REFUSED DUE TO THE FOLLOWING REASON(S):
1 The proposal is contrary to Policies MTRA1 - MTRA4 of the Local Plan Part 1 Joint Core Strategy, the saved policies of the Winchester District Local Plan Review
2006 (particularly H3), emerging Policy DM1 of the Local Plan Part 2 and the
National Planning Policy Framework in that it represents residential development
outside the settlement boundary of Colden Common. There is no justification for
making an exception to these policies as the Council can demonstrate an adequate
supply of housing land.
2 The proposal would be so significant that to grant permission would undermine
the Local Plan Part 2 process by predetermining decisions about the scale, location
or phasing of new development that are central to the emerging Local Plan, which is
at an advanced stage but not yet formally part of the development plan.
3 The proposed development is contrary to Policies CP20 of the Local Plan Part 1
- Joint Core Strategy and Policy DP3 of the Winchester District Local Plan Review
2006 in that it would extend development outside the built-up area of Colden
Common into an area of countryside which is highly sensitive and falls within the
Durley Claylands Landscape Character Area. By introducing development on this
site the proposals would be detrimental to the landscape character of this area and
the rural setting of Colden Common.
4 The proposed development is contrary to Policy CP3 of the Winchester District
Local Plan Part 1 - Joint Core Strategy, in that it fails to make appropriate provision
for affordable housing.

5 The proposed development is contrary to Policy CP21 of the Winchester District
Local Plan Part 1 - Joint Core Strategy, in that it fails to make contributions towards
Education.

Council (WCC) take a positive and proactive approach to development proposals
focused on solutions. WCC work with applicants/agents in a positive and proactive

Reason: To ensure a satisfactory visual relationship between the new development
and the existing.
3 No development shall take place until a landscape plan to include details of both
hard and soft landscape works have been submitted to and approved in writing by
the Local Planning Authority and these works shall be carried out as approved.
These details shall include the following, as relevant:
existing and proposed finished levels (including plans and sections with
existing and proposed floor and ground levels) and contours;
means of enclosure, including any retaining structures, boundary treatments
and planting borders;
hard surfacing materials.

Soft landscape details shall include the following as relevant:

The above details shall be implemented in accordance with the approved details
before the building is occupied. If within a period of five years after planting any tree

seriously damaged, defective or diseased another tree or plant of the same species
and size as that originally approved shall be planted at the same place, within the
next planting season.
Reason: To improve the appearance of the site in the interests of visual amenity.
4 The proposed access and drive, shall be laid out and constructed in accordance
with specifications to be first submitted to and approved in writing by the Local
Planning Authority.

5 The gradient of the drive shall not exceed 8% within 6 metres of the edge of the
adjoining carriageway.

7 The parking areas including the garages shall be provided in accordance with
the approved plans before the dwellings are first occupied and thereafter
permanently retained and used only for the purpose of accommodating private
motor vehicles or other storage purposes incidental to the use of the dwelling.

8 Prior to the commencement of the development hereby permitted detailed
information (in the form of SAP design stage data and a BRE water calculator)
demonstrating that all homes meet the Code 4 standard for energy and water (as
defined by the ENE1 and WAT 1 in the Code for Sustainable Homes) shall be
submitted to and approved in writing by the Local Planning Authority. The
development shall be built in accordance with these findings.
Reason: To ensure a sustainable form of development consistent with the objectives
of The National Planning Policy Framework 2012 and to accord with the
requirements of Policy CP11 of the Winchester District Local Plan Part 1 - Joint Core
Strategy.
9 Prior to the occupation of the dwelling hereby permitted detailed information (in
the form of SAP "as built" stage data and a BRE water calculator) demonstrating
that all homes meet the Code 4 standard for energy and water (as defined by the
ENE1 and WAT 1 in the Code for Sustainable Homes) shall be submitted to and
approved in writing by the Local Planning Authority. The development shall occupied
in accordance with these findings.
Reason: To ensure a sustainable form of development consistent with the objectives

Reason: To ensure the avoidance of doubt and the satisfactory appearance of the
development.
11 Before the commencement of development, an updated Arboricultural Impact
Appraisal and Method Statement demonstrating protection measures during any
development and post occupancy shall be submitted to and approved by the Local
Planning Authority. It is a requirement that these documents are to be in accordance
with BS5837:2012 - Trees in relation to design, demolition and construction or any
subsequent revisions. All protective measures, including fencing, shall be installed in
accordance with the approved details, prior to any demolition, construction or
groundwork commencing on the site and shall be retained until the completion of the
development.
Reason: To ensure protection and long term viability of retained trees and to
minimise impact of construction activity.
12 The Arboricultural Officer shall be informed once protective measures have
been installed so that the Construction Exclusion Zone can be inspected and
deemed appropriate and in accordance with Tree Protection Plan

