シンポジウム 2012 ～アメリカ知的財産法の最新事情～
拝啓
時下ますますご清栄のこととお慶び申し上げます。
このたび、PRIP Tokyo（特定非営利活動法人知的財産研究推進機構）は、知的財産分野に携
わる方々を対象としたシンポジウムを開催いたします。
スピーカーとして、米国連邦巡回区控訴裁判所（CAFC）のランドール・レーダー首席判事、
ジョージ・ワシントン大学ロースクールのマーティン・エーデルマン教授にお越しいただくほか、
モリソン・フォースター外国法事務弁護士事務所のご協力を得て、マイケル・ジェイコブス米国
弁護士、ジャック・ロンデン外国法事務弁護士、ロバート・ホリングスヘッド外国法事務弁護士、
クリント・コナー外国法事務弁護士、寺口由華米国弁護士をお迎えすることができました。さら
に今年は、稲葉良幸弁理士（TMI 総合法律事務所）、一色太郎外国法事務弁護士（一色外国法事
務弁護士事務所代表）と玉井克哉教授（PRIP 常務理事、東京大学教授）をお迎えし、日米の知財
法の対比という観点からもご講演いただく予定です。
第一セッションでは、「アメリカ特許法に関する最近の動向」と題しまして、米国の特許法に
関する最近の主な動向について、レーダー首席判事とエーデルマン教授にご講演いただきます。
第二セッションでは「知的財産権訴訟における法的救済」と題しまして、ジェイコブス米国弁護
士とロンデン外国法事務弁護士が、衡平法上の救済と特許損害について講演いたします。第三セ
ッションでは、「米国および日本における特許手続きについての考察」と題しまして、米国改正
特許法における特許無効手続きに向けての戦略についてコナー外国法事務弁護士に、また日米の
対比、日本の法律の観点から玉井教授にご講演をいただいた後、パネル・ディスカッションを予
定しています。
本シンポジウムは、実務界と学界から最高水準の講演者をお招きし、知的財産権における日米
の最新情勢についての洞察とその意義を深めていただく恰好の機会です。ご多忙とは存じますが、

Symposium 2012 “Recent Developments in U.S. Intellectual Property Law”
November 2012
Dear Sirs and Madams:
PRIP Tokyo (a non-profit organization for the Promotion of Research on Intellectual Property)
is pleased to announce that a symposium for professionals engaged in the field of intellectual
property will be held on Monday, November 26, 2012.
The main speakers at the symposium will include Chief Judge Randall R. Rader (Chief Judge
for the United States Court of Appeals for the Federal Circuit) and Martin J. Adelman
(Professor of Law, The George Washington University Law School). Through the cooperation
of Morrison & Foerster, a leading international law firm, we are delighted to have as speakers
Morrison & Foerster’s Mr. Michael A. Jacobs, Mr. Jack W. Londen, Mr. Robert Hollingshead,
Mr. Clint Conner, and Ms. Yuka Teraguchi. We are also pleased to have as speakers Mr.
Yoshiyuki Inaba (TMI Associates), Mr. Taro Isshiki (Isshiki International Law Office), and
Professor Katsuya Tamai (Executive Director, PRIP and Professor, University of Tokyo).
In the first session entitled “Recent Developments in U.S. Patent Law,” Chief Judge Rader and
Professor Adelman will discuss recent key developments and trends in U.S. patent law. At the
second session entitled “Remedies in Intellectual Property Cases”, Mr. Jacobs and Mr. Londen
will discuss developments in equitable remedies and patent damages. In the third session
entitled “Challenging Patent Rights in the U.S. and Japan,” Mr. Conner will discuss strategies
for challenging validity under the AIA and Professor Tamai will compare the AIA with the
Japanese law. A panel discussion will follow each session.
We believe that this symposium, offering the views of intellectual property experts in the
judiciary, academia, and legal profession, offers an excellent opportunity to gain insight into
recent key developments in intellectual property. We hope that you will be able to join us.

