自動車保険の証明書に関するニューヨーク州の新規定
ニューヨーク州では、無保険車両の増加に頭を悩ました州政府が、無保険車両を正確迅速に確認するための「自動車保険オンライン登
録」制度を新法により１９９８年１月７日付けで導入したことはご存知の通りです。この法律は一般に 1997NY S5754 と呼ばれており、
皆様の自動車保険を引き受けた保険会社が、その自動車と保険情報など所定の情報をニューヨーク州陸運局に電子登録することになっ
ております。ここでは、この規定が皆様に及ぼす影響とその対応策を観ておきます。
New York State is concerned with the increasing number of uninsured drivers that operate automobiles and, as a result, the State Legislature enacted a
law which allows for the creation of an instant on-line registry of motor vehicle insurance to accurately identify motor vehicles with no liability
coverage. This Law, which was enacted during their 1997-1998 session to be effective January 7, 1998, (referred to as 1997 NY S 5754) requires
insurance companies to report certain information to the State.
Required Information
自動車保険オンライン登録に必要な各種情報
ニューヨーク州自動車保険オンライン登録に必要な主たる情報は、既に保険代理店やブローカーを通じて保険会社に提出されておりま
す。これらの情報は、例えば：
Most of the required information is already submitted to your insurance company through your agent or broker:
車両番号（１７桁のアルファベットと数字）
Vehicle Identification Number (VIN)
年式・メーカー・モデル
Year, Make, Model of Vehicle
保険契約者名・住所
Insured Name and Address
保険証券の種類
Type of Insurance Policy
しかしながら、特定の情報については必ずしも保険会社に通知されていないこともあります。特に、実際にニューヨーク陸運局への車
両登録に関わる情報は保険会社が直接知り得るものではありません。従って、次の情報は必ず保険代理店・ブローカーを経て保険会社
に知らせておく必要があります。
However, some of the information is not necessarily provided to the insurance company. This information is dependent on how the vehicle is
specifically registered with the State of New York.
For all registered vehicles, your insurance company also need:
Registered Name(s) (if different from Insured policyholder)
登録された車両所有者名（保険契約者と異なる場合）
車両登録に使用された住所（保険契約者住所と異なる場合）Registered Address(es) (if different from mailing address of policyholder)
Driver’s License Number (and state)
運転免許証番号（個人名義で車両登録した場合）
Date of Birth

Gender
性別（個人名義で車両登録した場合）
連邦納税者 ID（企業名義で車両登録した場合）

また、次のような車両は現在オンライン登録の対象となっていないので、以上のような追加情報を必要としません。

Motorcycles, Snowmobiles and All terrain vehicles (ATVs)
オートバイ・スノーモービル・ATV
Vessels
船舶・ボート
商業目的で使用しないトレーラー
Non-Commercial Trailers
警察・消防関係車両
Police and Fire Vehicles
政府・外交官関係車両
Government Vehicles, including those with Diplomatic Plates
トラクターなど農耕機器
Implements of Husbandry (i.e. Farm Equipment)
車両保険だけが設定されている車両
Vehicles with Physical Damage Coverage only
州政府公用車両（専用プレートのあるもの）
Vehicles registered in the State (STA) or Political Subdivision (PSD)
Problems You May Encounter
よく発生する問題
マンハッタンの真中でも郊外の住宅地でも、警察は常時貴方の車に保険が手配されているかどうか監視していると考えてください。
マンハッタンで車をちょっと離れた間に警察官が車に近づき、保険登録を確認したところ車両登録住所と保険契約者の住所が一致していなかっ
たため、実際には保険があるにも拘らず記録上無保険とされ、車を一時的に没収された挙句徒歩で帰らされたという話もあります。
NY Police will always be on the lookout for uninsured vehicles whether you are in Manhattan or in suburban residential areas. We have heard of an unfortunate driver who
had to walk home because his car was taken away due to no insurance record. The story goes like this. In Manhattan, he left his car just for a short while. The policeman
approached the vehicle and checked for insurance record. Because the address on the registration was different from the insurance policy holder’s address, the search turned
out empty and the vehicle was determined not insured contrary to the fact that it was insured.
また、ある企業がニューヨーク州でリースしている自動車で、車両登録は自宅勤務をしている従業員の自宅住所で行なわれている一方、保険契
約企業の住所はその本社があるカリフォルニアとなっていたため、情報が一致せず問題になりかけたこともあります。
We have more examples of potential problems due to non-matching information. A Japanese corporation leased a car in NY. The vehicle registration was done using the
address of the NY employee’s home office. The insurance policy holder’s address was in California where the corporate headquarter was located.
さらに、保険代理店・ブローカーから保険会社、そしてニューヨーク州陸運局へと車両情報が回送され、陸運局で最終的に入力される過程で１
７桁の車両番号（VIN）の一部にタイポ（入力ミス）が発生したため、間違い無く保険が手配されている証明にならなかったという事例もあり
ます。特に、以下が要注意の文字数字であることは容易に想像できます。
Another example of a potential problem is a typo or data entry error. The information is passed on from the insured to the broker to the insurance company and to the State of
NY. If one letter or number of the VIN was entered wrong, your vehicle will be determined no insurance! Therefore, please pay special attention to the following easy to
misidentify letters and numbers:

まとめ－より良い対応策
ニューヨーク州が導入したオンライン保険登録制度は、運用次第では無保険車両の締め出しに威力を発揮すると期待されます。また、最近フロ
リダ州が同様の制度を導入し、今後追随する州は増えるものと予想されます。
This online insurance registration NY State introduced would function as an efficient tool to enforce mandatory insurance, even though the problems like we mentioned
above need to be addressed. Florida State recently introduced the same type of system. We are sure many states will follow.
しかし、以上のような日常の不都合や問題が発生することもありますでの、現時点での最良の防止策は車両登録証を保険代理店・ブローカーに
提示することと言えるでしょう。これにより、実際にオンライン登録処理をおこなう保険会社で事前に問題を防止するよう情報を入力すること
が可能になります。
While NY State works to improve the system, the best solution to avoid problems like above is to present us a copy of the vehicle registration. We can send the copy to the

insurance company so they can enter the information as on the registration.
