PREFACE
BasketballAustraliaiscommittedtothehealth,safetyandwell-beingofallitsmembersand
participantsandisdedicatedtoprovidingasafeenvironmentforparticipatinginthesportof
basketballthroughoutAustralia.
Thepositivevirtuesofinvolvementinthesportofbasketballarewellheraldedandevidencedbythe
thousandsofyoungAustraliansparticipatinginbasketballactivitiesandcompetitionacrossthecountry
eachweek.Thevalueofregularexercisegainedthroughbasketballtoanindividual’spersonalhealth
andfitnessshouldnotbeunderestimated,northerolethatsocialinteractionprovidedthroughthe
basketballassociationenvironment,whichcanplayindevelopingayoungperson’sself-esteemand
involvementintheirlocalcommunity.
However,harassmentinsportcanservetodrasticallyunderminetheseintrinsicbenefitsof
involvementinbasketball.Theunfortunaterealityisthatbasketball,asasport,isnotimmunefrom
actsofdiscrimination,harassmentandabuse,rathertothecontrary,sportmayprovidean
environmentwhichinmanycaseslendsitselftoconductwhichisnotonlyinappropriate,butalso
unlawful.
Dependingonthenatureofthecase,instancesofharassmentorabuseinsportcanhavedevastating
effectsfornotonlytheindividualsinvolved,butalsothesportingorganisationitself.Apartfrom
exposingthecluborassociationtopotentiallegalliability,officialsmaybefacedwithlowmorale,an
unpleasantenvironment,higherturnoverofpersonnelandtheprospectoflong-termdamagetothe
organisation’simageandreputation.TheseareallunnecessaryharmswhichBasketballAustraliais
anxioustoavoid.
TheadoptionoftheBasketballAustraliaMemberProtectionBy-LawreflectsBasketballAustralia’s
dedicationtoservingandprotectingitsmembersandparticipantsthroughoutalllevelsofthesport.
However,theadoptionoftheMemberProtectionBy-Lawitselfisjustthefirststepinaffordingour
membersandparticipantstheprotectiontheydeserve.TheBy-Lawsetsoutthecodesofbehavior
thateveryoneassociatedwithBasketballAustraliaisexpectedtoabidebyanddisciplinaryactionwill
betakenwhenitisbreached.ThesuccessfulimplementationandenforcementofthisMember
ProtectionBy-LawrequiresthecooperationandcommitmentofBasketballAustraliamembersand
participantsatalllevels.
ThefollowingMemberProtectionBy-LawconveysastrongmessagetoallBasketballAustralia
membersandparticipants,andprospectivemembersandparticipants,thatasasport,weare
committedtoensuringthesafetyofourmostvaluableassetwellintothefuture.

Introduction
Basketballiseveryone’sgameandisoneofthemostpopulargamesintheworld,with214nations
participatingandaround1.2millionAustraliansparticipatinginthegameeachyear.Basketball
Australia’smissionistoigniteAustralia’spassionforbasketballthroughgrowth,successandunity.
Criticaltotheachievementofthismissionistheprovisionofsafeandinclusiveenvironmentswherever
basketballisplayed.
2.
PurposeofthisBy-Law
ThisMemberProtectionBy-Law(“By-Law”)aimstoassistBasketballAustraliatoupholditscorevalues
andcreateasafe,fairandinclusiveenvironmentforeveryoneassociatedwithoursport.Itsetsoutour
commitmenttoensurethateverypersoninvolvedinoursportistreatedwithrespectanddignityand
protectedfromdiscrimination,harassmentandabuse.Italsoensuresthateveryoneinvolvedinour
sportisawareoftheirlegalandethicalrightsandresponsibilities,aswellasthestandardsofbehavior
expectedofthem.
TheBy-Lawattachmentsdescribethepracticalstepswewilltaketoeliminatediscrimination,
harassment,childabuseandotherformsofinappropriatebehaviorfromoursport.Aspartofthis
commitment,BasketballAustraliawilltakedisciplinaryactionagainstanypersonororganisation
boundbythisBy-Lawiftheybreachit.
ThisBy-LawhasbeenendorsedbytheboardofBasketballAustraliaandhasbeencreatedasaBy-Law
underclause21.1ofBasketballAustralia’sconstitution.TheBy-Lawcommencedon19October2015
andwilloperateuntilreplaced.CopiesofthecurrentBy-Lawanditsattachmentscanbeobtainedfrom

