裁判所及び権限争議裁判所等の重要判例をも併せて収録したものがいくつかあり、また Recueil Dalloz や Recueil Sirey
の判例集にも 19 世紀後半からの重要行政判例が収録されておりますが、復古王政期の 1820 年代から現在に至るまでの公法
判例を網羅的に集成・公刊し続け、それゆえに定評のあるものはこの判例集のみです。フランスの法学者・実務家も行政判

ーユ・デタの年次活動報告です。カサンによる本雑誌刊行の辞によると、これまでコンセーユ・デタは、ルボン(Lebon)の名
で知られる判例集によって専ら行政裁判所としての活動内容しか知られてこなかったこと、しかし、かねてから、この点を
遺憾とする識者の声もあり、法令案作成等のコンセーユ・デタの諮問的業務をはじめその事績と諸資料が広く世に知られう

フランス古法時代の優れた法律家の 1 人であるデュムランは、とりわけその慣習法の研究によって知られています。フラン
ス古法の主要な源の一つである慣習法に関しては、従来地域ごとに細分化されていたものについて、15 世紀以降、王権によ
る統一と成文化が強力に推進されていましたが、デュムランは、ダルジャントレ等とともに、慣習法の研究を深化し、特に

フランスは、この法令全集第 1 巻が刊行された 1834 年まで、大革命・ナポレオン体制・復古王政・七月王政とめまぐるしい

1903 年に教授資格試験に合格し、リール、パリ両大学で教鞭を執ったルネ・ドゥモーグ
（1872-1938）は、20 世紀に前半に活躍したフランスの代表的な民法学者です。
現在、民法の分野における最も代表的な雑誌である「Revue Trimestrielle de Droit Civil」は、1902 年にエ
スマン(Adhemar Esmein)によって創刊されましたが、ドゥモーグは最初からの協力者でした。そして、教授は
この雑誌の中で債務法の分野における多くの論文を発表し、後世に多大な業績を残しました。具体的には、文
献紹介、判例紹介などのほかに、不確定な権利、一方的な意思による契約の変更、意思表示の瑕疵としての強
迫、などに関する研究です。これらの研究成果が本書「Traite des Obligations en General（債務法体系）」
全 7 巻(1923-1933)に結実しております。当初 8 巻が予定されておりましたが、残念ながら第 7 巻を最後に未刊
のまま終わりました。しかし、未刊であることが本書の価値を無にするものではありません。現在においても
なおしばしば引用されていることからもフランス債務法の重要文献のひとつと云えましょう。本書の最大の特
色は、比較法にかなりのページ数が当てられていることです。現在と異なり、比較法が未成熟な時代において、
教授が多くの外国法に注目しておりましたことは、同氏の見識の深さを示すものでしょう。例えば、第 1 巻の
錯誤に関するところでは、イタリア法、ポルトガル法、スペイン法、ドイツ法、スイス法、オーストリア法、

In CODE CRIMINEL the very last Treatise on Criminal Law from the Ancien Régime, Serpillon,
Lieutenant-General for Criminal Affairs in the Présidial d'Autun, emphatically defends proposals for
radical reform in what is all too often archaic practice. The chapters devoted to the Inquisition
Sessions he had to preside, in which he describes the repulsion they provoked, are very moving and
extremely rare in legal literature. His coverage of prison life also provides clear evidence of a gradual
change and progress in people's attitude towards the incarceration of their fellow man.

The STATUTES AT LARGE were begun both as a retrospective and also a current publishing project in 1762,
under the editorship of Danby Pickering, from whom the entire series acquired its popular name.
Pickering himself was responsible for volumes 1 thru 46, which were published between 1762 and 1807.
Volumes 47 thru 98 have no named editor. George K. Rickards, counsel to the speaker of the House of
Commons, was the named editor for volumes 99-109. Volumes 1-24, covering 1225-1761 and published
between 1762 and 1769, comprise the retrospective portion of the series, with Vol. 24 being an index for
those years. Volumes 25 thru 109, covering 1761-1869, were each published in the year(s) following the
parliamentary session(s) the statutes of which they cover. There is one additional index volume prepared
by Pickering (Vol. 38 of the set), which covers volumes 25 thru 37, the 1st to 32nd regnal years of George
III.
紙のない時代における記録はなかなか残らない。また、印刷技術が出現するまで、書物は高嶺の花である。

に、慣習を法として考える国においてことは、ますます重要になってくる。なぜなら、慣習の存在を証明するのが、裁判そ
の他の記録になるからである。さて、Pickering’s Statutes at Large は、そのような時代における重要な資料であ
る。題名がしめすとおり、これは、私集制定法大全である。1225 年から 1869 年までのイギリスにおいて発布された Statutes
を編集したものである。これは、この資料が、イギリスにおける国会成立以前の成文法をも含むことを意味する。即ち、議
会制が始まる前、statutes は王の発した法律であった。議会の原型は、エドワード一世の時代にできたとしても、それが立
法府として君臨するまでには、まだ時間がかかる。それゆえ、この資料は、二つの側面から現代におけるイギリス法及び政
治研究に欠かせない。まず、第一に、その高い歴史的価値、である。本書をつぶさに眺めてみれば、この時代において法に
関心を持ち、影響力を行使しようとした者たちの姿が垣間見えてくる。たとえば、この資料を注文した者たちのリストは、
本書が発行された当時の法曹界の面々である。そしてそれは当時の為政者に近い人々でもある。第二は、現代的価値である。
いったん法が制定されれば、その法が改廃されるまで、効力は続く。また、ある法の成立過程と成立年代から、その法の制
定目的が理解できる。判例主義を取る法制度にあっては、制定法もまた、歴史的コンテクスト、時間の連続の中で、解釈さ
れる。それゆえ、この資料は現代のイギリス法を知ろうとするものにとっても、高い価値を持つ。このような資料が、原
文に近い形で手に入るようになることは英国及びその他のコモンロー制度を持つ国々を研究する研究者にとって、とても
喜ばしいことなのである。
