Patterns on ties and blouses are fine. An Update on Mandatory Pro Bono by Robert Ostertag, Esq. The NYS Bar Association’s House of Delegates will meet in less then two weeks on an extremely important issue to you, your and everyone else’s membership, and your delegate to the House will be voting. I have written to every county bar association in the state, and every county bar association but one has expressed support for my opposition to the Administrative Board’s rules 118.1 and 118.2, as adopted at the instance of the Chief Judge, requiring mandatory reporting of attorneys’ pro bono contributions in time (a minimum of 50 hours per year) and dollars, with the threat of his reporting to the local press the names of those attorneys who do not meet his arbitrary minimum requirement. Such mandatory reporting makes pro bono itself essentially mandatory despite ethics rule 6.1 which specifically makes pro bono aspirational only. There is widespread opposition throughout the state to the current rule. The issue here is not pro bono, but rather mandatory reporting of pro bono and its aftermath. Within the past few months, the state bar’s president has negotiated with the Chief Judge and his representatives in an effort to undo what the Chief has initiated. His efforts have been many and are commendable. He, too, opposes the mandatory requirement. The rule already exists and reporting of hours and dollars is already upon us. Many (though I don’t know how many) attorneys throughout the state (including me) have declined to provide any such information on their re-registration forms, and I’m led to believe that that number is indeed substantial. Another component to the problem is the Freedom of Information Act (FOIL) which would require OCA, upon request, to release to the local press the names of lawyers who do not comply with the Chief’s rule. The threat of public ridicule is real, particularly upstate where local newspapers have little to write about and would likely write critically, even to the possibility of effectively putting someone out of practice. There apparently has been a tacit understanding that would no longer require attorneys to identify themselves with regard to the reporting mandate, so that whatever numbers OCA obtains would be anonymous. We’ve seen nothing binding, however. How that agreement would be implemented has yet to be determined. It likely cannot occur through the use of a computer, or so I understand. That would seem to leave the US mail, using anonymous envelopes, postmarked (at least by upstate attorneys practicing in small towns) from locations other than where they practice to make anonymity foolproof. That tomfoolery is where the judicial hierarchy seems to have led us. Numbers of hours (minimum of 50 per year) have not been addressed. That requirement is particularly discriminatory to solo and small firm practitioners who comprise some 63% of the privately practicing bar in NY and who, for the most part, cannot afford such a minimum commitment. Nor has the issue of monetary contribution reporting been addressed. Seems that just about everyone believes that the Chief Judge has no business in our checkbooks, and he doesn’t. I would offer that delegates should think carefully before they support the adoption of anything binding upon the state bar’s membership before all the issues are determined and agreed upon by both sides, preferably in writing, including pro bono hours, money reporting issues, the method of unidentified reporting and the assurance of its anonymity. And I believe we should also seek a ssurance that what the Chief Judge does with the information he acquires does not morph its way into mandatory pro bono which the State Bar Association has consistently opposed, and which the Chief once said he would not seek to impose, but which he later seemed to retract when he told us that everything is now on the table. May I respectfully urge, therefore, that you call these matters to your respective delegates’ attention and that they ask to be heard at the House meeting. Thanks so much. It was really very simple… and it made a lot of sense. He was a Catholic kid from Queens; I was a Jewish kid from Brooklyn. He enjoyed a challenging courtroom battle; I didn’t even know where the Courthouse was. I was happy to stay in the office putting real estate deals together. We were a couple of years out of law school working together at, what was then, Poughkeepsie’s largest law firm. It was Veteran’s Day in November 1984. The office was closed but Bill and I were working. I approached Bill and said “C’mon, we can do this on our own.” Bill looked at me and replied, “Let’s do it” – and that’s how Tendy & Cantor was born. We started out without a desk, sitting on the carpeted floor staring at the telephone, waiting for it to ring. Pretty soon the phone began to ring and it rang and it rang and it rang. And it wasn’t just luck – it didn’t take long for Bill to become well known as a skilled trial attorney. Bill quickly gained a reputation in the Hudson Valley as a stellar criminal defense attorney who pulled a rabbit out of a hat in the toughest of cases. Time and time again, Bill won cases that other attorneys turned away because there was no hope of winning. And yes, it wasn’t just luck, and it wasn’t just because