ThisBy-LawissupportedbyMemberProtectionPoliciesthathavebeenadoptedandimplementedby
ourmemberassociationsandaffiliatedclubs.
3.
WhoisboundbythisBy-Law
3.1
ThisBy-Lawappliestothefollowingpeoplewhethertheyareinapaidorunpaid/voluntary
capacity:
3.1.1 Personsappointedorelectedtoboards,committeesandsub-committeesofBasketball
Australia,ConstituentAssociations,AffiliatedLeagues,AssociationsandClubs;
3.1.2 EmployeesofBasketballAustralia,ConstituentAssociations,AffiliatedLeagues,
AssociationsandClubs;
3.1.3 SupportpersonnelappointedorelectedtoteamsandsquadsthatrepresentBasketball
Australia,ConstituentAssociations,AffiliatedLeagues,AssociationsandClubs;(e.g.
managers,physiotherapists,psychologists,masseurs,sporttrainers);
3.1.4 CoachesandassistantcoachesappointedorelectedtoteamsthatrepresentBasketball
Australia,ConstituentAssociations,AffiliatedLeagues,AssociationsandClubs;
3.1.5 AthletesappointedorelectedtoteamsthatrepresentBasketballAustralia,Constituent

3.1.9 Anyotherpersonororganisationincludingspectators,parents/guardiansandsponsors,
whoorwhichagreesinwriting(whetheronaticket,entryformorotherwise)tobe
boundbythispolicy.
3.2
Thispolicyalsoappliesto:
3.2.1 ConstituentAssociations;
3.2.2 LeagueAssociations;
3.2.3 AffiliatedAssociations;
3.2.4 Clubs.
3.3
TheassociationsboundbythisBy-Lawunderclause3.2arerequiredtoadoptandimplementa
similarpolicy(orBy-Law)andtoprovideprooftoBasketballAustraliaoftheapprovalofthe
policy(orBy-Law)bytherelevantboardinaccordancewithitsconstitution.Eachassociation
mustalsoundertaketoensurethataffiliatedclubsandindividualmembersareboundbythis
policyandaremadeawareofthispolicyandwhatitsays.
3.4 ThisBy-Lawwillcontinuetoapplytoaperson,evenaftertheyhavestoppedtheirassociationor
employmentwithBasketballAustralia,ifdisciplinaryactionagainstthatpersonhascommenced.
4.
Organisationalresponsibilities
BasketballAustralia,ConstituentAssociations,LeagueAssociations,AffiliatedAssociationsandClubs
must:
4.1
Adopt,implementandcomplywiththisBy-Law;
4.2
EnsurethattheConstitution,By-Lawsorotherrulesandpoliciesincludethenecessaryclauses
forthispolicytobeenforceable;
4.3
Publish,distributeandpromotethisBy-Lawandtheconsequencesofanybreaches;
4.4 Promoteandmodelappropriatestandardsofbehavioratalltimes;
4.5
DealwithanybreachesorcomplaintsmadeunderthisBy-Lawinasensitive,fair,timelyand
confidentialmanner;
4.6
ApplythisBy-Lawconsistently;
4.7
RecogniseandenforceanypenaltyimposedunderthisBy-Law;
4.8
EnsurethatacopyofthisBy-Lawisavailableoraccessibletoallpeopleandorganisationsto
whomthisBy-Lawapplies;
4.9
Useappropriatelytrainedpeopletoreceiveandmanagecomplaintsandallegationsof
inappropriatebehaviour,forexample,butnotlimitedto,MemberProtectionInformation
Officers(MPIOs),whichincludesanAffiliatedAssociationorClubreferringmatterstoa
ConstituentAssociationforthemtodealwith;and
4.10 MonitorandreviewthisBy-Lawatleastannually.
5.
Individualresponsibilities
IndividualsboundbythisBy-Lawareresponsiblefor:
5.1 MakingthemselvesawareoftheBy-Lawandcomplyingwiththeallrelevantprovisionsincluding
thecodesofbehaviouritsetsout;
5.2 ConsentingtothescreeningrequirementssetoutinthisBy-Lawandanystate/territoryWorking
withChildrenChecksifthepersonholdsorappliesforarolethatinvolvesregularunsupervised
contactwithachildoryoungpersonundertheageof18,orwhereotherwiserequiredbylaw;

