I want to thank all of you for your hard work and dedication to our union and for being so welcoming to all the travel card members who have visited our local the past few years. It is an honour serving as your business manager. I wish you and your family a safe and memorable holiday season and best wishes for 2013. UA Local 179 Event Participation: In 2012 the Local held various member and family events throughout the year with great member participation. It was fun and encouraging to have many attend our general meetings and UA special events such as: the Reid Lichtenwald memorial sled derby, UA Slo-pitch team, paintball tourney, Labour Day family picnic, pin awards and children’s Christmas parties which have all been a great success. Please plan to attend a few events in 2013 as they really are a great time. New Regina Union Hall/Training Facility Update: This is a giant leap forward for our organization and it is a privilege to be involved during these very exciting times. The new UA Local 179 Regina union hall and SPI JTAC training facility located at 402 Solomon Drive is near completion with construction at ninety percent. We are now down to the details of phone systems, networking, security system and of course to plan and co-ordinate the actual move. The tentative possession date is mid-January 2013. The move will take place over an extended weekend with the office being closed the Friday and Monday then opening for normal business the Tuesday in our new facility. UA Local 179 News – Winter 2012/2013 4|Page Training -There is no finish line: I commend our member’s foresight and commitment to invest in its new facilities and the local’s future in training. On the job hands on experience and mentorship without question is a great teacher. We are very fortunate as UA members to have the opportunity to learn and grow through the UA / Sask Piping Industry Joint Training Committee added courses and Saskatchewan Apprenticeship programs. I believe continuous training is needed to enhance and improve skills throughout our careers. Enhanced training will ensure that UA remains the labour option of choice, and greatly improves our ability to negotiate fair wages and good working conditions in a political climate where big business is king. Within this newsletter Director of Training Ken Busch has included a list of upcoming courses made available by the SPI JTC. I would ask that members of all ages and stages of their career commit to take a course in 2013. Whether it is a UA Foreman course, UA Steward, UA Rigging, IP Prep, Green Thread, HDP, Tig & Specialty Welding all these skills are in high demand. Extra efforts made by individuals do make a difference and impact the success of UA Local 179. Legal Update: PCL Monad preliminary LRB hearing – you may recall in Bill Steeves’ previous report he mentioned efforts to organize at Agrium PCL Monad. We currently have a case in front of the Labour Relations Board that if successful will allow us to pursue certification of the job site. The preliminary hearing was held at the Regina LRB Nov 9, 2012 with the case being heard and the UA arguing that CLAC does not hold legal certification. PCL and CLAC’s legal counsel claimed contrary. We expect to receive a decision in a few weeks time. BFI Fit for Work Arbitration hearing has been set for November 28, 29, 30 & December 3, 4 and 5, 2012 in Regina. Saskatchewan Building Trades Legal counsel and we have been working to prepare. Final Word – Sitting on a pail texting? Recently on one of our projects a contractor and owner rep are walking the jobsite and come across two individuals standing and talking at a fab table with a third sitting down on a job box. When approached and asked what they are doing, one replied waiting for direction from our foreman. The member sitting down didn’t acknowledge the supervision or even stand up. This event combined with a member caught and reprimanded for sitting on a five gallon pale while texting on the job a week earlier set off a very unfavourable chain of events. The contractor and owner rep were furious and what ensued was first an attack on the Steward Foreman and General Forman with claims casting doubt on their ability to manage the members and crews. This is a huge deal in the eyes of the owner which unfortunately overshadows everything positive happening on the job at that time. cont’d… UA Local 179 News – Winter 2012/2013 5|Page Numerous Calls and conversations with the local continued during the next week including a contractorowner conference call with the UA Western Rep. As well as the Client Rep contacting the UA Canadian head office. Much of the conversations revolved around the UA Standard for Excellence and what the UA is “really doing” to ensure owners realize value and productivity. The part that got me was all that time and energy spent on a few individuals who are not representing themselves or the organization to standards. The spotlight and positive recognition for UA member quality work is overlooked due to poor choices of a few individuals. In