Tweed Shire Council hos engoged the services of Converge Heritoge +
Community in o project to develop o fweed Shire AboriginolCulturolHeritoge
Monogement PIon (The Project).
Tweed Shire Council (TSC) ond Converge Heritoge + Community (Converge)
recognises the Tweed Shire Council Aboriginol Advisory Committee (AAC) os
o key stokeholder in lhe Project ond will consult, engoge ond seek direction
from the Committee throughout the duroiion of lhe Project.
ond Converge recognise thot the AAC includes representotion from o
ronge of Aboriginol community groups including; the Tweed/Byron Locol
Aboriginol Lond Council; Tweed/Wollumbin Aboriginol Educotion Consultotive
Group; Minjungbol Museum ond Study Resource Centre;Tweed Cooperoiive
Society; Conowindro Aged Core Focility; Tweed Corporotion for Spori
(Stingroys) ond other community representoiives who moy provide odvice
ond input on on "os needed" bosis. The AAC wishes to work with TSC ond
Converge on lhe Project.

up the greoter portions of the Aboriginol community of the Tweed Locol

Memorondum of Understonding clorifies the roles ond responsibilities of
the Porticiponfs in lhe Project, ensuring o respectful, beneficiol, hormonious
ond effective working relotionship.

Memorondum of Understonding outlines the expected outcomes ond
deliverobles of the fweed Shrre Abonginol CulturolHeritoge Monogement
Pton (The Project). Further detoil is included in Appendix A'

Memorqndum of Understonding constitutes the entire Memorondum of
Understonding between both Porficiponts, ond moy be omended of ony time in
occordonce with clouse 14.

Any technicol resources ond equipment supplied by Converge for lhe
Project remoining the property of Converge.

Aboriginol Community Nominee
The TSC Aboriginol Advisory Commiitee ogrees to nominote o Troditionol
Owner or Custodiol representotive of the Tweed Shire district for the purpose
of ossisting with the Culturol Heritoge Study. ln consultotion with Converge
ond TSC, the TSC AAC will nominote oppropriole representotive/s bosed on
lhe ogreed work progrom os required from time to time (fhe nominee/s).
The nominee/s hos ogreed to ossist both Converge ond TSC stoff in lhe
collection ond interpretotion of culturol informolion os moy be considered
oppropriofe. The Aboriginol community Nominee/s moy be required to
occompony Converge stoff during field work to visit or identify unrecorded
Aboriginol sites ond ploces of signîficonce. Converge will lioise directly with
ihe oppointed Nominee/s prior lo such field work ond odvise both the TSC
AAC ond TBLALC of results.
Converge ond Tweed Shire Council ogrees to ensure thot ony Nominee is to
be foirly compensoted for time ond knowledge ond poid o negotioted hourly
roie for oll Prqect work undertoken. The rote of poyment is io be in
occordonce with o seporote ogreement between the TSC Aboriginol
Advisory Commiitee, Tweed Shire Council ond Converge'
Culturol proiocols moy require ihot different representotives ore required for
differeni oreos within the Tweed Shire district. lf ihis is necessory ihe qdvice of
ihe TSC Aboriginol Advisory Committee will be sought in identifying the mosi
oppropriote Troditionol Owner or Custodiol nominee for eoch oreo.

Troining
Converge undertokes to conduct ony siie visits ond investigotions in compony
with the Nominee of the TSC Aboriginol Advisory Committee. For the purpose
of the Prolecf oll site visits ond investigotions ore to be regorded os q mutuol
opportunity for troining ond informotion shoring between Aboriginol
poriiciponts, Tweed Shire Council ond Converge stoff. The Nominee will:

TSC Aboriginol Advisory Commitlee ond Tweed Shire Council lo

ln oddition, Converge will develop recording temploies for culturol heritoge
sites ond ploces, ond will irqin the Nominee in recording ond colloling dotq

9.
Reslriclions on knowledge of Aboriginol culturql siles ond ploces
Tweed Shire Council ond Converge ocknowledge the confidentiolity of
Aboriginol culturol sites ond ploces. Converge willseek ond respecl odvice
from the Nominee regording culturolly confidentiol knowledge. Such
knowledge will be identified os "Confidentiol", ond moy require restricted
occess, os determined by the Nomínee.
All Porticiponls will respect ihe confidentiolity of culturol informotion, ond will
observe protocols of ihe Aboriginol community os ideniified by fhe Nominee
ond the TSC Aboriginql Advisory Committee. No Porticipont will disclose or
distribute ony informotion thot is identified os "Confidentiol", except by
ogreement in writing by signotory Porticîponts to this Memorondum of
Understonding. This clouse opplies both throughout The life of lhe Prqecf, ond
forever thereofter.

TSC AAC qnd Nominee, will be followed by oll Project Porticiponts.

(b) The Porticipont will try to resolve the dispute by direct negotiotion of on

(c) lf the dispute is obout on Aboriginol culturol heritoge

motter, ond the Porticíponts ore unoble to resolve the dispuie by direct
negotiotion of o meeting of oll Porficiponfs, then the motier will be
resolved on the odvice of ihe TSC Aboriginol Advisory Committee. The
TSC Aboriginol Advisory Committee moy refer the motter to o person or
people, e.9., their nominoled Elders, who hove the obility ond/or
outhoriiy to intervene ond focilitofe some form of resoluiion, ln the event
thot they ore unoble to focilitote some form of resoluiion, the decision of
the person or people to whom the mofter is referred is finol.