5.3 Placingthesafetyandwelfareofchildrenaboveotherconsiderations;
5.4 Beingaccountablefortheirbehaviour;
5.5 FollowingthestepsoutlinedinthisBy-Lawformakingacomplaintorreportingpossiblechild
abuse;and
5.6 Complyingwithanydecisionsand/ordisciplinarymeasuresimposedunderthisBy-Law.
6.
Positionstatements
6.1 Childprotection
BasketballAustraliaiscommittedtothesafetyandwell-beingofallchildrenandyoungpeople
whoparticipateinoursportoraccessourservices.Wesupporttherightsofthechildandwill
actatalltimestoensurethatachild-safeenvironmentismaintained.BasketballAustralia
acknowledgesthevaluablecontributionmadebyourstaff,membersandvolunteersandwe
encouragetheiractiveparticipationinprovidingasafe,fairandinclusiveenvironmentforall
participants.Weaimtocontinuethisandtotakemeasurestoprotectthesafetyandwelfareof
childrenparticipatinginoursportby:
6.1.1 Identifyingandanalysingriskofharm
BasketballAustraliawilldevelopandimplementariskmanagementstrategy,includingareview
ofourexistingchildprotectionpractices,todeterminehowchild-safeourorganisationisandto
identifyanyadditionalstepswecantaketominimiseandpreventtheriskofharmtochildren
becauseoftheactionsofanemployee,volunteeroranotherperson.
6.1.2 Developingcodesofbehaviour
BasketballAustraliahasdevelopedandpromotesacodeofbehaviorthatsetsouttheconduct
weexpectofadultswhentheydealandinteractwithchildreninvolvedinoursport,especially
thoseinourcare.Wehavealsoimplementedacodeofbehaviortopromoteappropriate
conductbetweenchildren.RefertotheattachmentsinPartBofthisBy-Law.
6.1.3 Choosingsuitableemployeesandvolunteers
BasketballAustraliawilltakeallreasonablestepstoensurethatweengagesuitableand
appropriatepeopletoworkwithchildren,especiallythoseinpositionsthatinvolveregular
unsupervisedcontactwithchildren.Thiswillincludeusingarangeofscreeningmeasures.
BasketballAustraliawillensurethatWorkingwithChildrenChecksareconductedforall
employeesandvolunteerswhoworkwithchildren,whereanassessmentisrequiredbylaw.Ifa
criminalhistoryreportisobtainedaspartoftheirscreeningprocess,BasketballAustraliawill
handlethisinformationconfidentiallyandinaccordancewiththerelevantlegalrequirements.

6.1.4 Supporting,training,supervisingandenhancingperformance
BasketballAustraliawillensurethatallouremployeesandvolunteerswhoworkwithchildren
haveongoingsupervision,supportandtraining.Ourgoalistodeveloptheirskillsandcapacity
andtoenhancetheirperformancesowecanmaintainachild-safeenvironment.
6.1.5 Empoweringandpromotingtheparticipationofchildren
BasketballAustraliawillencouragechildrenandyoungpeopletobeinvolvedindevelopingand
maintainingachild-safeenvironmentforoursport.
6.1.6 Reportingandrespondingappropriatelytosuspectedabuseandneglect
BasketballAustraliawillensurethatallemployeesandvolunteersareabletoidentifyand
respondappropriatelytochildrenatriskofharmandthattheyareawareoftheirresponsibilities

