ORGANISATION TRANSAT NEW YORK – VENDEE is a sailing race organised by the Manhattan YC in conjunction with OSM Open Sports Management SA (hereafter “OSM”) The term Organising Authority designates MYC and OSM and/or every physical or moral person designated or assigned by MYC or OSM to intervene in the Race organisation. The Organising Authority works with the SPORTS NAUTIQUES SABLAIS, France, for the organisation of the finish, in close collaboration with the IMOCA class and the FFV. Before New York, in Newport RI, USA, boats will be hosted at Newport Shipyard. In les Sables d’Olonne, France, boats will be hosted in Port Olona. All Skippers competing in the Race are members of the IMOCA class, and IMOCA will make every effort to ensure that its members respect the Rules in their entirety, and will conduct all checks it considers necessary. 2. NAME The official name, at the publication date of this Notice of Race is TRANSAT NEW YORK – VENDEE. This name may be changed depending on the promotion and communication needs of the Race and on any partnerships entered into by the Organising Authority. 3. OBJECT TRANSAT NEW YORK – VENDEE is a solo non-stop sailing race, without assistance. Its aim is to promote the sport of sailing, to develop the IMOCA class and the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP. The Race provides Skippers with the opportunity to qualify for the “Vendée Globe 2016-2017” race, it is part of the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP, and it is open to IMOCA 60 monohulls in possession of a 2016 IMOCA certificate. Notwithstanding that the intention is that the TRANSAT NEW YORK – VENDEE shall be a solo non-stop sailing race, a media crewmember may be carried under terms set out in the rules of the Race. 4. DEFINITIONS Assem bly Area The area within the Port where the Boats are allocated berthing. Boat A 60’ monohull yacht holding a valid IMOCA certificate. Event The whole period from the start of the assembly period at the Start, to the end of all promotional events in the Finish Port Les Sables d’Olonne, including the Race itself. 3 IJ The International Jury as defined below. ISAF the International Sailing Federation its successors and assigns including “World Sailing”. M edia Crewmember (if Carried) A person, nominated by the Skipper, and approved by the Organising Authority when it is satisfied that the person’s skills and competence fit the intent of this rule. Approval or non-approval shall not be grounds for requesting redress. (This changes RRS 60.1(b) and 62.1(a).) The Media Crewmember is not permitted to participate in the sailing, or the performance, of the Boat in any way, further details and restrictions are laid out in Appendix 6. NOR The Notice of Race (including this Notice of Race, any appendices, amendments etc.) Noticeboard The official Race Noticeboard: www.ny-vendee.com OC The Organising Committee is appointed by the Organising Authority in accordance with RRS 89.2 (b) The Organising Committee will be made up of the following members: Jacques Caraes – Race Director , OSM Peter Bayer – Managing Director, OSM Marion Cardon – Communications Manager & Team Liaison, OSM Laurence Deguernel-Caraës, Coordination des opérations, OSM Gaetan Gouérou – General Manager, IMOCA Port A city which hosts a start (Start Port) or a finish (Finish Port) of the Race. Pro-am Race Any informal race(s) organised by the Organising Authority in the vicinity of a Port with VIPs, media or corporate guests sailing on a Boat. Race The TRANSAT NEW YORK - VENDEE RC Race Committee as appointed by the FFVoile RM RRS Race Management The Racing Rules of Sailing 2013 - 2016. Rules Any or all of the rules referred to in Clause 5 of the NOR. SI Sailing instructions (including any appendices, amendments etc.) Skipper The person in charge of the Boat at all times at sea and fitting the criteria described in Clause 6 below. Tim e Lim it The time by which all Skippers must have finished the Race, which will be by the start of the prize giving ceremony of the Race at the latest. 