Bill was a good attorney. It was because Bill Tendy was a GREAT attorney – the most incredibly gifted and skilled attorney I have ever seen. I don’t feel that way just because Bill was my partner – there are dozens of other attorneys and judges here in Dutchess County who will agree that Bill was not just good, he was great. And he was MY partner – I was incredibly blessed to have had Bill Tendy as my partner for 28 years. For those 28 years, Bill never ceased to amaze me. If you were a client of Bill’s, you were fortunate because you were represented by the best. When Bill was on trial, little else mattered. He put blinders on to everything else in the world, except for his family of course. He out-worked, out-strategized and anticipated his adversary’s every move. Bill had this uncanny ability to view things differently than others did. He’d talk to a client or a witness and immediately know if they were telling the truth or lying. He’d go to a crime scene and would notice things that no one else saw; his legal mind was amazing and his ability to strategize, absolutely incredible. As we all know, Bill chose to practice law upstate. He loved the quieter pace of living up here, a good cigar, some Pappy Van Winkle bourbon, and perhaps most of all, the solitude of fly-fishing on his beloved trout stream in upstate Chauteguay. But I am convinced – in fact, I am certain - that if Bill Tendy had chosen to practice law in New York City, he’d be a nationally renowned and celebrated attorney. Yes, Bill was that good. Yes, Bill was that great. A few days after Bill passed away, I ran into Bryan, an old friend of mine. I told him that Bill had passed away and immediately, tears began to run down Bryan's face. About 15 years ago, Bryan's then 20 year-old son ran into some trouble - for lack of better words, he just wasn't a good kid. On more than one occasion, Bill helped Bryan's son out of a jam and made a real effort to turn this kid’s life around. Bryan proceeded to tell me that today, his son is a fine, upstanding family man. He is now 35 years old, has a wife, two kids, and is a Sergeant Major in the United States Air Force. “Congratulations” I said, “I give your son a lot of credit.” “No,” said Bryan, “Give Bill Tendy the credit. Without Bill's influence on my son, who knows where my son would be today or if he would even be here today.” So to Bill’s wife Esther, his children Lauren and Will, and to the rest of his family and friends, please take some comfort from the fact that unlike so many other lives that come and go, Bill’s life, albeit too short, had true meaning. Bill left a mark on those whose path he crossed, and had a positive impact on the lives of so many people. He was a great guy and a great attorney. I am so honored, so privileged, and so humbled that for 28 incredible years, I was Bill Tendy’s partner. And to, and on behalf of, everyone and anyone who reads this, I say... Thank you Bill... Thank you my friend. In Memoriam William Tendy, Esq. by Hon. David Steinberg A sense of overwhelming sadness and loss descended on our legal community in August when William Tendy, Jr. died after a courageous struggle against ALS. He was 60 years old. When the Poughkeepsie Journal posted the news of Bill’s death, they got it right: “Revered local attorney who died was compassionate, intelligent.” It is true that Bill was revered by so many of us as a gifted trial lawyer, and a strong and compassionate advocate for his clients. He represented the very highest ideals of our profession that exists to assist and counsel people in need. So many of us looked up to him. So many of us wanted to be like Bill Tendy when we grew up. I had the good fortune to work with Bill on a few cases. I saw first hand what he went through during the process of defending an individual, and how serious and committed Bill was to that awesome responsibility. He would talk about it at times, about the weight of defending an individual on trial for his liberty, his reputation, and even his life. He would lose sleep, working and thinking about his clients at all hours of the day and night. He would worry that he might be missing some fact or detail that would be the key to a successful defense. He went to visit clients in jail at night and on weekends, always respecting their need to be involved in their defense, or to make the difficult decision to take a plea or go to trial. He showed the utmost respect for the humanity of his clients. How fortunate were they to have Bill Tendy as their lawyer. I had the greater fortune to call Bill my friend. He was simply a fine human being. Many know of his sharp sense of humor with its sardonic view of the system. He loved to lacerate the pompous and self-righteous. We both knew that sometimes you have to laugh to keep from crying in this line of work. We come into this world with nothing more than our names, and we hope we can leave this world with a good reputation. We also hope to leave the world a better place. Bill’s legacy on both counts is assured. Bill is survived by his beloved family: his wife, Esther and his children, Lauren and William. He is also survived by his mother, Anna, and his three sisters, Susan, Sheila, and Paula D’Elia, and his three brothers, John, Thomas and Robert. Let’s keep Bill in our hearts always.