understatelawstomakeareportiftheysuspectonreasonablegroundsthatachildhasbeen,
orisbeing,abusedorneglected.RefertotheattachmentsinPartEofthisBy-Law.
Further,ifanypersonbelievesthatanotherpersonororganisationboundbythisBy-Lawis
actinginappropriatelytowardsachild,orisinbreachofthispolicy,heorshemaymakean
internalcomplaint.RefertotheattachmentsinPartDofthisBy-Law.
6.2
Takingimagesofchildren
Imagesofchildrenmustnotbeusedinappropriatelyorillegally.BasketballAustraliarequiresthat
individualsandassociations,whereverpossible,obtainpermissionfromachild’sparent/guardian
beforetakinganimageofachildthatisnottheirown.Theyshouldalsomakesurethe
parent/guardianunderstandshowtheimagewillbeused.
Torespectpeople’sprivacy,wedonotallowcameraphones,videosandcamerastobeusedinside
changingareas,showersandtoilets.
Whenusingaphotoofachild,BasketballAustraliawillnotnameoridentifythechildorpublish
personalinformation,suchasresidentialaddress,emailaddressortelephonenumber,without
theconsentoftheparent/guardian.Wewillnotprovideinformationaboutachild’shobbies,
interests,schoolorthelike,asthiscanbeusedbypaedophilesorotherpersonsto“groom”a
child.
Wewillonlyuseimagesofchildrenthatarerelevanttooursportandwewillensurethatthey
aresuitablyclothedinamannerthatpromotesparticipationinthesport.Wewillseek
permissionfromtheparents/guardiansofthechildrenbeforeusingtheimages.Werequireour
memberassociationsandclubstodolikewise.
6.3
Anti-discriminationandharassment
BasketballAustraliaiscommittedtoprovidinganenvironmentinwhichpeoplearetreatedfairly
andequitablyandthatis,asfaraspracticable,freefromallformsofdiscriminationand
harassment.Werecognisethatpeoplemaynotbeabletoparticipate,enjoythemselvesor
performattheirbestiftheyaretreatedunfairly,discriminatedagainstorharassed.
6.3.1 Discrimination
Unlawfuldiscriminationinvolvesthelessfavourabletreatmentofapersononthebasisofoneor
moreofthepersonalcharacteristicsprotectedbystateorfederalanti-discriminationlaws.
Thepersonalcharacteristicsprotectedbyanti-discriminationlawsincludeattributessuchasage,
disability,genderandrace.Thefulllistofprotectedpersonalcharacteristicsisinthe
“Definitions”setoutintheDictionaryofTerms.
Discriminationcanbeeitherdirectorindirect.
• Directdiscriminationoccursifapersontreats,orproposestotreat,apersonwithaprotected
personalcharacteristicunfavourablybecauseofthatpersonalcharacteristic.
• Indirectdiscriminationoccursifapersonimposes,orproposestoimpose,arequirement,
conditionorpracticethatwilldisadvantageapersonwithaprotectedpersonalcharacteristic
andthatrequirement,conditionorpracticeisnotreasonable.
Forthepurposesofdeterminingdiscrimination,theoffender’sawarenessandmotiveare
irrelevant.
6.3.2 Harassment
Harassmentisanyunwelcomeconduct,verbalorphysical,thatintimidates,offendsor
humiliatesanotherpersonandwhichhappensbecauseapersonhasacertainpersonal
characteristicprotectedbyStateorFederalanti-discriminationlegislation.Theoffensive

behaviourdoesnothavetotakeplaceanumberoftimes,asingleincidentcanconstitute
harassment.
Sexualharassmentisonetypeofharassment.Sexualharassmentisunwelcomeconduct,
remarksorinnuendoofasexualnature.Itcoversawiderangeofbehavioursandcanbeverbal,
written,visualorphysical.Sexualharassmentisnotlimitedtomembersoftheoppositesex.
6.3.3 Prohibitionagainstdiscriminationandharassment
BasketballAustraliaprohibitsallformsofharassmentanddiscriminationbasedonthepersonal
characteristicslistedinthe“Definitions”setoutintheDictionaryofTermsinclause10.
Anypersonwhobelievestheyarebeing,orhavebeen,harassedordiscriminatedagainstby
anotherpersonororganisationboundbythisBy-Lawisencouragedtoraisetheirconcernswith
us,orwiththemostrelevantorganisationasdefinedinsection7.1.Apersonmaymakean
internalcomplaint,andinsomecircumstances,theymayalsobeabletomakeacomplainttoan
externalorganisation.RefertotheattachmentsinPartDofthisBy-Law.
6.4 Intimaterelationships
BasketballAustraliaunderstandsthatconsensualintimaterelationships(including,butnot
limitedtosexualrelationships)betweencoachesorofficialsandadultathletesmaytakeplace
legally.However,thisBy-Lawwillhelpensurethattheexpectationsofcoachesorofficialsare
clearand,toensurethatifanintimaterelationshipdoesexistordevelopbetweenacoachor
officialandanadultathlete,thatrelationshipwillbemanagedinanappropriatemanner.
Coachesandofficialsarerequiredtoconductthemselvesinaprofessionalandappropriate
mannerinallinteractionswithathletes.Inparticular,theymustensurethattheytreatathletes
inarespectfulandfairmanner,andthattheydonotengageinsexualharassment,bullying,
favouritismorexploitation.
BasketballAustraliatakesthepositionthatconsensualintimaterelationshipsbetweencoaches
orofficialsandtheadultathletestheycoachshouldbeavoidedastheycanhaveharmfuleffects
ontheathleteinvolved,onotherathletesandcoachesandonthesport’spublicimage.These
relationshipscanalsobeperceivedtobeexploitativeduetothedifferencesinauthority,power,
maturity,status,influenceanddependencebetweenthecoachorofficialandtheathlete.
Werecommendthatifanathleteattemptstoinitiateanintimaterelationshipwithacoachor
official,thecoachorofficialshoulddiscouragetheathlete’sapproachandexplaintotheathlete
whysucharelationshipisnotappropriate.
Ifaconsensualintimaterelationshipdoesexistordevelopbetweenanadultathleteandacoach
orofficial,thecoachorofficialisexpectedtoensurethattherelationshipisappropriateandthat
itdoesnotcompromiseimpartiality,professionalstandardsortherelationshipoftrustthecoach
orofficialhaswiththeathleteand/orotherathletes.
Inassessingtheappropriatenessofanintimaterelationshipbetweenacoachorofficialandan
adultathlete,relevantfactorsinclude,butarenotlimitedto:
therelativeageandsocialmaturityoftheathlete;
anypotentialvulnerabilityoftheathlete;
anyfinancialand/oremotionaldependenceoftheathleteonthecoachorofficial;
theabilityofthecoachorofficialtoinfluencetheprogress,outcomesorprogressionofthe
athlete’sperformanceand/orcareer;
• theextentofpowerimbalancebetweentheathleteandcoachorofficial;andthelikelihood
oftherelationshiphavinganadverseimpactontheathleteand/orotherathletes.