4 5. RULES Specific attention is drawn to RRS, Basic Principles: Sportsmanship And The Rules: “Competitors in the sport of sailing are governed by a body of rules that they are expected to follow and enforce. A fundamental principle of sportsmanship is that when competitors break a rule they will promptly take a penalty, which may be to retire.” Also Fundamental rule 1.1: “A boat or competitor shall give all possible help to any person or vessel in danger”. and Fundamental rule 4: “The responsibility for a boat’s decision to participate in a race or to continue racing is hers alone”. Attention is also drawn to the Offshore Special Regulations – 1.02: “The safety of a yacht and her crew is the sole and inescapable responsibility of the person in charge who must do his best to ensure that the yacht is fully found, thoroughly seaworthy and manned by an experienced crew who have undergone appropriate training and are physically fit to face bad weather. He must be satisfied as to the soundness of hull, spars, rigging, sails and all gear. He must ensure that all safety equipment is properly maintained and stowed and that the crew know where it is kept and how it is to be used. He shall also nominate a person to take over the responsibilities of the Person in Charge in the event of his incapacitation. Neither the establishment of these Special Regulations, their use by race Organisers, nor the inspection of a yacht under these Special Regulations in any way limits or reduces the complete and unlimited responsibility of the person in charge.” 5.1 Applicable docum ents: a) The NOR, including any appendices and amendments. b) The SI including any amendments for the various events held in the Ports and for the Race. c) The International Regulations for the Prevention of Collisions at Sea (IRPCAS) only where they are referenced from the RRS and for the avoidance of other vessels not racing. d) The IMOCA Class Rules (IMOCA Yearbook) in force at the time of the Race. e) The ISAF Offshore Special Regulations Category 1 (OSR) for Monohulls in force at the time of the Race. Where there is a conflict between these ISAF Offshore Special Regulations and the IMOCA Class Rules, the IMOCA Class Rules shall prevail in agreement with the FFVoile. The full checklist of safety equipment to be carried on-board is attached, as Appendix 4, and compliance with this checklist forms part of the Rules. f) The notices, regarding organisation, safety, boat inspection, attendance of the Skippers at the Race briefings and various events will be issued and signed by the RC and published on the Noticeboard. g) Deleted. h) The RRS 2013-2016 - Part 2 of the RRS (When boats meet): Part 2 of RRS applies from the start of the Race until 5 30 miles after the start line and 30 miles before the finishing line, for these parts of the course sailed during daylight. For the rest of the course, the rules are replaced with part B (Steering and sailing rules) of the IRPCAS. - RRS 26 is changed so that the warning signal shall be made 10 minutes before the starting signal of the Race and the preparatory signal shall be made 5 minutes before the start signal. The “Class Flag” used will be the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP flag. - RRS 41 Outside Help, Weather, Rule 45 Hauling Out; Making Fast; Anchoring o A weather forecast will be provided to each boat on a daily basis. o In the event of damage being sustained, Boats may request permission from the RC to contact shore support and if necessary receive external assistance from their shore support or third parties. Subject to the permission of the RC boats may thereafter complete repairs, hauling out, anchoring or making fast as necessary. The skipper shall inform the RC of the position and the time that repairs will commence. On completion of the repair work and not less than six hours after commencing repairs the Boat must return to the point at which it commenced repairs and inform the RC before continuing. In the event of inclement weather, the boat may request permission from the RC to continue from another point. In such a case the IJ shall consider whether any penalty should be applied. o There may be additional modifications to RRS 41 in the SIs. - RRS 42.2 (Prohibited action): add: f) keel motions and/or mast which are not necessary to the stability of the Boat. - RRS 44 (Penalties at the time of the incident) - Changed in NOR 10.1 and 10.3. There may be additional modifications to RRS 44 in the SIs. - RRS 50.2 (Spinnaker Poles; Whisker Poles): Does not apply. - RRS 50.3 As may be modified by the IMOCA Class Rules. - RRS 51 (Movable Ballast): as may be modified in the IMOCA Class Rules - RRS 52 (Manual power): Boats are authorised to use power other than power provided by the crew in order to use the automatic pilot. Such power may also be used to fill and/or empty the ballast and/or to position the keel. This changes RRS 52. - RRS 54 (Forestays and headsail tacks): Does not apply. - RRS 61 (Protest requirements): - Changed in NOR 8. There may be additional modifications to RRS 63 in the SIs. - RRS 62 (Redress): modified in the SI - RRS 63 (Hearings): RRS 63.7 is changed to read “ If there is a conflict between rules, uncertainty about which rule should prevail, or which rule should prevail, then the IJ shall resolve that conflict in the manner that it believes will provide the fairest result for all boats affected.” There may be additional modifications to RRS 63 in the SIs. 6 - RRS 64 (Decisions) : Modified in the SI The prescriptions of US Sailing and the FFVoile that apply are laid out in Appendix 5. 