the hall or on the job we must hold each other accountable to the highest standards. Local 179 members know anything less is not acceptable. Bill Peters UA Local 179 News – Winter 2012/2013 7|Page Organizing Matters Bill Steeves, Business Agent/Organizer I hope everyone had a good summer and got out and about to enjoy some of it. Work in the Saskatoon area has slowed right down and probably won’t pick up much until spring. Several of our members have been laid off due to lack of work and have hopefully found other employment to keep the bills paid. If you have been laid off and are working for a non-signatory contractor, please keep in touch with us and let us know where you are working. You could also try “testing the waters” as to whether or not the other employees might want to become UA members. The more contractors we have, the more employment opportunities there are for our members. Some of the projects coming out soon should be the new 70+ million dollar Art Gallery in Saskatoon, the 175+ million dollar Children’s Hospital as well as new commercial developments at the U of S and numerous schools and other buildings in and around Saskatoon. Hopefully our contractors will pick up a good majority of the work and keep our commercial sector going strong. I have had some talks with Modern Niagara, the mechanical contractor doing the new Saskatoon Police Station. Things have not progressed as quickly as I had hoped but I am still hopeful that we can come to some kind of arrangement. This would be a great new contractor if I can get things worked out. As for the issues with PCL Monad, we are just starting to get into the LRB hearings and are a ways off before we will know much more about this issue. Fraternally Bill Steeves UA Local 179 News – Winter 2012/2013 8|Page Commercial Sector Work Landon Mohl, Business Agent/Organizer Hello Brothers and Sisters, I have been busy working on attempting to certify a few nonunion contractors within Saskatchewan. This work is very difficult and time consuming. At one of the contractors I am working on certifying when it came down to the signing of union support cards the workers got scared because they were afraid of being fired. I am still trying to meet with the tradesman to take care of their concerns but this is difficult to do when you can’t talk to these guys during work hours. I can talk to them at lunch or coffee breaks but if I go one minute outside of their break time I am considered to be disrupting their paid working time so the potential certification may be jeopardized. This can affect whether the Labour Relations Board approves the certifications. The provincial government has the cards stacked heavily against us and is trying to make it harder with the upcoming new legislation they plan to pass in the legislature. I’m telling you this story because I think it is imperative that you brothers and sisters be involved with helping strengthen Local 179 in our attempts to certify all non-union plumbing, refrigeration, fire sprinkler, steam fitting/pipefitting and welding companies. You can play your part by talking to your non-union friends/tradesman about the benefits of being a union member and the benefits of working for a unionized company such as our pension, training and health and welfare benefits. I have been having conversations with 2 of my conservative right wing friends and I have convinced them that the United Association is a good union and is doing positive things for Saskatchewan. One of these right wing friends is even sold on starting a UA mechanical company in the future. I personally will continue to do what I can in this province to promote the UA and unions in general to the public and I hope you will do the same. Commercial Sector Work in Southern Saskatchewan: EDCO Plumbing & Heating is steady with 6 plumbers and 2 pipefitters working on the Drive Products building near the new union hall in Regina, Conexus Arts Center Boiler and Renovation work, Muscowpetung Reserve School, ongoing service work on all the Catholic Schools and just picked up a job at the new Global Transportation Hub. UA Local 179 News – Winter 2012/2013 9|Page Black & Mcdonald is steady with 4 Refrigeration Mechanics and 2 Plumbers doing service/maintenance work all over Southern Saskatchewan. They also have 4 plumbers working on a SIAST Wascana renovation, RQHR Health Centre and some smaller projects. B & M management has started planning meetings with the engineering and general contractors for the Moose Jaw Hospital & Maple Creek Hospital. They are planning to work together as a team on these jobs and the current plan is to start Moose Jaw in late winter or early spring and then start Maple Creek a couple months later. They will need a minimum of 12 plumbers or pipefitters on both hospitals according to management and it will be approximately 1 ½ years of work. If anybody lives in Moose Jaw or around Maple Creek please let me know as they would prefer local people but will consider anybody that wants to work for them. Currently they are seeking