Scope The Housing Authority is in the process of setting up a Government owned company in order to handle the Implementation and Management of the forthcoming Social Housing Projects. For this purpose and on behalf of the forthcoming new Company, the Housing Authority is issuing an Expression of Interest for those ‘Periti’ who would be interested in offering the necessary professional services in connection with the above mentioned Social Housing Projects. Periti will report to the Head of the Contracting Authority or his delegated official/entity. 2. Requisites The service providers to be engaged will possess the following qualifications: i. Warrant of Perit. 3. Main Responsibilities The following services shall be rendered: i. General Architectural proposal ii. Preparation and submission of a full development application to MEPA iii. Follow-up of application including meetings with MEPA to ensure speedy issue of permit iv. Structural design including geotechnical investigation where required v. Preparation of detail/drawings for tender/construction purposes: a. Detailed Architectural Design b. Detailed Structural Design c. Detailed Mechanical and Electrical Design d. Detailed Interior Design and Finishes of Common Areas and Units e. Landscaping Design of External Areas vi. Preparation of specifications and tender documents including Bill of Quantities vii. Preparation of detailed estimation of costs viii. Technical adjudication of tenders ix. General supervision on site, quality control and monitoring of project up to completion of snags and issue of certificate of completion x. Issuing of regular reports on progress of works and performance of contractor xi. Issuing of instructions to contractor including evaluation of additional works necessary and assessment/recommendations of claims made by contractor xii. Detailed measurement of works and issuing of Certificate of Payments xiii. Certification of Fire Safety and other applicable certifications. xiv. Issuing of an Energy Performance Certificate xv. Project management services including continuous site supervision while works are in hand. xvi. Additional services such as revisions in drawing made necessary by client’s request, technical problems on site, MEPA requirements etc. have to be taken into consideration. Selected Periti shall ensure they are adequately supported and equipped to deliver the services required. Selected Periti are expected to meet to very tight deadlines. The Contracting Authority retains the right to withdraw from the service agreement should it, at any time, feel that service is not being rendered satisfactorily and/or according to the set time frames. 4. Remuneration 4.1 Total of 7% (excluding VAT) of the certified value of works in connection with the project which will be payable on completion of different phases of the project as follows (items i. to xv. are listed in Section 3): a. On Completion of whole project: Based on amount certified in interim payments to contractor This includes completion of snags, issue 0.5% of certificate of completion and final bill. 4.2 The percentage due up to item viii. will be calculated on the estimated construction cost of the project. However, the total fee due would, on completion of the project, be adjusted to a total of 7% (excluding VAT) of the actual project cost. This fee is deemed to include all measurement fees and any required revisions of plans or additional drawings. No additional fees will be payable in case project completion is delayed or extended for any reason. 4.3 In case any of the items listed in Section 3 are not required then the rate applicable for these particular items will not be payable to the Perit. 4.4 If a MEPA permit already exists but may need changes to the submitted design proposals and plans, a service charge is to be paid by the Contracting Authority for such amendments to the respective Perit. The service charge is to be discussed and agreed between the Architect and the Contracting Authority on a case by case basis depending on the extent of the changes. 5. Conditions 5.1 Periti will assume sole and full responsibility of the whole project including any works and/or services which may be assigned to the sub-contractor/s and/or third parties. Therefore, the Contracting Authority is exempt from any liability and/or responsibility of acts and/or omissions arising from the relationship entered into between the architect and third parties. 5.2 Periti will make use of their own transport, support staff and backstopping facilities required for the implementation of the services. 5.3 The successful applicant shall be required to commence the services forthwith following the order to start. 5.4 No equipment is to be purchased on behalf of the Contracting Authority as part of this service contract 5.5 Conditions of Employment for Perit’s employees: 5.5.1 All employees engaged on this contract shall enjoy working conditions such as wages, salaries, vacation and sick leave, maternity and parental leave as provided for in the relative Employment Legislation. Furthermore, compliance with Chapter 424 of the Laws of Malta (Occupational Health and Safety Authority Act) as well as any other national legislation, regulations, standards and/or codes of practice or any amendment thereto in effect during the execution of the contract shall be adhered to. In the event that it is proved otherwise during the execution of the contract, the latter shall be terminated with immediate effect and that no claim for damages or compensation be raised by the Perit. 5.5.2 No part of the services to be provided under this contract shall be subcontracted to an economic operator who has in his employment employees, who are already in employment with the bidding entity and are carrying out, with the sub-contractor, the same or very similar duties as those in their contract of employment with the Perit’s entity. 5.5.3 The sub-contractor/s agree to all these conditions. 5.5.4 Periti engaged in this EOI declare that the service being provided under this contract will be carried out solely by the bidding entity employees, or bona fide self-employed individuals. No work will be carried out by persons designated as self-employed where their actual employment status in terms of the Employment Status National Standard Order LN 44/2012 is that of an employee. 5.5.5 Employees of the Perit’s entity whether providing services to the Contracting Authority or not, have a written contract of service and are registered with the Employment and Training Corporation. Periti selected through this call shall submit a list of employees who will be providing the services to the Contracting Authority. Copies of the written contracts of service of the employees will be available at any time for inspection. 5.5.6 The Perit’s employees shall be given a detailed payslip containing all relevant details including the amount paid, normal hours worked, overtime hours, hours worked on Sundays and Public Holidays, hours availed of as leave or sick leave, a breakdown of bonuses/allowances as well as deductions made (such as social security contributions and income tax). 5.5.7 All the wages/salaries of the Perit’s entity’s employees are paid only by direct payment in the employee’s bank account. 5.5.8 The relevant bank statements of wage/salaries’ deposit and copies of the detailed payslips will be made available as and when required by the Director of Industrial and Employment Relations. 5.5.9 If the Perit is found in breach of any of the above declarations it is accepted that this contract will be terminated and will have no right to be compensated for any damage s/he may have suffered or will suffer in the future in respect to this termination. 5.5.10 The Contracting Authority reserves the right to request a list of the minimum hourly workers’ costs involving the provision of the employees’ services in this Expression of Interest. 6. Submission Requirements 6.1 Interested and suitably qualified persons are invited to submit the following: a. A detailed CV (Europass format) including a brief description of experience in related discipline and relevant past assignments. b. Relevant warrant certificates. 6.2 Interested parties may submit requests for clarifications by sending an email on: [email protected] by Wednesday 3rd February 2016. Questions and answers and amendments to the Expression of Interest document will be uploaded on the Housing Authority website: www.housingauthority.gov.mt. It is the responsibility of the interested parties to visit this site to be aware of any changes/clarifications. 6.3 All submissions must be submitted in full and sealed in an envelope bearing the reference “Expression of Interest for the Provision Services by Periti” so that the bid can be identified. Late quotations will be rejected and will not be considered for evaluation. No liability will be accepted for rejection of late quotations. The submissions must be deposited in the Housing Authority’s EOI box till 10:00am CET of Tuesday 9th February 2016 at the Housing Authority.