5.2 The two official languages of the Race will be English and French. The Organising Authority will provide an English and French version (or other languages as it may deem appropriate) of each document relating to the sporting and organisational elements of the Race but in the case of any discrepancy, or error in translation, the English version will prevail. For the Offshore Special Regulations (OSR) and the ISAF rules, the English version prevails. 5.3 Weather routing – Routing is not allowed for the races of the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP. Routing shall mean any specially prepared information and/or indication, whether personalised or for a group of Skippers, coming from the outside, with the exception of weather information sources authorized by the race regulations, and providing assistance in the understanding of the various weather situations and the choice of course(s) to be followed or not to be followed. 5.4 Boats must comply with MARPOL 73/78 Annex V which prohibits the dumping of plastic or synthetic materials at sea. Boats shall not dump fuel or oil overboard at any time. 5.5 Exceptional circumstances - In the case of exceptional circumstances, and in situations where the safety of the Skipper is at stake, the RC may need to formulate specific directives that the Skipper will have to follow. These new directives will be issued to meet the exceptional circumstances and will be dealt with in the most effective way. Such directives could amend one or more of the clauses included in the NOR or other applicable rules mentioned above. In that case, such directives will be submitted to the IJ in a detailed report. 5.6 International Jury (IJ) - An IJ for the Race will be appointed in accordance with RRS Appendix N. In accordance with RRS 70.5 there shall be no appeal from the decisions of the international jury 5.7 Declarations – The Skipper and team manager of the Boat will sign a declaration before the Race start confirming that the Skipper will start the Race and comply with the Rules. After the finish of the Race, the Skipper will sign a declaration stating that he/she has finished the Race and complied with the Rules. An additional declaration will be signed by the Media Crewmember (if carried) before and after the Race, detailing their intention to, and afterwards, their compliance with, the Rules. 6. THE SKIPPER, C REWMEMBER AND M EDIA C REWMEMBER : 6.1 The Race is single-handed. Guests on board may be permitted during specific events and promotional activity prior to the Race at the discretion of the Organising Authority. A Media Crewmember is permitted on board throughout the Race. Further details relating to the Media Crewmember will be set out in the SI’s and Appendix 6 of this NOR. 6.2 Any Skipper who has embarked one or any assisting person as outlined in RRS 41, must make every effort to disembark such person as quickly as possible, in compliance with the SI. 6.3 The Skipper must be in possession of all official documents necessary in order to enter Newport, RI, USA, to leave New York, NY, USA and to enter malnland in les Sables d’Olonne, France. 7 6.4 The Skipper must comply with the laws of his/her national authority or country of residence. The Skipper must be in possession of a valid sailing license for the Race, with a medical visa, in compliance with the laws and regulations of his/her country. 6.5 Minimum age: 18 years old on 1st May 2016. 6.6 ISAF-approved safety and survival training According to the ISAF Special Offshore Regulation, the Skipper must have taken part in a course for survival at sea at a centre certified by ISAF or FFVoile, or one of the ISAF national authority members. On completion of such course, before 1st May 2016. the Skipper must send to RM the certificate of completion of such course during the last 5 years, i.e. after 1 January 2011. 