an out-of-scope plumbing construction manager and a service manager. If anybody is interested in those jobs please contact me as I would prefer a UA brother or sister acquire both of these jobs. Black & Mcdonald head office has given the go ahead to build a big construction division in Regina so they are currently bidding on everything. POW CITY Mechanical is steady with 24 plumbers working at the RCMP barracks dorm building #2 and starting building #3. Local 179 plumbers have been working at the RCMP barracks for over 3 years on Dorm #1 and #2. With the work on Dorm #3 they expect to be there for another year or more. Also in Regina they are working at the new Wascana School, College Park #2 Retirement Home, General Hospital Renovation, Hill Tower 3 and a few smaller jobs throughout the province. As well they are still working on the Redvers Hospital. They are estimating a lot of work but having a hard time competing with the non-union companies. Marathon Mechanical is steady with 4 plumber/pipefitters working at the RCMP barracks APS building Renovation Phase #1 and it sounds like they acquired Phase #2. Christie Mechanical is steady with 17 plumbers working within Regina at our new union hall and in Weyburn at the new SaskPower building. Their maintenance division is steady with 1 Plumber, 1 Pipefitter and 4 Refrigeration Mechanics working at the SaskPower plant in Estevan and all over Southern Saskatchewan. They are estimating a lot of work but having a hard time competing with the non-union companies. C & E Mechanical is steady with 14 plumbers working within Moose Jaw at finishing the new Boston Pizza, the Moose Jaw/Caron/Mortlach Pumping Station, White City School and several boiler installs all over Southern Saskatchewan. They are also doing maintenance/service work all over southern Saskatchewan. They will need to hire a few plumbers to help with the White City School soon. Discount Plumbing & Heating is busy with 6 plumbers doing service work and renovations all over the city of Moose Jaw and surrounding area. Johnson Controls is steady with 3 HVAC/Refrigeration Mechanics doing service work all over Southern Saskatchewan and immediately requires a 2nd, 3rd or 4th year apprentice. They have hired a Refrigeration Mechanic recently. UA Local 179 News – Winter 2012/2013 10 | P a g e Honeywell Controls is steady with 6 HVAC/Refrigeration Mechanics doing service work and retrofits all over Southern Saskatchewan. Broadway Refrigeration has picked up there first job in Saskatchewan and is hiring there first apprentice to help complete the A/C installation for the new Center Square Place Apartments in Downtown Regina. They will be looking for a Refrigeration Mechanic in the new year to help with the installation. I will be certifying this company very soon. Standard Mechanical is steady with 2 Service Vans doing HVAC/Service Work all over Southern Saskatchewan. Simplex Grinnell is busy with 6 Sprinkler Fitters working at the Co-Op Refinery, 7 Sprinkler Fitters working at Rocanville, 4 Sprinkler Fitters working at the Hill Tower 3 in Regina, condo/apartments in Regina, Mosiac Belle Plaine Water Mist System and finishing Swift Current Bus Barn. The service department is steady with 3 Service Vans doing work all over Southern Saskatchewan. Upcoming work is at the camp at Jansen Potash Mine. They have hired several people in the last couple months. Viking Fire Protection is very busy with 13 Sprinkler Fitters working within Regina at the new Lavalee School, new Regina Skills & Trades center, David Johnson Building, 2nd Ave. Rental Units, Rose Garden Highrise, Healthline Building Renovation & RQHR Health Center. Outside of Regina they have a lot of work at Vibank School Phase #2, Radville Marian Health Center, Kipling School Phase #2, Estevan Viking Oil Field Building, Assiniboia Canalta Hotel, Weburn SaskPower building, Weyburn Southeast Cornerstone School, Yorkton Harvest Meats, the old Yorkton Painted Hand Casino building and they have 2 service vans doing work all over southern Saskatchewan. Outside of Regina they have a lot of work at the Rocanville Slimes building and loadout, Rocanville Scissor Creek office building, Redvers Health Center, Yorkton with many jobs such as a Days Inn Hotel, Holiday Inn Hotel, Canadian Tire Fire Pump addition, Royal Ford building and some warehouses. They have a lot of upcoming work including the SaskPower Carbon Capture job, Carson Energy building in White City and many other jobs that have not even been designed yet. The service department is busy with 11 Sprinkler Fitters working all over Southern Saskatchewan. Vipond has hired a couple people in the last couple months and is keeping a lot of Saskatoon guys busy as well out of town. Coming up very fast is the Christmas and the New Year holidays. The Training Centers and Training Offices will be closed from the end of the day on December 21 and will reopen on January 2, 2013. The first thing I would like to mention is the Provincial Pipe Trades Apprenticeship Competitions. These are open to all Indentured