Itwilloftenbedifficultforacoachorofficialinvolvedinanintimaterelationshipwithanadult
athletetomakeanobjectiveassessmentofitsappropriatenessandaccordinglytheyare
encouragedtoseekadvicefromBasketballAustralia(theMemberProtectionInformation
Officer)toensurethattheyhavenotinvolvedthemselvesininappropriateorunprofessional
conduct.
Ifitisdeterminedthatanintimaterelationshipbetweenacoachorofficialandanadultathlete
isinappropriateorunprofessionalBasketballAustraliamaytakedisciplinaryactionagainstthe
coachorofficialuptoandincludingdismissal.Actionmayalsobetakentostopthecoaching
relationshipwiththeathlete.Thiscouldincludeatransfer,arequestforresignationordismissal
fromcoachingduties.
Ifacoach,officialorathletebelievestheyarebeing,orhavebeen,harassedtheyare
encouragedtoseekinformationandsupportfromBasketballAustralia’sMemberProtection
InformationOfficerorotherofficial.OurcomplaintsprocedureisoutlinedinPartDofthisByLaw.
6.5
Pregnancy
Pregnantwomenshouldbetreatedwithrespectandanyunreasonablebarrierstotheirfull
participationinoursportshouldberemoved.BasketballAustraliawillnottolerateany
discriminationorharassmentagainstpregnantwomen.
BasketballAustraliawilltakereasonablecaretoensurethecontinuingsafety,healthandwellbeingofpregnantwomen.Wewilladvisepregnantwomenthattheremayberisksinvolvedwith
theircontinuingparticipationinsportandwillencouragethemtoobtainmedicaladviceabout
thoserisks.Pregnantwomenshouldbeawarethattheirownhealthandwell-being,andthatof
theirunbornchildren,isofutmostimportanceintheirdecision-makingabouttheextentthey
choosetoparticipateinoursport.
Weencourageallpregnantwomentotalkwiththeirmedicaladvisers,makethemselvesaware
ofthefactsaboutpregnancyinsportandensurethattheymakeinformeddecisionsabouttheir
participationinoursport.Wewillnotrequirewomentoundertakeapregnancytest.
Ifapregnantwomanfeelsshehasbeenharassedordiscriminatedagainstbyanotherpersonor
organisationboundbythisBy-Law,shemaymakeacomplaint.RefertotheattachmentsinPart
DofthisBy-Law.
6.6
Genderidentity
Genderidentitymeansthegender-relatedidentity,appearanceormannerismsorothergenderrelatedcharacteristicsofaperson.Thisincludesthewaypeopleexpressorpresenttheirgender

BasketballAustraliaiscommittedtoprovidingasafe,fairandinclusivesportingenvironment
whereallpeoplecancontributeandparticipate.

