Be it enacted, etc., as follows:
SECTION 1. The tenure of office of William FitzMaurice, incumbent
of the office of legal investigator and legal assistant in the office of the
city solicitor of the city of Cambridge, shall, upon the effective date of
this act, be unlimited, but he may be removed therefrom for cause after
hearing in the manner provided by section forty-three of chapter
thirty-one of the General Laws.
SECTION 2. This act shall take effect upon its acceptance by the
city of Cambridge.

the branch in which it originated, with his objections thereto, was passed,
by the House of Representatives, September 18, 1967, and, in concurrence,
by the Senate, September 18, 1967, the objections of the governor, notwithstanding, in the manner prescribed by the constitution; and thereby has

Chap. G18. A N ACT RELATIVE TO THE TRANSFER OF PATIENTS TO AND
FROM T H E B R I D G E W A T E R STATE HOSPITAL.
Whereas, The deferred operation of this act would tend to defeat its
purpose, which is, in part, to make its provisions for the transfer of
patients to and from the Bridgewater state hospital effective forthwith,
therefore it is hereby declared to be an emergency law, necessary for the
immediate preservation of the public convenience.
Be it enacted, etc., as follows:
SECTION 1. Section 20 of chapter 123 of the General Laws is hereby
amended by striking out the first paragraph, as appearing in section 5
of chapter 637 of the acts of 1955, and inserting in place thereof the following paragraph: —
The department, subject to section twenty A, may transfer to and
from any hospital or school except the state hospital division at Bridgewater any patient who in its opinion is a proper subject for care and
treatment in the institution to which he is to be transferred, except that
no patient shall be transferred between institutions while he is present
as a voluntary patient or while committed for observation under section seventy-seven.
SECTION 2. The seventh paragraph of said section 20 of said chapter 123 is hereby amended by striking out the first sentence, as appearing in section 5 of chapter 637 of the acts of 1955, and inserting in place
thereof the following sentence: — On the request of a superintendent
of any state hospital the commissioner may transfer to the state hospital
division at Bridgewater for a period not to exceed sixty days any male'
patient who has made two or more attempts to escape or whose conduct has been such as to render him dangerous to other patients or to
the personnel of the hospital or school.
SECTION 2A. Said seventh paragraph of said section 20 of said chapter 123 is hereby amended by inserting after the second sentence, as

amended by chapter 146 of the acts of 1965, the following two sentences:— Any patient so transferred shall be returned to the institution from which he was transferred by the end of the sixty-day period.
The commissioner shall, at the time of the transfer, transmit a written
statement setting forth the reasons for the transfer to the commissioner
of correction.
SECTION 3. Said section 20 of said chapter 123 is hereby amended
by striking out the eighth paragraph, added by chapter 593 of the
acts of 1963.
SECTION 4.
Section 22A of said chapter 123, as most recently
amended by chapter 596 of the acts of 1963, is hereby further amended
by striking out the third paragraph and inserting in place thereof the
following paragraph: —
Upon the certification of the medical director of the Bridgewater
state hospital that any patient who has been transferred from another
state hospital or who has been otherwise committed to the Bridgewater
state hospital and is no longer under sentence, is not an escape risk or
dangerous to other patients or personnel and is thereby a fit subject for
transfer to a state hospital, the commissioner of correction shall request
the commissioner of mental health to execute such a transfer and shall
transmit a copy of such certification with such request. Within thirty
days the commissioner of mental health shall communicate his approval of such transfer request to the commissioner of correction and
execute the transfer or shall request a hearing before any court having
jurisdiction over original commitments under sections fifty and fiftyone. The court shall hear and determine whether or not the patient is
a fit subject for transfer. If the court determines that the patient is a
fit subject for transfer, it shall order the patient transferred. If the
commissioner of mental health fails to approve such request or to request such hearing within said thirty-day period, he shall be deemed
to have approved such transfer. All transfers which have been approved or ordered by any of the aforesaid procedures shall be made
forthwith and to a state hospital designated by the commissioner of
mental health.

A N A C T AUTHORIZING T H E CIVIL COMMITMENT O F C E R -
TAIN MENTALLY ILL PERSONS TO BRIDGEWATER STATE
HOSPITAL.
Whereas, The deferred operation of this act would tend to defeat its
purpose, which is to provide forthwith for the civil commitment to
Bridgewater state hospital of certain mentally ill persons who are so
dangerous to themselves and others that strict security is required and
who are not proper subjects for confinement at another mental hospital,
therefore it is hereby declared to be an emergency law, necessary for the
immediate preservation of the public safety and convenience.

SECTION 1. Chapter 123 of the General Laws is hereby amended by
inserting after section 51 the following section: —•
Section 51 A. If a court, acting in compliance with the provisions of
this chapter, determines that a male person is a proper subject for
commitment to any institution for the mentally ill under the jurisdic-
