“Mixed Use Asset” Recap
The boat, the bach and the tax
F
or many, the long summer days at
the bach, or on the boat are a distant
memory, as the reality of work sets
in. Now, as another year comes to an end, it’s
a good time to recap some of the tax rules
associated with those assets. Think back to
how many days you, your family and friends
got to enjoy them before it all grows a little
too fuzzy.
If you already have a bach that is both rented
and used personally, then hopefully you
should already have a good system to keep
track of the mixed use requirements which
began 1 April 2013. However, if you have
recently acquired a bach or have a boat or
aircraft then this may help you get a head start
on your next tax return.
What is a Mixed Use Asset?
• An asset that is used both privately and to
produce income,
acquired, or for property i.e. the bach of
any cost or market value.
How does it affect you?
If you have a Mixed Use Asset, then good
record keeping is necessary. The majority of
costs associated to the asset will be claimable
based on its “private” use vs its use to derive
income. At first glance this may seem simple.
However difficulties arise in deciphering what
constitutes private use and what expenses
should or should not be apportioned.
Private Use Vs Income Earning Use
This may seem like a clear distinction
however, private use extends to include not
only your own personal use but also the use
of;
• your family and those associated to you,
even if they pay for that use, or
• anyone who pays less than 80% of the
market rental rate.
• is unused for 62 days or more within a tax
year,

• is a boat or aircraft with a cost or market
value more than $50,000 when it was

not deductible,
however the amount of rent that is paid by
those that are considered “private” are exempt
and does not need to be included as income.
The majority of other expenses that relate
to both private and income earning use i.e.
interest, rates, general maintenance, are
claimable based on the income earning use
divided by the total use.
Note that these rules can become more
complicated when your income is less than 2%
of the value of the asset, or if the asset is held
by an ordinary company. In these situations
we recommend you seek specific advice.
Is it just too difficult?
Regularly keeping detailed records of your
asset’s use is key in easing the pain in
preparing year end accounts. This could be
as simple as keeping a diary of what days
the property was used and who used them.
However, if you know that this is not your
forte then I would recommend finding a
booking system that assists in record keeping
or seeking assistance from your accountant.
Alternatively if you receive less than $4,000 of
income each year then you can disregard the
whole process and include no profit or loss
from the asset.
Lastly, note that GST may also require
mixed use adjustments and there are some
unforeseen and quirky GST rules that can
apply to holiday homes, therefore we always
recommend that specific advice be sought.

The amount of deposit, or the capital
required, increased last year to 20 percent.
The loan to value ration or LVR while still
20 percent doesn’t mean to buy a second
home you need to physically have 20
percent in hand. A bank can look at your
current property, or investment property
(s), and utilise any surplus equity you
might have as the extra security for the
new purchase. You can conceivably buy a
property without any deposit at all if you
have sufficient equity elsewhere.
This all sounds great, and
good communication is
key to getting the right
mortgage to suit your
needs. If buying property,
or simply letting them use
your equity, it is a good
idea to put the property
in a trust to prevent, or
miminise, future problems
should your children’s
current or future partners
not work out.
Getting things done right
the first time is much
easier than trying to redo at a later date.
Putting into a trust later requires selling
home to the trust and gifting, as well as the
establishment of a ‘new’ mortgage with all
the criteria involved, i.e. capacity to pay,
collateral and character past history, et al.
A good trust lawyer is key to setting up
something that will suit you for generations.