13 Notwithstanding the provisions of the Town and Country Planning (General
Permitted Development) Order 2015 (or any Order revoking and re-enacting that
Order with or without modification) no development permitted by Classes A, B, C, D,
E, F and G of Part 1 and Class A of Part 2 of Schedule 2 of the Order, shall be
carried out without the prior written consent of the Local Planning Authority.
Reason: To protect the amenities of the locality and to maintain a good quality
environment.
14 The first floor window in the south-eastern elevation of the dwelling hereby
permitted shall be glazed with obscure glass which achieves an obscuration level at
least equivalent to Pilkington Obscure Glass Privacy Level 4, unless otherwise
agreed in writing by the local planning authority, and the glazing shall thereafter be
retained in this condition at all times.
Reason: To protect the amenity and privacy of the adjoining residential properties.
15 Detailed proposals for the disposal of foul and surface water shall be submitted
to and approved in writing by the Local Planning Authority before the

recognised public holidays. Where allegations of noise from such works are
substantiated by the Environmental Protection Team, a Notice limiting the hours of
operation under The Control of Pollution Act 1974 may be served.
During Construction, no materials should be burnt on site. Where allegations of
statutory nuisance are substantiated by the Environmental Protection Team, an
Abatement Notice may be served under The Environmental Protection Act 1990.

or their agents or successors in title has secured the implementation of a
programme of archaeological mitigation work in accordance with a Written Scheme
of Investigation that has been submitted to and approved by the local planning
authority in writing. No demolition/development or site preparation shall take place
other than in accordance with the Written Scheme of Investigation approved by the
LPA. The Written Scheme of Investigation shall include:
1. An assessment of significance and research questions
2. The programme and methodology of site investigation and recording

12 Following completion of all archaeological fieldwork a report will be produced in
accordance with an approved programme including where appropriate postexcavation assessment, specialist analysis and reports and publication.
Reason: To ensure that evidence from the historic environment contributing to our
knowledge and understanding of our past is captured and made publicly available,
in compliance with policy HE.1 of the Winchester District Local Plan Review.
13 Before any works hereby permitted are begun, details of the foundations and any
drainage and services, to include a detailed design and method statement, shall be
submitted to and approved in writing by the Local Planning Authority, such details to
show how surviving archaeological remains are to be preserved.
Reason: To ensure the conservation and protection of important archaeological
remains present within the site, in compliance with policy HE.1 of the Winchester
District Local Plan Review.
14 No development or preparatory works shall be undertaken until a European
Protected Species Licence has been applied for and secured; details or which shall
be submitted to the Local Planning Authority. All works affecting European protected
bats will then proceed in accordance with the approved bat mitigation plan.
Reason: In order to mitigate the loss of protected species in the interests of the
ecology of the area and In accordance with ODPM Circular 06/2005.

surface water drainage for the site is via a watercourse. The Council's technical staff
and the relevant authority for land drainage consent should comment on the
adequacy of the proposals to discharge surface water to the local watercourse.
We request that should this application receive planning approval, the following
condition is attached to the consent: "Construction of the development shall not
commence until details of the proposed means of foul and surface water sewerage
disposal have been submitted to, and approved in writing by, the Local Planning
Authority in consultation with Southern Water."

Reason: To ensure a satisfactory relationship between the new development and
adjacent buildings, amenity areas and trees.
11 Notwithstanding the provisions of the Town and Country Planning (General
Permitted Development) Order 1995, (or any order revoking and re-enacting that
order, with or without modification), no windows other than those expressly
authorised by this permission shall, at any time, be constructed in the side
elevation(s) of dwellings hereby permitted.
Reason: To protect the amenity and privacy of the adjoining residential properties.
12 The first floor window(s) in the side elevation of the dwellings hereby permitted
shall be glazed with obscure glass which achieves an obscuration level at least
equivalent to Pilkington Obscure Glass Privacy Level 4, unless otherwise agreed in
writing by the local planning authority, and the glazing shall thereafter be retained in
this condition at all times.

13 The development shall be carried out in accordance with the measures set out
within Ecological report carried out by Andrew Quayle date: 20/6/16 reference : 75
Downs Rd Extended Phase 1 Ecological Survey. Details of mitigation shall be
submitted to and approved in writing by the Local Planning Authority prior to any site
preparation works and demolition. Thereafter, the compensation measures shall be
permanently maintained and retained in accordance with the approved details.
Reason: To provide adequate mitigation and enhancement for protected species.
14 A detailed scheme for hard and soft landscaping, tree and/or shrub planting shall
be submitted to and approved in writing by the Local Planning Authority before
development commences. The detailed scheme shall specify porous hardsurface
treatments, species, density, planting, size and layout. The scheme approved shall
be carried out in the first planting season following the occupation of the building or
the completion of the development whichever is the sooner. If, within a period of 5
years from the date of planting, any trees, shrubs or plants die, are removed or, in