6.7 The Skipper must justify his ability to take part in the Race on board the Boat by: 1. Being an active member of the IMOCA Class 2. Providing a nautical CV to his registration 3. Having taken part and been ranked in a single-handed ocean race of at least 2700 nautical miles since 1 January 2011 4. and/or having taken part and been ranked in a doubled-handed race of at least 4000 nautical miles onboard a boat of at least 40' since 1 January 2011 5. and/or being able to justify his/her sailing skills to RM 6. and/or having raced aboard the Boat which has sailed at least 1500 nautical miles in the same configuration as at the start of the Race and in conditions similar to those likely to be met during the Race. 6.8 In accordance with Clause 5.7 of the NOR, the Skipper will submit to RM by the start briefing at the latest, his/her completed and signed start declaration, which is an appendix of the SI. 6.9 Safety Provisions, Media Crewmember The Media Crewmember shall: 1) Complete a course for survival at sea at a centre certified by ISAF, FFVoile or a member national authority of ISAF 2) Undertake a medical assessment satisfactory to the OA confirming his or her fitness to undertake the Race 7. SKIPPER AND BOAT ATTENDANCE The Skipper, and where applicable the Boat, will take part in any Pro-Am Race and any event detailed in the official program (appendix 3 of the NOR) and any update published on the Noticeboard and in the official presentation given by the Organising Authority, unless given specific written permission not to by the Organising Authority. 8. PROTESTS Boats not carrying Media Crewmembers are prohibited from protesting boats carrying Media Crewmembers purely on the basis of them carrying Media Crewmembers, which is permitted under these Rules. For further details on Protests, please see Sailing Instructions. 8 9. HEARINGS See Sailing Instructions 10. PENALTIES See Sailing Instructions 11. ELIGIBILITY AND QUALIFICATION CRITERIA 11.1 Boat: the Boat must hold a valid IMOCA certificate 2016 at the date of the start of the Race. 11.2 Skipper: The Skipper must be an active member of the IMOCA class, and must be able to demonstrate to the RM a suitable level of experience as described in 6.7 above. 11.3 Qualification: The OC reserves the right to request a Skipper with his/her registered Boat to undertake a qualifying passage, the details of which must be decided in advance with the RC. The course, distance, date and start time of such qualifying passage must be agreed with RC at least one week before the anticipated date of departure. Such qualifying passage must be carried out on board the Boat entered for the Race, with the same boat configuration as that planned for the Race, including tracking. The Skipper shall use his/her best endeavours to have the Race logos provided by the Organising Authority in place (logos on the mainsail and Race flags) during such qualifying passage. 11.4 Reserve Skipper: A person who may replace the Skipper prior to the start of the Race. Such Reserve Skipper must have the same level of qualification as the Skipper he/she will replace. 11.5 Medical: The Skipper must be declared fit to compete by a qualified doctor, who will provide a letter to this effect to the RM. 12. RESTRICTIONS ON ENTRY 12.1 The Organising Authority may choose to limit the total number of entries to the Race based on availability of space in the host Ports or for any other reason. Such decision will be at its sole discretion. 12.2 In accordance with RRS 76.1, the Organising Authority or RM reserves the right to refuse participation in the Race of any Boat that does not appear to be in good condition, insufficiently equipped, dangerous or does not comply with the obligations of the NOR and safety rules. 12.3 The Organising Authority or RC’s decisions will be final and indisputable (this changes RRS 76.1). 9 13. REGISTRATION PROCEDURE 13.1 For a registration to be accepted, a completed registration form attached as Appendix 1, together with an entry deposit of €5,000 must be sent to the Organising Authority. 13.2 The registration of a Boat will be recorded after the date of receiving a correctly-completed registration file including a bank operation confirmation of an entry deposit of €5,000. The registration file will be sent to OSM (by land post or by mail: [email protected]) on 15 February 2016 at the latest (date of postal stamp or of email dispatch). OSM will acknowledge receipt and attribute a position of registration number. Bank operations are to be paid to OSM’s bank account: Credit Suisse, CH-6301 Zug IBAN CH61 0483 5148 8885 1100 0 Clearing No. 4835 BIC CRESCHZZ63A Account holder: OSM Open Sports Management SA, EPFL Innovation Park, Building I, CH-1015 Lausanne 13.3 If a Boat complies with all the requirements of the Organising Authority, including attendance at all Events (such as the Pro-Am Race), and makes all reasonable endeavours to finish the Race, the deposit amounts will be returned, plus interest calculated using the average Swiss Franc LIBOR rate during the period the deposit has been held, within one calendar month of the end of the Event. 