Allpersons,regardlessofgenderidentity,areentitledtobetreatedfairlyandwithdignityand
respectatalltimes.Wewillnottolerateanyunlawfuldiscriminationorharassmentofaperson
becauseoftheirgenderidentity.Thisincludesdiscriminationorharassmentofapersonwhois
transgenderortranssexual,whoisassumedtobetransgenderortranssexualorhasan
associationwithsomeonewhohasorisassumedtobetransgenderortranssexual.Weexpectall
peopleboundbythisBy-Lawtoactwithsensitivitywhenapersonisundergoinggender
transition/affirmation.
Ifanypersonbelievesthattheyarebeing,orhavebeen,harassedordiscriminatedagainstby
anotherpersonororganisationboundbythispolicybecauseoftheirgenderidentity,theymay
makeacomplaint.
6.6.2 Participationinsport
BasketballAustraliarecognisesthatexcludingpeoplefromparticipatinginsportingeventsand
activitiesbecauseoftheirgenderidentitymayhavesignificantimplicationsfortheirhealth,
wellbeingandinvolvementincommunitylife.Wearecommittedtosupportingparticipationin
oursportonthebasisofthegenderwithwhichapersonidentifies.
Ifissuesofperformanceadvantagearise,wewillconsiderwhethertheestablished
discriminationexceptionsforparticipationinsportarerelevantinthecircumstances.
Discriminationisunlawfulunlessanexceptionapplies.
BasketballAustraliaisawarethattheInternationalOlympicCommittee(IOC),Commonwealth
GamesFederation(CGF)andInternationalBasketballFederation(FIBA)haveestablishedcriteria
forselectionandparticipationintheOlympicGames,CommonwealthGamesandFIBAmajor
eventsrespectively.Whereatransgenderpersonintendstocompeteatanelitelevel,wewill
encouragethemtoobtainadviceabouttheIOC’s,GCF’sandFIBA’scriteriawhichmaydiffer
fromthepositionwehavetaken.
Drugtestingproceduresandprohibitionsalsoapplytopeoplewhoidentifyastransgender.A
personreceivingtreatmentinvolvingaProhibitedSubstanceorMethod,asdescribedonthe
WorldAnti-DopingAgency’sProhibitedList,shouldapplyforastandardTherapeuticUse
Exemption.
6.6.3. Intersexstatus
Federalanti-discriminationlaw,andsomestateandterritoryanti-discriminationlaws,provide
protectionfromdiscriminationagainstapersononthebasisoftheirintersexstatus.Refertothe
Dictionaryoftermsinclause10.BasketballAustraliaiscommittedtoprovidingasafe,fairand
inclusivesportingenvironmentwhereallpeoplecancontributeandparticipate.Wewillnot
tolerateanyunlawfuldiscriminationorharassmentofapersonbecauseoftheirintersexstatus.
6.7
Responsibleserviceandconsumptionofalcohol
BasketballAustraliaiscommittedtoconductingsportingandsocialeventsinamannerthat
promotestheresponsiblemanagement,serviceandconsumptionofalcohol.Wealso
recommendthatstateassociationsandmemberclubsfollowstrictguidelinesregardingthe
serviceandconsumptionofalcohol.
Ingeneral,ourBy-Lawisthat:
• alcoholshouldnotbeavailableorconsumedatsportingeventsinvolvingchildrenandyoung
peopleundertheageof18;
• alcohol-freesocialeventswillbeprovidedforyoungpeopleandfamilies;
• foodandlow-alcoholandnon-alcoholicdrinkswillbeavailableateventsweholdorendorse
wherealcoholisserved;
• acommitteememberorseniorexecutivememberofstaffwillbepresentateventswehold

Coaches,officials,trainers,volunteersandplayerswillrefrainfromsmokingandremain
smoke-freewhiletheyareinvolvedinanofficialcapacityinoursport,bothonandoffthe
court.
Bullying
BasketballAustraliaiscommittedtoprovidinganenvironmentthatisfreefrombullying.We
understandthatbullyinghasthepotentialtoresultinsignificantnegativeconsequencesforan
individual’shealthandwellbeing,andweregardbullyinginallformsasunacceptableinour
sport.
Bullyingischaracterisedbyrepeated,unreasonablebehaviourdirectedataperson,orgroupof
persons,thatcreatesarisktohealthandsafety.Bullyingbehaviouristhatwhichareasonable
personinthecircumstanceswouldexpecttovictimise,humiliate,undermine,threaten,degrade,
offendorintimidateaperson.Bullyingbehaviourcanincludeactionsofanindividualoragroup.
Whilstgenerallycharacterisedbyrepeatedbehaviours,one-offinstancescanamountto
bullying.
Thefollowingtypesofbehaviour,whererepeatedoroccurringaspartofapatternofbehaviour,
wouldbeconsideredbullying:

