BYLAW NO. 4-2005
A BYLAW IN THE CITY OF
LLOYDMINSTER IN THE PROVINCES
OF SASKATCHEWAN AND ALBERTA
UNDER THE LOCAL IMPROVEMENTS
ACT R.S.S. 1993 AS AMENDED
RESPECTING SPECIAL ASSESSMENT
WHEREAS the Council of the City of Lloydminster deems it expedient to fix a
certain rate per metre of frontage which will be a uniform rate to be especially
assessed upon the land abutting directly upon the work pursuant to the Local
Improvements Act R.S.S., 1993; and
WHERAS the Council may provide that corner lots shall be exempt in whole or
in part from liability in respect of any work abutting directly on the flank of such corner
lots;
NOW, THEREFORE, the Council of the City of Lloydminster in the Provinces of
Saskatchewan and Alberta enacts as follows:
1. Business District — Commercial
In a Business District — Commercial, those rates as described in Schedule "A"
attached hereto and forming a part of this bylaw, are assessable to the Owner for
works authorized in the year 2005, and where a corner lot in a business district has
a frontage which abuts directly on a water main or sewer main constructed as a
local improvement, the flank of the said corner lot shall be exempt from liability in
respect of the cost of the water main or sewer main constructed after the passing of
this Bylaw, but, in any event, the exemption shall not be for a greater distance
along the said flank than 36.6 meters (120 feet).
2. Residential District
In a Residential District, those rates as described to be replaced with a new
Schedule "B" which are attached to and forming a part of this Bylaw are assessable
to the owner for work authorized in the year 2005 forward, and where there are
corner lots in residential areas with flankage abutting on the said work, the whole
flank shall be exempt from the special assessment as stated in the Bylaw, but in
any event, the exemption shall not be for a greater distance along the said flank
than 36.6 meters (120 feet).
This Bylaw shall come into force and effect upon the final passing thereof.
