SAMPLEPHONICS ソフト音源共通エンドユーザー使用許諾契約書 1/4 © クリプトン・フューチャー・メディア株式会社エンドユーザー使用許諾契約書本ソフトウェアを正規にご購入されたオリジナル・エンド・ユーザー、及び本ソフトウェアを使用する権利を許諾されたユーザーを、以降「お客様」と言います。本ソフトウェアは、Samplephonics よりお客様に本ソフトウェアの使用が " 許諾 " されるものであり、" 販売 " されるものではありません。お客様は、音楽制作、映画、テレビ番組、ウェブサイトやメディア制作において、追加のライセンス料やロイヤリティを Samplephonics 並びに本ソフトウェアの制作、製造、配布に携わる関係者のいずれへも払う必要はなく、本ソフトウェアを使用する権利が許諾されます。著作権本使用許諾契約書で明示的に許諾されていない限り、以下を含みますがそれを限りとせず、お客様はファイル共有ウェブサイト、ウェブフォーラム、コンピューターネットワーク、ファイルホスティングウェブサイト上で、本ソフトウェアをコピー、再販売、リース、複製、配布することは固く禁じらています。本ソフトウェアに収録されているサウンドそのままを販売すること、または、後述する "Samplephonics について " で記載してあるビジネスと競業になるような方法で販売することは認められません。本ソフトウェアに係わる全ての画像、プログラム、オーディオデモ、テキスト、ロゴは Samplephonics がその権利を所有し、知的財産法によって保護されています。免責 Samplephonics、並びに本ソフトウェアの制作、製造、配布に携わる関係者のいずれも、本ソフトウェアやその付属資料、またはコンテンツなどの使用もしくは使用不能に起因する、利益の損失や蓄えの損失を含み、必然的、偶発的、間接的、特殊、懲罰的な損害に対して、たとえ Samplephonics がそのような損害の可能性を示唆されていたとしても、責任は一切負いません。 Samplephonics について Samplephonics は、ダウンロード商品（デジタルオーディオレコーディング、音楽制作ソフトウェア、その他関連商品）を、サウンドを扱うユーザー（ミュージシャン、ミュージックプロデューサー、作曲者、映像作家、ウェブデザイナーなどを含み、これに限りません。）へ販売しています。クリプトン・フューチャー・メディア株式会社（以下「当社」）は、本製品の契約原文（以下「契約原文」）を日本語に翻訳したものである本契約について、翻訳の完全性を保証するものではありません。もし本契約と契約原文に相違があったときには、契約原文を優先するものとします。また、その様な相違によって損害が生じたとしても、当社は保障いたしません。契約原文および本契約は、変更することがあります。その場合当社は、本契約の最新版を当社 WEB サイトにて公表するものとします。本契約に関してご質問がある場合、当社 (Fax:011-222-0707 / Email: [email protected]) までお問い合わせください。 SAMPLEPHONICS ソフト音源共通エンドユーザー使用許諾契約書 2/4 © クリプトン・フューチャー・メディア株式会社 Licensing Agreement All products from Samplephonics are sold as 'royalty free,' which means that they are licensed, not sold to you, by Samplephonics. Samplephonics is either the owner or entitled licensee of the products on sale. By making payment for a product you are granted the right to incorporate them in a music production, film, tv program, website or other media production, without paying any additional royalties, license fees, or any other fees to Samplephonics or any third parties. Usage and Copyright Copying, re-selling, leasing, duplicating or distribution in any form of the products for sale, other than outlined in the ‘License Agreement’, is strictly prohibited. This extends, but is not limited, to file sharing websites, web forums, computer networks and file hosting websites. Products cannot be distributed in their original format or sold in a manner that would be considered competitive with the nature of Samplephonics’business, outlined in‘About Samplephonics.’Everything else on the website is licensed to Samplephonics, including artwork, source code, materials, audio demos, graphics, text and logos and protected by copyright and intellectual property laws. Disclaimer and Waiver Samplephonics will be held harmless against any losses, judgements, claims, legal fees or court costs that may arise out of a breach of these terms and conditions. By entering this agreement you agree not to sue or recover any damages from Samplephonics and any affiliated companies or people as a result of its decision to terminate or suspend this agreement. Whilst Samplephonics will take reasonable and sufficient steps to ensure that the website is free from any viruses, trojans, malware, spyware, harmful software, data theft or any unauthorised malicious activity, Samplephonics make no guarantees on this subject and will not be held liable for any loss resulting from this. About Samplephonics Samplephonics are in the business of selling downloadable products in the form of digital audio recordings, music production software and other related materials, for use by, but not limited to, musicians, music producers, composers, film editors and web designers.