13.4 The deadline for entries will be 15 February 2016. Late entries may be considered by the Organising Authority up to the 1st May, but in which case an entry fee (non-returnable) of €5,000 will apply. 13.5 Registration to the Race implies total acceptation of the NOR, without reserve. 14. MEASUREMENT AND INSPECTION Boats shall be in the Assembly Area within Newport, RI, USA by 09h00 (local time) on 17 May 2016 in race condition. Measurement and inspection will take place during the period from 17-21 May 2016, with the Checklist (Appendix 4) as a guide. 15. BRANDING AND IDENTIFICATION At all times (unless specified below) in relation to the Race and the Event, Boats shall display the following branding and identification (all to be provided to each Boat by the Organising Authority): • Dodgers (of approximate size 2.1m x 0.6m), to be displayed in the position highlighted in the IMOCA Class Rules at all times whilst ashore and whilst afloat, except they may be removed from a position 30 nautical miles following the start of the Race, until 30 miles before the finish line. • 2 flags (of approximate size 2m x 1.5m), representing the Race or the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP), one to be displayed on each shroud at all times whilst ashore and whilst afloat, 10 except they may be removed from a position 30 nautical miles following the start of the Race, until 30 miles before the finish line. • Forestay banner flags to be flown at all times when in Port. • Flags and Pennants. While ashore, pennants and flags featuring the name of the Boat, its logo or trademark, to the exclusion of any slogan, may be hoisted on the shrouds of the Boat. Furthermore, Skippers agree to hoist in the rigging of their Boat flags to be supplied by the Organising Authority as defined in due course in the SI. Such flags will be hoisted in Newport, RI, from the time of the welcome briefing, in New York, NY, until the start of the Race, then after the finish in Les Sables d’Olonne until the end of the Race. • Name of the Race: any Boat entered in the Race must, on request by the Organisation Authority in accordance with 13.4 in the NOR, show on her mainsail the logo of the Race and/or the Race partner in accordance with IMOCA rules. Stickers will be supplied by the Organising Authority, and their application and appearance until the end of the Race will be the Skipper’s responsibility. 16. POSITION REPORTING 16.1 Tracking beacons capable of transmitting signals to the Organising Authority will be provided to each Boat and these must be switched on from 2 days before the start of the Race until the Boat reaches the dock in the arrival Port. The Boat’s Sat C must remain switched on for the same period. Tracking beacons must be returned within 24 hours of finishing in the arrival Port to a member of the RM. If a Boat does not finish the Race, the tracking beacons must be returned by courier to an address designated by the RM. If not returned, or if returned late, a financial penalty may apply. 16.2 The Boat must carry active AIS, which will be fully activated for the duration of the Race. 17. MEDICAL 17.1 The list of the products included in the medical kit will be in accordance with appendix 6 of the medical rules of the FFVoile. If supplementary medicine is to be taken on-board, it is the Skipper’s obligation to communicate such list of medicine to the Race Management team before 28th May 2016. 17.2 In accordance with ISAF regulations 19.6.2 (Appendix 2 – Section II, anti-doping), some (sedative) products may be taken to treat an emergency. In the event of one or more of these products being used, the Skipper will inform as soon as possible the RM of the reasons and methods for using these products. Moreover, the Skipper will note in the Boat’s log the circumstances that led him/her to use them. It is also the responsibility of the Skipper to ensure that his/her own national authority is informed with respect to antidoping regulations. 17.3 Authorised medical advice means any remote intervention by a doctor enabling a Skipper to administer the necessary treatment following an accident on-board or the aggravation of an existing condition. Any intervention for any other reason may be considered as trying to improve the physical performance and may result in the case being passed to the IJ. 11 17.4 The Skipper will inform the RM every time he/she requires medical advice other than medical assistance provided by a nominated Race doctor. In such case, the approached doctor will fully inform the Race doctor as quickly as possible of his/her diagnosis, prescriptions and advice given to the Skipper. 