Apprentices that have contracts supported by Saskatchewan Piping Industry Joint Training Board. Notices will not be sent out to each Apprentice. Consider this as notice that if you are interested to send me a letter advising my office that you wish to compete. Once my office receives your letter of intent, your name will be added to the Competition Roster. No dates have been set for this, but this event will proceed in either March or April of 2013 at the Saskatoon Training Center. In the last Local News Newsletter I had mentioned that we would be sending each Apprentice the information regarding the 2013 Apprentice Competitions. On further review, I have changed my mind and if you are interested in competing, the onus is on you to identify yourself to my office by way of a letter. You can either mail the letter in, email it to [email protected] or drop it by either the Saskatoon or Regina Training Offices. Last newsletter I wrote about privacy laws pertaining to you and how we cannot respond to anyone who requests information from my office(s) regarding our Apprentices. One example is when a wife, girlfriend, Mom, etc. calls regarding anything that is part of an individual’s file. We do not provide that information and many times the people asking are not happy with what we tell them. Privacy laws are what they are. The next paragraph is what I wrote last time. I am keeping it in as I feel there are many that probably did not read it. I would like to take the opportunity to advise all Apprentices that when you need something from either of my offices or information, you need to call in to us. This applies to trade time issues, address changes, telephone numbers, email addresses, new phone numbers, courses, and anything else for that matter that pertains to your Apprenticeship. We often receive calls from your parents, girlfriends, or wives. Due to privacy laws, we will not be providing any information to anyone other than the person we are sponsoring as an Apprentice. At the time of this writing, I am working at setting the course schedules for the next months after the New Year. I will be working off the Blue Responder Forms and schedule accordingly. One thing I do wish to add here is that our Regina Training Center will be moving into the new UA UA Local 179 News – Winter 2012/2013 12 | P a g e Local 179 location in Regina. The training side, specifically the shop areas are not operational the minute we get access to the completed complex. At this time there is a Canadian Training Fund Grant Application in for tooling and equipment for the new shops. I am not sure what or how much will be approved at this time. At the same time, we need to keep the welding shop on Cornwall Street up and running so as we can still put on welding courses, and provide weld testing service to TSASK. The administration part of the Regina Training Office will be moving into the new location as soon as access is given. I hope that the transition will go smooth. It should take 2 to 3 days to get the office up and running. I am asking all members to be and show patience during this transition. I know from when we moved into the new Saskatoon Facility there were some that must have thought a quick snap of the fingers is all it takes to get these things up and running. I wish it was like that to be honest. It is not. There are offices to set up computers to set up, networks to be configured, filing systems to be installed, telephone systems to be switched over, internet connections to be configured, and the list goes on and on. In short, there are many items that will need to be done quickly and at the same time; your understanding and patience will be greatly appreciated. I thank each of you for that. In order to minimize how long it will take to get the new weld shop operational, we are prefabricating the weld booths in Saskatoon. Our plan is to build them and then ship them in pieces that can then be assembled in the new shop. Most of the new weld booths are going to be 6 feet X 8 feet. They are being built using a similar design we used in the Saskatoon weld shop. I am also going to push hard to ensure that both the classrooms in the new Regina Training Center are up and running soon after the move in time frame. There are many class type courses that due to a lack of a suitable training space have been on hold. The new facility will allow us to schedule more and provide more. I again ask for your patience and understanding while we transition into the New Training Center. These are exciting times for our Local and the Joint Training Committee. The new infra-structure to support a growing Local will serve this Local well in the present and in the years ahead. My hat is off to former Business Manager Randy Nichols and current Manager Troy Knipple for the forward thinking and perseverance in getting these projects from concept stages to where they are today. These are bold steps and take many hours of thought process as well as many steps and discussions. It is unbelievable the details that go into new