andcommunicationtools,suchassmartphonesandsocialnetworkingwebsites,havegreatly
increasedthepotentialforpeopletobebulliedthoughunwantedandinappropriatecomments.
BasketballAustraliawillnottolerateabusive,discriminatory,intimidatingoroffensive
statementsbeingmadeonline.Frustrationatareferee,teammate,coachorsportingbody
shouldneverbecommunicatedonsocialnetworkingwebsites.Theseissuesshouldinsteadbe
addressed–inawrittenorverbalstatementoracomplaint–totherelevantcontrollingclub,
leagueorpeaksportingbody.
Ifanypersonbelievestheyarebeing,orhavebeen,bulliedbyanotherpersonororganisation
boundbythisBy-Law,heorshemaymakeacomplaint.RefertoattachmentsD.
6.10 Socialnetworkingwebsites
BasketballAustraliaacknowledgestheenormousvalueofsocialnetworkingtopromoteour
sportandcelebratetheachievementsandsuccessofthepeopleinvolvedinoursport.Social
networkingreferstoanyinteractivewebsiteortechnologythatenablespeopletocommunicate

and/orsharecontentviatheinternet.ThisincludessocialnetworkingwebsitessuchasFacebook
andTwitter.
BasketballAustraliaexpectsallpeopleboundbythisBy-Lawtoconductthemselves
appropriatelywhenusingsocialnetworkingsitestoshareinformationrelatedtooursport.
Socialmediaactivityincludingpostings,blogs,statusupdatesandtweets:
• mustnotcontainmaterialwhichis,orhasthepotentialtobe,offensive,aggressive,
defamatory,threatening,discriminatory,obscene,profane,harassing,embarrassing,
intimidating,sexuallyexplicit,bullying,hateful,racist,sexistorotherwiseinappropriate;
• mustnotcontainmaterialwhichisinaccurate,misleadingorfraudulent;
• mustnotcontainmaterialwhichisinbreachoflaws,courtorders,undertakingsorcontracts;
• shouldrespectandmaintaintheprivacyofothers;and
• shouldpromotethesportinapositiveway.
7.
COMPLAINTSPROCEDURES
7.1
Handlingcomplaints
BasketballAustraliaaimstoprovideasimple,confidentialandtrustworthyprocedurefor
resolvingcomplaintsbasedontheprinciplesofnaturaljustice.
Anyperson(acomplainant)mayreportacomplaintaboutaperson,peopleororganisation
boundbythispolicy(respondent)iftheyfeeltheyhavebeenharassed,bulliedordiscriminated
againstortherehasbeenabreachofthisBy-Law.
Inthefirstinstance,complaintsshouldbereportedto:
• aMemberProtectionInformationOfficer;
• theCEOorPresident(ortheirnominee)ofBasketballAustralia,ConstituentAssociations,
LeagueAssociations,AffiliatedAssociationsandClubs;or
• anotherappropriatepersonwithintheorganisation(e.g.teammanager,coachetc.).
Ifacomplaintrelatestobehaviororanincidentthatoccurredatthe:
• statelevel,orinvolvespeopleoperatingatthestatelevel,thenthecomplaintshouldbe
reportedtoandhandledbytherelevantstateassociationinthefirstinstance;
• clublevel,orinvolvespeopleoperatingattheclublevel,thenthecomplaintshouldbe
reportedtoandhandledbytherelevantclubinthefirstinstance.
Onlymattersthatrelateto,orwhichoccurredat,thenationallevel,aswellasseriouscases
referredfromthestateandclublevel,shouldbedealtwithbythenationalbody.
Acomplaintmaybehandledinformallyorformally.Thecomplainantwillusuallyindicatehisor
herpreferredoptionunlesstheMPIO/ComplaintsManager/CEO/President(ortheirnominee)
considersthatthecomplaintfallsoutsidethispolicyandshouldbehandledanotherway.For
example,thelawmayrequirethatthecomplaint/allegationbereportedtoanappropriate
authority.
Allcomplaintswillbedealtwithpromptly,seriously,sensitivelyandconfidentially.Our
proceduresforhandlingandresolvingcomplaintsareoutlinedinAttachmentD1.
Individualsandorganisationsmayalsoseektohavetheircomplainthandledbyanexternal
agencyunderanti-discrimination,childprotection,criminalorotherrelevantlegislation.
7.2
Impropercomplaintsandvictimisation
BasketballAustraliaaimstoensurethatourcomplaintsprocedurehasintegrityandisfreeof
unfairrepercussionsorvictimisationagainstthepersonmakingthecomplaint.