ランドール R. レーダー
全米の特許事件を専属的に管轄する連邦巡回区控訴裁判所首席判事。1974 年ブリ
ンガム・ヤング大学で B.A.を、1978 年ジョージ・ワシントン大学で J.D.を取得。1988 年レーガン大統領の任命
により合衆国請求裁判所判事、1990 年ジョージ・ブッシュ大統領により連邦巡回区控訴裁判所判事に任命され、
2010 年 6 月 1 日に同裁判所首席判事に就任。裁判官職を務める傍ら、教育者としても積極的に活動しており、
現在はジョージ・ワシントン大学ロースクール等にて教鞭を執る。
Chief Judge Randall R. Rader is the Chief Circuit Judge on the United States Court of Appeals for the Federal Circuit. He
obtained a B.A. in English from Brigham Young University in 1974 and a J.D. from George Washington University in 1978.
President Ronald Reagan appointed him to the United States Claims Court in 1988. President George Bush appointed him to
the Court of Appeals for the Federal Circuit in 1990. He assumed the duties of Chief Judge on June 1, 2010. Chief Judge
Rader is also an educator and has taught classes on patent law and other intellectual property law at various law schools and
universities.
マーティン J. エーデルマンジョージ・ワシントン大学ロースクールの知的財産法・先端技術法の教授、知
的財産法プログラムの共同ディレクター、知的財産研究所 Dean Dinwoodey センターの共同ディレクター。現在
は主に特許法の分野において教鞭を執るが、1999 年にジョージ・ワシントン大学に転ずる前は、1973 年よりミ
シガン州立ウェイン大学の知的財産および反トラスト法専門の教授であり、デトロイト地区において特許弁護
士を務めた経験がある。
Martin J. Adelman is the Theodore and James Pedas Family Professor of Intellectual Property and Technology Law;
Co-Director of the Intellectual Property Law Program; and Co-Director of the Dean Dinwoodey Center for Intellectual
Property Studies at The George Washington University Law School. Earlier, Professor Adelman taught at Wayne State
University Law School and practiced as a patent attorney in the Detroit area.
玉井克哉
東京大学先端科学技術研究センター教授
東京大学法学部卒。東京大学助手、学習院大学法学部助教授（行政法) を経て、1990年4 月東京大学法学部助教
授 (行政法・知的財産法)。 1995年10月東京大学先端科学技術研究センター助教授、1997年より同教授(知的財
産法)。マックス・プランク知的財産法研究所（ドイツ、ミュンヒェン）、ジョージ・ワシントン大学ロー・ス
クール及び連邦巡回区控訴裁判所での在外研究経験がある。現在は、慶應義塾大学特別招聘教授、政策研究大
学院大学客員教授、日本音楽著作権協会(JASRAC)理事。 2004年、PRIPTokyo設立とともに常務理事に就任。
Katsuya Tamai is a professor of Intellectual Property Law at the Research Center for Advanced Science and Technology
(RCAST) of the University of Tokyo. Before joining the RCAST, he served as an associate professor at the Faculty of
Law. He studied IP law at the Max-Planck-Institute for the IP Law in Munich (1989-92) as well as at the George
Washington University Law School and the U.S. Court of Appeals for the Federal Circuit (1999-2000). In addition to his
professorship at the University of Tokyo, Prof. Tamai teaches at the National Graduate Institute for Policy Studies (GRIPS)
and Keio University as an adjunct professor. He is also a Board Member at Japanese Society for Rights of Authors,
Composers and Publishers (JASRAC).
稲葉良幸
TMI 総合法律事務所パートナー
上智大学理工学部卒業後、鵜沼特許事務所入所。1974 年に弁理士登録後、米国へ留学するとともに、ロサンゼ
ルスのコーダ・アンド・アンドローラ法律特許事務所及びワシントン D.C.のスティーブンス・デービス・ミラ
ー・アンド・モーヂャ法律事務所に約２年半勤務。鵜沼特許事務所への復帰を経て、稲葉特許事務所開設。そ
の後、ＴＭＩ総合法律事務所を開設し現在に至る。特許・商標についての侵害訴訟、審決取消訴訟、無効審判、
侵害・有効性の鑑定、プロセキューション、その他知的財産に関するアドバイスに数多く携わる。2004 年特定
侵害訴訟代理業務付記登録。1998 年よりサンタクララ大学ロースクールのサマープログラム担当教授。また、
2007 年から 2008 年には日本弁理士会副会長を務めた経験を持つ。
Yoshiyuki Inaba is a co-founding partner of TMI Associates, the fifth largest Japanese law firm. He heads the intellectual
property group with his expertise in patent and trademark prosecution and enforcement. He graduated from Sophia
University (B.Sc., Mechanical Engineering, 1973) and became qualified as a Japanese patent attorney in 1974. He has over
30 years of experience in the industry and has earned the reputation of being a top-level IP practitioner. He oversees the
daily management of each client’s IP portfolio, ensuring proper protection is obtained and the client’s interests are fully
covered. He also handles and supervises patent and trademark lawsuits at both the district and IP high court levels as well as
invalidation procedures at the Japan Patent Office. In negotiations, including licensing, transfers, and general cooperative
arrangements, his attention to detail promises the parties involved a reasonable, amicable, hassle-free transaction. In
addition to his private practice, he has served as a vice-president for the Japanese Patent Attorney Association among other
professional organizations. He also teaches a class on Japanese IP law at Santa Clara University (CA).
一色太郎一色外国法事務弁護士事務所設立前は、モリソン・フォースター外国法事務弁護士事務所において
パートナーを務める。同事務所に勤務した 13 年間中、IP 訴訟を含む多岐にわたる商事紛争事案を専門に取り扱
う。特許訴訟、敵対的ライセンス交渉及びトレードシークレット紛争に関する案件を中心に取り扱い、またそ
れ以外にも、著作権、契約違反、製造物責任、詐欺事件等の商事紛争について代理人を務め、これまでに、連

