If you are reading this brochure, it is likely that you or a loved
one has been pulled over for Operating Under the Influence
(OUI). Getting an ignition interlock device installed in your
vehicle is an important step in regaining your license in Maine.
This brochure will take you through all the necessary steps
based on your offense and will assist you in getting back on
the road quickly and legally.*
Under Implied Consent, you automatically agree to a
chemical test (blood, breath, or urine) at any time authorities
have probable cause to administer it. If you refuse to
take such a test, your driver’s license will be immediately
suspended. The suspension could be for a period of up to six
years.

WHAT IS AN IGNITION INTERLOCK?
An ignition interlock device (IID) integrates breath alcohol
testing with your vehicle’s ignition system. Prior to starting
your vehicle, you will need to submit a breath sample into the
hand held portion of the device that tests for the presence
of alcohol. If your Breath Alcohol Concentration (BrAC) is
below Maine’s ignition interlock limit, your vehicle will start. If
alcohol is detected, your vehicle will not start until a passing
sample has been provided.

If you are found guilty of OUI based on the police officer’s
testimony, your refusal to take a test will be considered as
an aggravating factor by the judge and another suspension,
as well as mandatory jail time, will be included.
ZERO TOLERANCE LAW
The State of Maine has a special law if you are under 21
years of age. If you are found operating, or attempting to
operate, a motor vehicle with any measurable amount of
alcohol in your body, you will lose your license for one year.
If you refuse a test, you will lose your license for at least 18
months. If you have a passenger under 21 years of age, an
additional 180 day suspension will be imposed.
Drivers under 21 years of age with a BAC of 0.08 or more
can be prosecuted for the criminal offense of OUI, but the
license suspension must be for one year.

If your license is suspended for a first offense OUI, you may
regain your driving privileges with the installation of an
ignition interlock device.
In order to reinstate driving privileges you must:
• Serve 30 days of license suspension
• Serve jail time, if required
• Completion of alcohol/substance abuse assessment and education program
• Pay applicable reinstatement fees and fines
A person who qualifies for restoration of driving privileges
with an ignition interlock device must file an Ignition
Interlock Petition Form with the Secretary of State
and receive written approval prior to having the device
installed.
SECOND OFFENSE
If your license is suspended for a second offense OUI, you
may regain your driving privileges with the installation of an
ignition interlock device.
In order to reinstate driving privileges you must:
• Serve nine months of license suspension
• Serve jail time, if required
• Completion of alcohol/substance abuse assessment and education program
• Pay applicable reinstatement fees and fines
An ignition interlock device can be installed nine months
after the beginning of the suspension period. A person
who qualifies for restoration with an ignition interlock
device must file an Ignition Interlock Petition Form with
the Secretary of State and receive written approval prior to
having the device installed.
THIRD OFFENSE
If your license is suspended for a third offense OUI, you may
regain your driving privileges with the installation of an
ignition interlock device.
In order to reinstate driving privileges you must:
• Serve at least three years of a license suspension
• Serve jail time, if required
• Completion of alcohol/substance abuse assessment and education program
• Pay applicable reinstatement fees and fines
An ignition interlock device can be installed three years
after the beginning of the suspension period. A person who
qualifies for restoration of driving privileges with an ignition
interlock device must file an Ignition Interlock Petition Form
with the Secretary of State and receive written approval prior
to having the device installed.
CALIBRATIONS
The State of Maine requires that all ignition interlock devices
be calibrated 30 days after the initial installation and every
60 days thereafter. A calibration consists of exchanging your
current device for a newly calibrated one, ensuring accurate
and consistent testing.
