on November 24,
2014, they filed an Amended Complaint to include the Mobile County Personnel Board. The
matter is currently set for trial by jury on April 2016.
MICHAEL SMITH v. CITY OF MOBILE POLICE DEPARTMENT (Case No. CV-2014-268)
The Police Sergeant with the City of Mobile Police Department was terminated from his
employment effective September 12, 2014, for conduct unbecoming, misuse of position, failure
to obey a direct order, bias based profiling, and disobedience of orders. On September 12,
2014, the employee appealed the termination to the Board.

The matter was heard on
November 13, 2014, and the Board entered an Order dated December 1, 2014, affirming the
termination.
On December 12, 2014, the employee appealed the Board's Order of December 1,
2014, which affirmed the employee’s termination, directly to the Mobile County Circuit Court. A
Motion to Dismiss was filed on March 2, 2015, by the Mobile County Personnel Board. All
pending motions were heard by Judge Joseph Johnston on March 6, 2015, and an Order was
entered that set the deadline for trial briefs for April 10, 2015, and setting the matter for hearing
on May 15, 2015.
SHERRY BARNES v. CITY OF MOBILE (Case No. CV-2013-000064)
Sherry Barnes, former Public Safety Dispatcher II with the City of Mobile Police
Department, appealed the Board’s order upholding termination of her employment for failing to
promptly repay money paid over to her in error. The case is pending.
ANGELA WRIGHT v. CITY OF MOBILE (Case No. CV-2013-117)
The former Public Safety Dispatcher II of the City of Mobile Police Department appealed
the Board’s decision to affirm her dismissal of employment for violation of department general
orders.
The Circuit Court modified the Board ordered termination and imposed a 30-day
suspension. The court’s judgment was upheld by the Alabama Court of Civil Appeals on August
31, 2014. The Alabama Supreme Court denied certiorari.
HESTER LINGO v. MOBILE COUNTY PERSONNEL BOARD AND CITY OF MOBILE (Case
No. CV-2014-000040)
The former Court Referral Officer II of the City of Mobile Municipal Court appealed the
Board’s decision to terminate employment for violation of commission of a criminal act, conduct
unbecoming an employee in the public service, and public intoxication while off duty. The case
is pending.

KAREN BROWN v. MOBILE COUNTY PERSONNEL BOARD AND MOBILE COUNTY (Case
No. CV-2013-000064)
Karen Brown, former Automotive Parts Buyer with Mobile County Public Works
Department appealed the Board’s order upholding termination of her employment on March 7,
2014. The employee failed to pay the required filing fee to the court, and the appeal case was
dismissed by Order of Circuit Court dated July 8, 2014.
WILLIAM PATRICK v. MOBILE COUNTY PERSONNEL BOARD AND CITY OF MOBILE
POLICE DEPARTMENT (Case No. CV-2014-141)
On May 13, 2014, William Patrick appealed the decision of the Mobile County Personnel
Board affirming his demotion from the position of Police Captain to Police Lieutenant in the
Mobile Police Department. On October 16, 2014, Mr. Patrick voluntarily dismissed the appeal
case.
CITY OF MOBILE v. MOBILE COUNTY PERSONNEL BOARD AND JOHN COLLINS (Case
No. CV-2014-00218)
John Collins, Crew Chief with the City of Mobile Public Works Department was
dismissed from his employment effective June 9, 2014 for conduct unbecoming an employee in
the public service, insubordination, neglect of duty, negligence or willful damage to public
property, supplies, or equipment, and violation of any lawful or reasonable regulation or order
made or given by a superior officer. The employee appealed the dismissal to the Board and the
matter was heard on August 28, 2014. The Board entered an Order dated September 9, 2014,
which modified the dismissal to suspension for the term of 100 days. The City of Mobile served
notice of its appeal of the Board’s Order entered for Mr. Collins on September 18, 2014. The
case is pending.

AMENDMENTS TO THE RULES
A public hearing was held on September 16, 2014, to consider a proposed amendment to
Personnel Board Rule 3.2, Reports of Absence. The proposed amendment was approved on
that date. Rule 3.2 now reads as follows:
“The absence of an employee from duty shall be reported to the Director by the
Appointing Authority or department head. Reports shall be made in a format
acceptable to the Director and submitted to the Personnel Department in
sufficient time for verification.
The reason for absence shall be stated; if
unauthorized it shall be reported as “Absent Without Leave.”
PROMOTIONS
There were 264 promotional appointments resulting from 124 promotional examinations
processed in 2014.
CLASSIFICATION AND PAY
The Personnel Board adopted specifications and salary grades for 14 new classes in
2014. In addition, the Board approved amendments to the pay plan for already existing classes
and revisions to nine existing specifications.
Also, the Board re-established two
specifications. The following jurisdictions granted 5% cost of living increase:
the
City

of
Bayou La Batre effective February 24, 2014; the Water Works and Sewer Board of the City of
Prichard effective November 15, 2014; and the Utilities Board of the City of Bayou La Batre
effective November 15, 2014. The following jurisdictions granted a 2.5% cost of living increase:
the City of Mobile effective October 4, 2014; Mobile Public Library effective October 5, 2014;
Mobile Area Water and Sewer System effective December 27, 2014; Mobile County effective
October 11, 2014; and Mobile County Emergency Management Agency effective November 1,
2014.

VETERANS
A total of 514 employees received paid leave to participate in military training during
2014. At the beginning of the calendar year 2014, seventeen of our Merit System employees
were still on military leave and thirty-four additional employees were granted leave during the
year. Thirty employees safely returned to their job during the year, and nineteen employees
were still out as of December 31, 2014.
Also, extra points were awarded to 218 veterans who applied for open competitive
examinations during 2014.
INFORMATION SYSTEMS
We continued our work with our document management system by adding the capability
to process several more document types. Office staff continues the bulk scanning of employee
folders and jurisdiction correspondence. One of the benefits to this is providing legal
documentation as requested by our attorneys in a much more portable and convenient fashion.
We progressed forward into social media in March by launching our Facebook page.
Within one year, we have reached over 500 fans and hope to move forward with this method of
communication. Job postings, holiday closings, and helpful hints make up the majority of our
status updates. Our goal is to make our employment options available to a wider audience, and
looks productive in the right direction.
We have added two agencies to our electronic time entry process, and plan to add at
least two more agencies to the electronic register verification process. These enhancements
allow our in-house payroll verification system to decrease payroll processing time and enable us
to turn around certified payrolls in a shorter amount of time.

On the applicant side, a new job analysis system was put in place. As part of this
process, we added an Office Skills Assessment program. We set up a server specifically for this
to provide our analysts with the system they needed to create valid assessment tools.
Our goal for 2015 is to continue moving forward in all of these areas in order to provide
improved services to our staff, the agencies, the merit system employees and the public.
TRAINING & RECRUITMENT
In 2014, the training area’s focus was primarily on the delivery of quality training to the
employees of the jurisdictions we serve. Outside recruitment activities have for the most part
been curtailed. Participation was limited to a few events.
In addition to training, the area’s responsibilities included the processing of test results
for typing proficiency, jurisdictional employee development incentives, and employees
grievances.
A summary of activities in these areas are shown below with the exception of
grievances. A more detailed report of grievances was included in an earlier section of the
annual report.
The concluding table describes the volume of activities for 2014 and compares the
results with those of 2012 and 2013. We are pleased to see that training participation continues
to increase. We did not receive requests in 2014 for special on-site jurisdictional training. We
anticipate a change in this area for 2015.
