Overview of Topics
□ Topic 1 - Latest Information on IP System in Each Country
This session will provide latest updates on IP-related laws, practices, court
rulings, and/or national policies in Korea, Japan and China. The present and
future of dispute resolution systems in IP in these countries will also be covered.
□ Topic 2 - Patentability of Computer Implemented Inventions
(2017 AIPPI Study Question Topic)
The term patentability here refers to the question of whether an invention may
be the patentable subject matter.
Patentability of computer implemented inventions (CII) has been a hot issue in
the patent field for many years. While national/regional laws and practices have
significantly evolved over time, the development of the various practices has
not been linear at all, creating a dynamically changing and scattered landscape
concerning patentability of CII.
The speakers from the three different jurisdictions will speak about the
situations surrounding this issue in their own jurisdictions. The issues related to
“IP protection of AI (Artificial Intelligence) and IoT (Internet of Things) related
idea” will also be covered.
□ Topic 3 - Bad Faith Trademarks
(2017 AIPPI Study Question Topic)
Bad faith involves some kind of dishonest, abusive or unseemly behavior by a
trademark applicant. Because of the differences in finding and handling bad faith
between jurisdictions and the variability of the criteria for a finding of bad faith,
there is a lack of predictability regarding what constitutes bad faith. This means
both trademark owners and applicants for registration may need to take different
approaches in different jurisdictions.
This session will provide an opportunity to learn about the similarities and
differences in this topic among three countries.