facilities. The decisions that have been made to provide the membership with new Local Union Offices and new Training Centers are the right ones. Every organization in North America is entering into a stage that has never been seen before. I am specifically referring to the high numbers of very talented individuals that will be transitioning to retirement or semi-retirement years during the next 5 years ad beyond. UA Local 179 News – Winter 2012/2013 13 | P a g e I have been looking for the past 7 years at the numbers of baby boomers with-in our Local that will be retiring in the next 5 years. These numbers are pretty high. The numbers in 10 years from now are even higher. This is one of the reasons we are working hard to increase the numbers of Apprentices and build the infra-structure to ensure that our new members are properly trained to replace the experienced members. At this time, our Local has one of the highest ratios of Apprentices across Canada. We hope to keep this going. It is all part of the strategic plan to ensure that our organization has continued success in supplying qualified people to our Contractors. There are some nay sayers out there and my response to them is simple. Plan to succeed or do not plan and fail. Success always comes to the organizations that take the time to plan. The usual courses offered are Pipe Fabrication, Gas, Math/Science, Plumbing Code, Blue Print Reading, and Hot Water Heating Practical. These sessions are open for all members to participate in. For the new member, please be advised that the scheduling of any of our courses has a process. You need to contact the Training Office at 1306-651-3737 to register for a course. We have received numerous calls from members that wonder why they did not receive a letter or a call regarding courses we have either recently scheduled or have going on. We send letters to all who have registered with a Blue Form or a phone in or email. The letters we send indicate for the member to call in and confirm that they will attend the course. If one has not identified to my office they wish to take a particular course, how would we know to send that person a letter. We have received a number of these calls lately and it is simply unbelievable to think that some people think we can read minds. It is also unbelievable that some individuals think that we are supposed to either write every member a letter or call every member each time a course is scheduled. All in all it was a great year for your training programs. We finalized the shops in the Saskatoon Facility and the new Facility in Regina is very close to move in and then the work begins to make the training shops operational. With the participation of the membership, we have been able to schedule numerous courses and programs. It is all good. UA Local 179 News – Winter 2012/2013 24 | P a g e By Howard Willems, founder of SADAO The Saskatchewan Asbestos Disease Awareness Organization (SADAO) is committed to informing the public that asbestos-related disease is the most significant contributor to occupational mortality and is a public health crisis in Saskatchewan and in Canada. SADAO is also committed to pursuing the establishment of a Provincial Asbestos Awareness and Management Plan. We have made great strides with the city of Saskatoon with a written commitment that they have: - gathered historical information on the past management of the asbestos containing materials (ACM) in their buildings, developed a budget for 2013 for hiring an asbestos management consultant, and have engaged with Project Services to assemble an RFP to solicit for asbestos management services that would include: · Thorough inventory and registry of ACM in our civic facilities · Assessment of condition of existing ACM · Priority management and removal roster · Identification and recognition system The safety team has developed an information and awareness program for the staff, and going forward they will introduce the results of the Asbestos Management program in their Tool Box talks with staff. UA Local 179 News – Winter 2012/2013 Timelines are that they hope to have the assessment, inventory and registry completed in early 2014. A Postcard campaign has been initiated for the provincial government because of their reluctance to develop and maintain a provincial registry. We need assistance in lobbying cities/municipalities, provincial school boards, health divisions concerning the presence and condition of asbestos in the buildings they own or operate as they fall outside the provincial governments oversight. Each of these jurisdictions could then develop their own list/registry that could be linked to a full provincial registry. Howard Willems passed away on November 8, 2012 from Mesothelioma he contracted from Asbestos exposure. NOTE: United Association Local 179 knows how harmful asbestos exposure can be. One is Federal Private Members Bill C-377 an act to amend the Income Tax Act concerning Unions. The second is the Saskatchewan Government is about to introduce a new Employment Code