交通安全講習会 平成２６年３月３日（月）１７時～ 1 ご講演 金沢中警察署 交通第一課 交通企画係長 杉森光弘警部補 March 3, 2014 Traffic Safety Session Kanazawa Naka Police Station, 1st Traffic Division, Chief of Traffic Planning Section Inspector Mitsuhiro SUGIMORI 2 講習会の概要/Outline of the session 1.行政処分（運転免許、免許の点数制度、違反点数） と刑事処罰（罰則）について Administrative measures (Driver’s License, Traffic Penalty Point System), Criminal Punishment 2.飲酒運転について / Drinking & Driving 3.国際運転免許について / International Driver’s License 4.中署管内の交通死亡事故の特徴について Traffic accidents (death) occurred under the jurisdiction of Naka Police Station. 3 1. 行政処分について Administrative measures (1) 運転免許/ Driver’s License 自動車の運転は人の命にかかわる危険な行 為として、一般に禁止されており、一定の技 能、知識を有すると認められた者に対して運 転免許を交付して運転を許可している。 Driving a car is regarded as a risky behavior as it can endanger someone’s life. It is forbidden in general. Only those who have the specified skill and the knowledge have the permission to drive after obtaining the Driver’s License. 4 (2)免許の点数制度 Traffic Penalty Point System • 交通法規に対する違反に応じて点数を付け、 ３年間の累積点数により、免許の停止、取 消処分を行い、道路交通の場から危険な運 転を排除する制度。 • A certain number of points are established according to the nature of the traffic offense or accident. It is prohibited to drive vehicles, moped and bicycles in Japan after drinking alcohol. 12 2.飲酒運転について/ Drinking & Driving • 運転に必要な認知、判断、操作に悪影 響を及ぼすことから、僅かであっても禁 止。 • It is prohibited to drive after drinking alcohol, even if the amount of alcohol consumed is small, as it causes bad effects on perception, judgment and handling which are required for driving. 13 2.飲酒運転について/ Drinking & Driving • 飲酒運転は故意犯であり、飲酒運転をしても加害 者に軽い刑罰しか科せられないのは理不尽との 被害者感情から、近年の法改正により、罰則の強 化、違反点数の引き上げがなされている。 • Driving after drinking is an intentional crime. Victims feel it is not fair that a criminal perpetrator (driving after drinking) gets only a light sentence. → recent law amendment → strengthened punitive clauses and penalty point was raised 14 厳罰化に伴い飲酒運転を助長した者に 対しても罰則が適用される The penalties to persons responsible for driver’s actions have been put in place (1) 車両の提供：酒を飲んで運転するお それのある者に対して車両等を提供す る When a person provides a vehicle to a driver who has consumed alcoholic drinks and is likely to drive under the influence of alcohol 15 飲酒運転を助長した者に対しても罰則 が適用される The penalties to persons responsible for driver’s actions have been put in place (2)酒類の提供：酒を飲んで運転する おそれのある者に対して酒を勧める When a person provides alcoholic drinks to a driver or encourages a driver to drink alcoholic drinks, despite the driver is likely to drive under the influence of alcohol 16 飲酒運転を助長した者に対しても罰則 が適用される The penalties to persons responsible for driver’s actions have been put in place (3)同乗：運転者が酒を飲んでいること を知りながら要求、依頼して同乗する When a person asks a driver for a ride in the driver’s vehicle, while being aware that the driver has consumed alcoholic drinks, and rides in that vehicle 17 刑罰法規適用の基準 The criteria to apply penal law • 酒を飲んで運転することは禁止されて いるが、全てが処罰の対象となるわけ ではなく、一定の基準に該当すると刑 罰法規が適用される。 • It is prohibited to drive after drinking. Penal laws will be applied when the alcohol content (breath, blood)exceed the specified level. 18 酒酔い運転 Drunk Driving アルコールの影響により正常な運転ができないおそ れのある場合、酩酊状態 Driving in such a condition that normal driving may be impaired by alcohol ５年以下の懲役又は１００万円以下の罰金 Imprisonment not exceeding 5 years or a fine not exceeding 1,000,000yen 違反点数35点（免許の取り消し、欠格期間３年（3年 以上免許がとれない）） 35 penalty points (Revocation of a driver’s license in Japan, Disqualified period: 3 years (unable to obtain driver’s license for 3 or more years)) 19 酒気帯び運転 Driving under the influence of alcohol 呼気１ℓに0.15mg以上、血液1mlに0.3mg以 上のアルコールを保有する場合/ When a driver’s breath alcohol content