17.5 In extreme cases, additional medicine may be given to the Boat by another Skipper, or any other third party, with the approval of the RM. However, the list of such medicine will be communicated to the Race doctor in advance for his approval. In this event a detailed report will be submitted to the IJ who will decide if any action is to be taken. 18. INSURANCE 18.1 Public liability insurance: The Skipper must have obtained public liability insurance to cover his/her participation in the Event for a minimum insurance value of €3 million per claim. The Skipper will provide the OC with an insurance certificate by 1 April 2016.at the latest. 18.2 Skipper’s insurance: The Skipper must ensure that all persons on board the Boat are covered with a suitable personal accident insurance policy to cover their participation in the Race. Such insurance policy must cover, at a minimum, death, permanent total disability, medical cover and rescue at sea. 19. RACES 19.1 Skippers will take part in all Pro-Am Races, prologue events, promotional events detailed in the Official Programme (see Appendix 3, and any updates to this which will be posted on the Noticeboard) and requested appearances as reasonably communicated by the Organising Authority, unless their absence is specifically authorised by the Organising Authority in advance. 19.2 There will be a non-points-scoring Pro-Am Race, which will start on 21 May 2016 from Newport, RI, to New York, NY. 19.3 There will be another non-points-scoring Pro-Am Race, on Friday 27 May 2016 in New York, NY. 19.4 A last non-points-scoring Pro-Am Race will be organised the 11 June 2016 in Les Sables d’Olonne. The Race will start from New York, NY, on 29 May 2016 across the Atlantic from West to East. Start line: in front of the North Cove Marina, on the Hudson River. Further details are outlined in the SI. Full details of courses and any exclusion zones will be published in the SI. 20. SCORING SYSTEM 20.1 Boats will be ranked based on their elapsed finishing time, as amended by any penalties (or redress) being awarded by the IJ. The Boat with the lowest elapsed time for the Race will be ranked first, and so on. 20.2 Points towards the IMOCA OCEAN MASTERS WORLD CHAMPIONSHIP will be awarded as defined in the IMOCA Class Rules. 12 20.3 The Race has a coefficient of 4 20.4 A real-time ranking will be established according to time of arrival, within the Time Limit. 21. POSITION UPDATES DURING THE RACE 21.1 Number of position updates The number and times of position updates will be published in the SI. The position updates will be sent to the press and to the Email addresses of Boats who so wish, either by Inmarsat C Email or to the Boat’s Email. For purposes of communication and promotion of the Event, the Organising Authority may, on its own initiative, reduce or increase the frequency of published rankings on the Internet or to the press. 21.2 Communication of position updates The Skipper shall communicate by the latest at the welcome briefing by which means he/she wishes to receive the position updates. The position updates will be sent to the Boat by Inmarsat C Email in the format of a “Pos report” at the Organising Authority’s cost. Moreover, the position updates will be available on the Race FTP in different formats (XLS, Pos report, XML, CSV). 22. MEDIA REQUIREMENTS The Organising Authority will deliver media requirements in the SI. 23. LIABILITY 24.1 The Organising Authority’s responsibilities in relation to Skippers are set out in the Rules as may be amended from time to time. Except within the Assembly Area should evidence of a fault or negligence of the Organising Authority be presented, the Organising Authority shall have no liability to any other individual involved in the Event or to any other individual involved in any manner in the Event for negligence and shall not be responsible for any loss, damage, or injury of whatsoever kind, howsoever arising (including force majeure), misrepresentation, breach of duty or otherwise to the maximum extent permitted by Law. 24.2 Skippers and any others involved with the Event shall be deemed to be aware of the NOR, and shall not make any claims or bring any proceedings of any nature in relation to or arising out of the Event against anyone 13 involved in the organisation or management of the Event other than the Organising Authority and against the Organising Authority only