BasketballAustraliawilltakeallnecessarystepstomakesurethatpeopleinvolvedina
complaintarenotvictimised.Disciplinarymeasurescanbeimposedonanyonewhoharassesor
victimisesanotherpersonformakingacomplaintorsupportinganotherperson’scomplaint.
IfatanypointinthecomplainthandlingprocesstheMPIO/ComplaintsManager/CEO/
President(ortheirnominee)considersthatacomplainanthasknowinglymadeanuntrue
complaint,orthecomplaintismaliciousorintendedtocausedistresstotherespondent,the
mattermaybereferredtotheTribunalforreviewandappropriateaction,includingpossible
disciplinaryactionagainstthecomplainant.
7.3 Mediation
BasketballAustraliaaimstoresolvecomplaintsquicklyandfairly.Complaintsmayberesolvedby
agreementbetweenthepeopleinvolvedwithnoneedfordisciplinaryaction.
Mediationisaconfidentialprocessthatallowsthoseinvolvedinacomplainttodiscussthe
issuesorincidentinquestionandcomeupwithmutuallyagreedsolutions.Itmayoccurbefore
oraftertheinvestigationofacomplaint.
Ifacomplainantwishestoresolvethecomplaintwiththehelpofamediator,theMPIOwill,in
consultationwiththecomplainant,arrangeforanindependentmediatorwherepossible.We
willallowlawyerstonegotiateonbehalfofthecomplainantand/ortherespondent.

Harassmentisanytypeofbehaviourthattheotherpersondoesnotwantandthatisoffensive,
abusive,belittlingorthreatening.Thebehaviourisunwelcomeandareasonablepersonwould
recogniseitasbeingunwelcomeandlikelytocausetherecipienttofeeloffended,humiliatedor
intimidated.

Asacoach,officialorsupportstaffmemberappointedbyBasketballAustralia(BA),orbyamember

meetthefollowingrequirementsinregardtoyourconductatalltimes.
1. ComplyandencouragecompliancewithBAstandards,Constitution,By-Laws(includingbutnot

b)Respectingthetalent,developmentalstageandgoalsofeachindividualplayer;and

5. DonotuseyourinvolvementwithBAtopromoteyourownbeliefs,behavioursorpracticeswhere

6. Refrainfromanyformofabuse,harassmentordiscrimination,oranyconductwhichmight
reasonablyberegardedasabuse,harassmentordiscriminationtowardsothers.Bealerttoany

Generally,coachingstaffandmanagementshouldonlyberequiredinchangingroomsforpregameorpost-gamemeetingsbetweencoachesandathletes,orifattendanceisotherwise
requiredbyanathlete.
12. Refrainfromanyconductwhichis;mightbereasonablyregardedas;orisbeinginvestigatedfor
potentiallybeingabreachofthecriminallawapplicabletothejurisdictioninwhichyouare
locatedatanytime.
13. Donotdenigrateand/orintimidateplayers,officials,spectatorsoreventorganisers.
14. Refrainfromunnecessaryorobviousdissension,displeasureordisapprovalwithofficials'
decisionsorspectatororplayerconduct.
15. Beresponsibleintheconsumptionofalcoholproducts.Youmustalsoberesponsibleforthe

Thecommissionmayinvestigateyourcomplaint.Thecommissionmayalsoattempttoconciliatethe

Ifyoudolodgeacomplaintwithacommission,anappropriatepersonfromourorganisation(e.g.an
MPIO)willbeavailabletosupportyouduringtheprocess.Youmayalsowishtohavealegal

AttachmentD2:MEDIATION
Mediationisaprocessthatseekstoresolvecomplaintswiththeassistanceofanimpartialperson–the
mediator.Themediatordoesnotdecidewhoisrightorwronganddoesnottelleithersidewhatthey
mustdo.Instead,heorshehelpsthoseinvolvedtodiscusstheissuesandseekstofacilitateamutually
agreeablesolution.
Ourapproachtomediationfollowsthestepssetoutbelow.
1.
TheMPIO/CEOwillappointanappropriatemediatortohelpresolvethecomplaint.Thiswillbe
doneunderthedirectionofBasketballAustraliaandinconsultationwiththecomplainantandthe
respondent(s).Themediatorwillbeanindependentpersoninthecontextofthecomplaint,
howeverthisdoesnotprecludeapersonwithanassociationwithBasketballAustraliaactingas
mediator.
2.
Themediatorwilltalkwiththecomplainantandrespondent(s)abouthowthemediationwilltake