is 0.15 mg/L or more, 0.3 mg/1ml blood or more 3年以下の懲役又は5０万円以下の罰金 Imprisonment not exceeding 3 years or a fine not exceeding 500,000yen 20 酒気帯び運転 Driving under the influence of alcohol 0.25以上:違反点数25点（免許の取り消し、 欠格期間2年） When a driver’s breath alcohol content is 0.25 mg/L or more: 25 penalty points (Revocation of a driver’s license in Japan, Disqualified period: 2 years) 0.15以上:１３点（免許の停止９０日） When a driver’s breath alcohol content is 0.15 mg/L or more: 13 penalty points (License suspension 90 days) 21 車両の提供： Providing a vehicle driver has driven a Imprisonment not exceeding 2 years or a fine not exceeding vehicle under the 25 300,000yen influence of alcohol 3.国際運転免許について / International Driver’s License (1)自国の運転免許で運転できる場合 • スイス、ドイツ、フランス､ベルギー、台湾、スロベニア、 モナコの有効免許 • 日本語による翻訳文の添付 • 上陸してから１年間 (1) Foreign driver’s license which can be used in Japan • Valid driver’s license issued in Switzerland, Germany, France, Belgium, Taiwan, Slovenia and Monaco • Japanese translation of the license should be attached • 1 year from the date of entry into Japan 26 3.国際運転免許について / International Driver’s License (2)国際運転免許で運転できる場合 • ジュネーブ条約加盟国発行の国際運転免許証 • 発給日から１年以内 • 上陸から１年以内 (2) International Driving Permit (IDP) • IDP issued by contracting countries of the Geneva Convention • 1 year from the day IDP was issued • 1 year from the day of entry into Japan 27 3.国際運転免許について / International Driver’s License (2)国際運転免許で運転できる場合 (2) International Driving Permit (IDP) • 日本で住民登録をしている方が日本から出国し、３ か月未満で再び日本に上陸した場合は、その上陸 日を運転可能期間の起算日としない。 • If anyone who registered as a resident in Japan leaves and reenters Japan within 3 months, the date of their return shall not be considered as the date of re‐entry from which the validity of an international driving permit is calculated. 28 例１：国際免許取得後に日本に上陸したケース Case 1: X entered Japan after obtaining IDP 上陸から１年間 1 year from the day X enterd Japan 国際免許発給から１年間 1 year from the day IDP was 日本と同等の水準にあると認められる免許 制度を有している25カ国１地域については 学科試験、技能試験が免除 • 25 countries and 1 region are regarded as meeting the exemption requirement and exempt from written test and driving skills test 32 3.国際運転免許について / International Driver’s License (3)日本の運転免許を取得して運転する場合 Obtaining Japanese Driver’s License • 自国の有効免許を所有していれば切り替えの手 続き（学科・実技試験有り、事前に連絡して予約し てから受験、日本語が話せない場合は付添が必 要、不合格で２～３回受験する人も多い） • If not Exam‐Exempt countries and region, they have to take written test and driving skills test to convert a valid foreign driver’s license to a Japanese license. An interpreter is required if the examinee can’t speak Japanese. Advanced reservations required. Some examinee can’t pass and have to take the test more than 2 times 33 3.国際運転免許について / International Driver’s License • (1), (2), (3) 以外は無免許運転となる ‐ 3年以上の懲役又は50万円以下の罰金 ‐ 違反点25点（欠格期間2年） • Other than (1), (2), (3), “driving without a license” ‐ Imprisonment not exceeding 3 years or a fine not exceeding 500,000yen ‐ 25 penalty points (Disqualified period 2 years) 34 4.中署管内の交通死亡事故の特徴について Traffic accidents (death) occurred under the jurisdiction of Naka Police Station. • 高齢歩行者の道路横断中に多い • 昨年1年間に３件の死亡事故で３人が死亡 • 3人とも６５歳以上の高齢者で道路横断中に車に はねられている • Most traffic accidents occurred when elderly persons were crossing street • 3 were killed by 3 death accidents last year • 3 victims are elderly persons (older than 65 years) and hit by a car while crossing the street 35 死亡事故例 A death accident • 2013年11月23日17:00頃、金大病院付近の 小立野通りで、第二車線を走行していた軽 四乗用車が、進路前方を左から右へ横断し ていた高齢女性をはねて死亡させている。 • On November 23, 2013, at about 17:00, a light vehicle was driving in the second lane of the Kodatsuno‐dori Avenue near Kanazawa University Hospital.