in accordance with the Rules and/or as permitted in 24.1 herein above. Without prejudice to the generality of the foregoing, the benefit of all exclusions and indemnities in the Rules shall apply not only to the Organising Authority but also to the individual members of the Organising Authority and RC and anyone else involved in the organisation or management of the Event from time to time. 24.3 Insofar as any of the other exclusions of liability set out in the NOR fail to exclude any liability the Organising Authority may have for injury, loss or damage suffered by any third party in respect of any activities undertaken by, or for the benefit of, any one Skipper, such Skipper shall indemnify the Organising Authority in respect of such liability and all costs and expenses attributable to such claim. Skippers shall generally indemnify the Organising Authority for any loss or damage sustained by the Organising Authority as a result of the Skipper’s breach of the Rules including, without limitation, those required by the NOR. 24.4 Acceptance of these exclusions of liability and provision of these indemnities shall be a condition of entering or participating in the Race and shall be effective as against Skippers and any others involved with the Event. It is the responsibility of Skippers entering the Race to ensure that the above provisions are brought to the attention of all persons associated with their participation in the Event. 25. Rule 67: After rule 67 add US Sailing prescribes that: (a) A boat that retires from a race or accepts a penalty does not, by that action alone, admit liability for damages. (b) A protest committee shall find facts and make decisions only in compliance with the rules. No protest committee or US Sailing appeal authority shall adjudicate any claim for damages. Such a claim is subject to the jurisdiction of the courts. (c) A basic purpose of the rules is to prevent contact between boats. By participating in an event governed by the rules, a boat agrees that responsibility for damages arising from any breach of the rules shall be based on fault as determined by application of the rules, and that she shall not be governed by the legal doctrine of ‘assumption of risk’ for monetary damages resulting from contact with other boats. Rule 76.1: After rule 76.1 add US Sailing prescribes that an organizing authority or race committee shall not reject or cancel the entry of a boat or exclude a competitor eligible under the notice of race and sailing instructions for an arbitrary or capricious reason or for reason of race, color, religion, national origin, gender, sexual orientation, or age. 27 APPENDIX 6 (MEDIA CREWMEMBER) Further to the definition in Clause 4 above, it is further clarified: The Media Crewmember shall not give assistance to, advise, help, warn the skipper nor participate in the sailing or the performance of the boat nor in any way and manner whatsoever, such as but is not limited. The use of and/or the settings of any equipment of the boat (with the exception of media equipment), including: sails, rig, any rope, the hardware and all operating systems (keel, mast and rudder), whether mechanical, hydraulic, or electrical, any and all systems related to energy production, and any systems related to navigation and the operation of the boat. The Media Crewmember shall not collect nor transmit any information regarding the Race, the performance of the boat, the weather or the positioning of competitors. Furthermore, the Media Crewmember is prohibited from standing a watch for the skipper, or alerting the Skipper in any way with respect to the Boat’s behavior and performance. Only equipment related to audiovisual production, its registration, its editing and sending files relating to it is permitted to be operated by the Media Crewmember. The Media Crewmember is also permitted to write for the purposes of generating media interest around the explanation of life on board for the singlehanded sailor. Anything not expressly permitted to the Media Crewmember is deemed to be prohibited. At the request of anyone from the OA (or any of their representatives), prior to the Start of the Race, the Media Crewmember shall demonstrate the proper detailed functioning of all media equipment (including, but not limited to taking images and sounds, saving files, editing, compression and transmission), and attend any training courses with members of the OA (or their representative) so stipulated by the OA. The OA may refuse the entry of a Skipper or Boat whose Media Crewmember does not meet the criteria set out above in accordance with NOR 12.2 28