Taro Isshiki Prior to founding Isshiki International Law Office in 2011, Taro Isshiki was a partner at Morrison & Foerster.
During his 13 years at Morrison & Foerster, Mr. Isshiki specialized in a variety of commercial disputes, with a particular
focus on IP litigation and counseling. He regularly represented clients in patent litigation, adversarial license negotiations
and trade secrets disputes. In addition, he represented clients in copyright, breach of contract, product liability, fraud and
other commercial disputes. He has represented clients in over 30 cases in federal and state courts as well as before the
International Trade Commission. Mr. Isshiki received his B.A. from Cornell University in 1995 and his J.D. from The
George Washington University Law School in 1998. He is qualified to practice in California and the District of Columbia.
He is a registered foreign lawyer (gaikokuho jimu bengoshi) in Japan.

Michael Jacobs is a trial lawyer who concentrates his practice on litigation of high-technology and intellectual property
matters. He has represented information technology and life sciences companies in over 35 patent lawsuits, often prevailing
at early stages of the dispute. He has also handled numerous high-profile arbitrations, several of which involved the
interplay between arbitration and court proceedings. Mr. Jacobs is the co-founder of the firm’s Intellectual Property Practice
Group, and currently heads its Life Sciences Practice Group. He received B.A. from Stanford University in 1977 and J.D.
from Yale University in 1983. He is a member of the bar of California.

Jack Londen is a trial lawyer with almost 30 years of experience in patent litigation and other areas of complex commercial
litigation in federal and state courts at the trial court and appellate levels. He has also handled many commercial arbitration
matters arising from merger and acquisition transactions. In addition, he has led significant cases involving public
education, civil rights, and other public interest matters. Mr. Londen is highly recommended in the field of Dispute
Resolution in The Legal 500 Asia-Pacific, 2011/2012 edition. He received his A.B. degree from Harvard College in 1975,
magna cum laude, and his J.D. degree from Yale Law School in 1978. He is a member of the bars of California and Arizona.
He served as law clerk to the Honorable William W Schwarzer, U. S. District Court for the Northern District of California,
during 1979 and 1980.

Robert Hollingshead is a partner and registered patent attorney working in Morrison & Foerster's Business and Litigation
groups in Tokyo. Mr. Hollingshead’s practice focuses on serving clients in the areas of patent litigation, pre-litigation
counseling, arbitration, opinion work, adversarial negotiations, and intellectual property transactions concerning electronic,
semiconductor, computer, software, telecommunications, medical device, and mechanical technologies. He holds an M.S.
degree in electrical engineering from the Johns Hopkins University and dual B.S. degrees in electrical engineering and
mathematics from the University of Maryland. Mr. Hollingshead is admitted to practice in the District of Columbia,
Maryland, Japan as a Gaikokuho-Jimu-Bengoshi (registered foreign lawyer), the U.S. Court of Appeals for the Federal
Circuit, and the U.S. Patent and Trademark Office.

Clint Conner is an Of Counsel in the Litigation Department of Morrison & Foerster’s Tokyo office. His practice focuses on
patent litigation and other intellectual property matters, including patent licensing, pre-litigation patent dispute resolution,
patent reexaminations, and trademark litigation. Clint received his JD from the University of North Carolina School of Law
in 2003 and his BSE in Industrial and Operations Engineering from the University of Michigan in 1997. Clint worked as an
engineer with a global telecommunications company before attending law school. He has been a resident of Japan since 2009
and came to Morrison & Foerster from another major international law firm in Tokyo. Clint is admitted to practice law in
California, New York, Japan as a Gaikokuho-Jimu-Bengoshi (registered foreign lawyer), and the U.S. Patent and Trademark
Office.
寺口由華東京オフィスのアソシエート。特許訴訟を中心に知的財産関連の紛争を専門とする。これまでに、
コンピュータ／エレクトロニクス産業のさまざまな企業を代理。モリソン･フォースター入所前は、米国連邦巡
回区控訴裁判所首席裁判官 Randall R. Rader のロークラークを務める。スタンフォード大学にてコンピュータサ
イエンスの B.S.取得後、ジョージ・ワシントン大学ロースクールにて J.D.取得。
Yuka Teraguchi is an associate in Morrison & Foerster’s Tokyo office. Her practice focuses on intellectual property
disputes, with an emphasis on patent litigation. Ms. Teraguchi has previously represented various companies in the computer
and electronics industries. Prior to joining the firm, Ms. Teraguchi served as a law clerk to the Honorable Randall R. Rader,
Chief Judge at the U.S. Court of Appeals for the Federal Circuit. Ms. Teraguchi earned her J.D. at the George Washington
University Law School. She received her B.S. in Computer Science from Stanford University.
