ﾌｨﾘﾋﾟﾝ人技能実習生の親族関係書類について

所得税法等の一部を改正する法律（平成 27 年法律第 9 号）により、平成 28 年 1 月分給与から、事業
所の社員が、国外居住親族に係る扶養控除の適用を受けるためには、その親族の「親族関係書類」や
「送金関係書類」を給与等の支払者に提出又は提示することが義務化されました。
従いまして、平成 28 年の給与からは、ﾌｨﾘﾋﾟﾝ人技能実習生が扶養控除を受けるためには、
「親族関係
書類」や「送金関係書類」が必要となっております。
「親族関係書類」は、外国政府または外国に地方公共団体が発行した書類でなけれなりません。その
書類とは国外居住親族の氏名、生年月日及び住所又は居所が記載されている書類で、国外居住親族が居
住者の親族であることを証するものであり、具体的には戸籍謄本、出生証明書、婚姻証明書が該当しま
す。
ただし、平成 27 年 9 月に国税庁ホームページ上で公表された「国外居住親族に係る扶養控除等 Q&A
（源泉所得税関係）
」の Q 18 の注意書きにおいて、
「ﾌｨﾘﾋﾟﾝの場合、バランガイ組織が発行するバラン
ガイ証明書も外国政府または外国の地方公共団体が発行した書類と同様に取り扱って差し支えありませ
ん。
」と記載されております。
従いまして、当組合ではﾌｨﾘﾋﾟﾝ人技能実習生にバランガイ証明書を「親族関係書類」として提出する
よう勧めております。この理由としましては、バランガイ証明書の取得が、技能実習生にとって金銭的
な負担が最も少ないからです。
また、外国語で作成されている場合は、法令により、その翻訳文も提出又は提示することとされてい
ます。バランガイ証明書は各バランガイによって書式が若干異なりますが、内容はほぼ同じであり、犯
罪歴等が無く、その地域に居住していること等を表し、国内・海外における雇用やパスポート取得等の
ために提出が必要な公的証明書のひとつとなっています。
以下にバランガイ証明書の数種類の証明書の英文例とその日本語訳を記載しています。以下の英文
例、日本語訳例があれば、社会通念上、バランガイ証明書の内容が理解できると考えます。技能実習生
のため、何卒、以下の文書をもって、日本語訳文に代えさせていただきたく、よろしくお願い申し上げ
ます。
