RESI Non si accettano merci di ritorno una volta che l’ordine sia stato regolarmente trasmesso ed evaso se non preventivamente concordate con la direzione commerciale e confernato tramite autorizzazione scritta. GARANZIA E LIMITI DI RESPONSABILITA Lucitalia Milano Srl garantisce le prestazioni dei propri prodotti solo ed esclusivamente in relazione ad usi, destinazioni ed applicazioni dalla stessa espressamente indicati. La garanzia dei prodotti ha una durata di 2 anni decorrente dalla data di consegna al Compratore. Eventuali reclami dovranno essere comunicati per iscritto a Lucitalia Milano unitamente alla copia della fattura d’acquisto, l’indicazione della data di consegna, la descrizione del difetto e la quantità di prodotti difettosi. Lucitalia Milano provvederà a riparare o sostituire, a sua insindacabile scelta, il prodotto difettoso entro un ragionevole periodo dal reclamo. Eventuali resi di merce difettosa verranno accettati da Lucitalia Milano solo se previamente autorizzati per iscritto, inviati correttamente, adeguatamente imballati e con trasporto prepagato. La presente garanzia non copre ulteriori spese sostenute dal Compratore in conseguenza della difettosità dei prodotti, in particolare Lucitalia Milano non si farà carico delle spese di ritiro dei prodotti difettosi dai clienti (ivi comprese le spese di smontaggio) e di spedizione ad essi dei prodotti in sostituzione. Qualsiasi responsabilità di Lucitalia Milano è espressamente esclusa nei seguenti casi: • uso, montaggio e/o manutenzione impropria o irragionevole dei prodotti, e/o loro scorretta conservazione; • se il danno o cattivo funzionamento sono causati da interventi sui prodotti non previamente autorizzati per iscritto da Lucitalia Milano (es. disassemblaggio, alterazioni, sostituzioni, ecc.); • se le qualità e le prestazioni sono state compromesse dall’applicazione di accessori non approvati da Lucitalia Milano. La presente garanzia assorbe e sostituisce ogni altra possibile responsabilità comunque originata dai prodotti forniti; in particolare il Compratore non potrà reclamare danni, riduzione di prezzi o di risoluzione del contratto. In nessun caso Lucitalia Milano sarà responsabile per danni indiretti o mancati profitti. Lucitalia MIlano si riserva il diritto di sopprimere e/o modificare senza preavviso eventuali prodotti inseriti a catalogo a scopo di miglioramento o per esigenze commerciali e/o produttive. La merce viaggia a rischio e pericolo del committente, anche se franco domicilio. PAYMENT Goods remain our sole property until fully paid. In case of missed payments any further delivery will be hold until settlement. Payments must be made only on our bank account, or to our representatives in possession of written authorization. If payment is made after the due date, interest will be charged at the current bank base rate plus 3%. In this case, the firm is entitled to suspend deliveries for orders in progress. LIGHHTING DESIGN All lighting engineering drawings, projects, studies and calculations remain property of Lucitalia Milano srl and cannot be published, nor reproduced without our prior written authorization. TECHNICAL DATA Descriptions and dimensions of luminaries shown in the catalogue and price list are indicative only. Lucitalia Milano reserves the right to make changes without notice that may be made to products because of production requirements or to improve and update items. INSTALLATION Different assemblings or transformations of products are strictly forbidden. Not authorized works will automatically cease any guarantee. The company will not be responsible for any damage and/or problem due to wrong installation. Our mounting instructions must be precisely and fully respected. If not every kind of guarantee will automatically cease and the installator may be law prosecuted. Moreover they must be delivered to the final user together with the conformity declaration to Norms of the installation. PRICES Selling prices can be changed at any time, without obligation of prior notice and information. DELIVERY TERMS Delivery terms: Ex works. The delivery times shown are indicative only, the company reserves the right to modify them at any time, without prior notice and without acknowledging any damage or penalty. RETURN POLICY Once the order is regularly transmitted, confirmed and shipped out return goods will not be accepted. GUARRANTIEE Lucitalia Milano guarantees the performance of its products only and exclusively in relation to how they are used, their destination and application as explicitly specified. The guarantee of the products has a two year guarantee starting from the date of delivery to the Purchaser. Any claims must be forwarded in writing to Lucitalia MIlano together with a copy of the purchase invoice complete with delivery date, description of the fault and number of products that are faulty. Lucitalia Milano, according to its indisputable choice will arrange either to repair or replace them within a reasonable period of time from the claim. Returned faulty goods will be accepted by Lucitalia Milano only if previously authorised in writing, correctly forwarded, suitably packed and with transport prepaid. This guarantee does not cover further expenses sustained by the Purchaser consequent to the faulty condition of the products; in particular Lucitalia Milano will not bear the cost of collecting the faulty products from customers (including cost of dismantling) and forwarding of replacement products to them. Any responsibility on the part of Lucitalia Milano is explicitly excluded in the following cases: • use, assembly and/or improper or unreasonable maintenance of the products, and/or their correct preservation; • if damage or bad functioning is caused by work carried out on products without prior written authorisation from Lucitalia Milano (e.g. disassembly, alterations, substitutions, etc.); • if the quality and performance have been compromised by the addition of accessories not approved by Lucitalia Milano. This guarantee includes and replaces every other possible responsibility stemming from the products supplied, no matter how it originated; in particular the Purchaser cannot claim damages, reduction in prices or cancellation of the contract. In no case will Lucitalia Milano be responsible for indirect damage or loss of profit. CLAIMS Claims for faults, defects, missing pieces or damages in materials must be lodged in written way not later than 8 days from receipt of goods. Replacements on guarantee are limited to components recognized to be unworking without any further charge. In this case, goods should be shipped back of perfectly packaged at customer cost. FORUM All disputes will be subject to the Italian jurisdiction in the Court of Monza. This price list, valid from 1st April 2014, cancels and replaces all the previous editions. RECLAMI Reclami per vizi, difetti, mancanze o danneggiamenti dei materiali devono essere presentati in forma scritta entro 8 (otto) giorni dal ricevimento delle merci. Le sostituzioni in garanzia sono limitate alle parti riconosciute non idonee senza oneri accessori di alcun genere, in questo caso la merce dovrà viaggiare in porto franco perfettamente imballata. FORO COMPETENTE Per ogni controversia si intende competente il foro di Monza. Il presente listino, valido dal 1 aprile 2014, sostituisce ed annulla tutte la precedenti edizioni.