which is going to be a new law to replace the 15 current pieces of labour legislation which govern the province. Bill C-377 as currently written would require unions to report all transactions of over $5,000 including benefits, pension trusts, salaries, expenses, pension payments. This Bill is seen as an attack on Canadian Labour Unions with the major supporters of Bill C-377 being those in direct competition with unions such as the Merit Contractors, Labour Watch, CFIB and the like. Those who support this bill argue that it is about making unions more transparent and accountable but we know that this is really about competition and weakening the union movement. Bill C-377 passed second reading in March of 2012 and was referred to the Finance Committee. The Finance Committee held testimony on the bill on October 25 th and November 7th 2012 and the Bill is still in committee. Many of the witnesses who presented to the committee stated many problems and concerns with the bill. One of those presenters was the Federal Privacy Commissioner Jennifer Stoddard who explained that this bill was deeply flawed in that it violated people’s privacy in a number of different ways. Also presenting was Robert Blakely on behalf of the Canadian Building Trades Department of the AFL/CIO. Blakely is a member of UA, he is a steamfitter out of Edmonton and also a lawyer. Blakely argued that he found it troubling that only unions were being targeted in this bill when other professions such as lawyer’s also paid professional dues which were tax deductible and were not included in this legislation. He further stated that this bill is about competition and not transparency and that is made clear by the fact that the Merit Contractors are the biggest supporter of this bill. If you want to send a message to the Finance Committee to tell them to put an end to this antiunion bill you can do so at a website set up by the Canadian Building Trades at www.workersbuildcanada.ca. The Saskatchewan Government commissioned a review and consultation of all labour legislation in Saskatchewan in May of this year. They indicated that they intend to take all 15 pieces of labour legislation that exist in Saskatchewan and replace them with one new Employment Code which they will introduce in the fall of 2012. They provided a 90 day period for individuals, businesses and organizations to make submissions to the consultation. UA Local 179 News – Winter 2012/2013 28 | P a g e UA Local 179 made a submission to the consultation where we argued that we do not understand why the Government would pursue wide reaching changes to labour legislation at a time when our industry has not seen a labour dispute in over 20 years. We further contended that the Government needs to focus on trades training and apprenticeship and not changes to the labour legislation if they wish to be prepared to deal with the growing demand for skilled labour in the province. There were several submissions from businesses with some troubling suggestions for changes to labour legislation in the province including: requiring 75% of members to vote in favour of certification but only 50% plus one to vote in favour of decertification (Merit Contractors); Support to average work hours over a two week period so that a worker could be scheduled to work 60 hours one week and 20 hours the next and not receive overtime (Merit Contractors); Support for “Right to Work” Legislation which would allow members to opt out of paying union dues but still get all the benefits of unionized work (Graham Construction); Requiring workers to give 2 weeks notice to quit a job but only requiring 4 hours notice from employers to lay employees off (Ledcor); and Removing workers’ right to refuse to work overtime (BHP Billiton, Construction Labour Relations Association of Saskatchewan). The Saskatchewan Building Trades released a paper entitled Saskatchewan Employment Code: Taking the Low Road to Growth in which they publicly criticized these suggestions of business and highlighted some facts. You can view this paper on the UA Local 179 website. As of November 19, 2012 the Government has not introduced the new labour legislation, The Saskatchewan Employment Code. However, on Friday, November 18, 2012 the Labour Minister Don Morgan released some of the details to a Saskatoon business luncheon and to the media. In the November 19, 2012 Leaderpost it stated: "Even though the bill - titled The Saskatchewan Employment Act - won't be introduced until later this month, he (Morgan) told the luncheon crowd the province's unions will be in for some major changes, including new requirements to disclose exactly how they spend the dues they collect." The article further stated that Morgan indicated there will be alterations to the 40-hour work week, new requirements for unions to report spending, and changes to the power unions have to impose fines on their membership. The Government has indicated this legislation will be introduced before the end of the fall legislative session which ends on December 6, 2012.
