外国書講読Ⅰ 和 知 賢太郎 ―英国憲法改革の行方（１）― １ 年 ２ 単 位 水曜日 １時限 前 期 授業のねらい 本講義では、英国の憲法改革を主要テーマに取り挙げ、関連する英語文献の講読を行う。憲法改革の中でも、 英国の上院改革は２ ０世紀を通じての主要テーマでもあった。戦後、１ ９ ４ ９年に行われた１ ９ １ １年の議会法（Parliament Act）の改正、１ ９ ５ ８年の一代貴族の導入、１ ９ ６ ８年の包括的な上院改革の失敗などの流れが挙げられる。しかし、近 時、その上院改革を求める流れは加速しており、１ ９ ９ ６年、労働党政権は民主制、代表制という観点から、改めて上 院改革を打ち出した。１ ９ ９ ９年１月、政府は上院改革案を議会に提出し、１ １月に両院を通過し、世襲議員が自動的に 議席を世襲し、投票権をもつという仕組みを改め、過度期の上院に残る９ ２名の議員を除く世襲議員が上院を去るこ とになった。さらに、２ ０ ０ ０年１月にはウェーカム（Wakeham）卿を議長とした王立委員会によって、 「A House for the Future」と題する報告書が議会に提出された。同報告書は将来を見据えた上院機構に関する提案を行ったが、 これを受けて、同年１ １月、政府は「The House of Lords-Completing the Reform」と題する白書を発表し、リポー トの大部分の提案を支持した。さらに２ ０ ０ ７年には白書「The House of Lords : Reform」、同年、緑書「The Governance of Britain」を公表し、また、２０ ０ ９年１ ０月には、２ ０ ０ ５年の憲法改革法（Constitutional Reform Act）に基づい て、貴族院上訴委員会が有していた終審裁判所としての権限が、新たに設置された連合王国最高裁判所（Supreme Court of the United Kingdom）に移管された。 本講義では、上院改革を始めとした広範な憲法改革の中から、英国憲法の法典化の議論をテーマに選ぶことにし た。２ ０ １ ０年に下院の政治・憲法改革委員会は「Mapping the path to codifying - or not codifying - the UK's Constitution」という調査を開始し、２ ０ １ ２年、それに対するロンドン大学キングズ・カレッジの政治・憲法研究センターの 報告書が公表されており、英国憲法改革の動向を引き続き探る。 授業方法 下記の文献を中心にして講読し、必要に応じてコマンド・ペーパー等に触れることとする。ネット上には膨大な 情報があり、その中で有益な情報を選択して、有効に活用するためにも、インターネットを利用したイギリスの関 連資料の収集を行う。 授業計画 １ Introduction ２ The existing constitution ３ Codifying of not ４ The Uncodified Constitution and its Implications ５ Definition and causes of the uncodified constitution (1) ６ Definition and causes of the uncodified constitution (2) ７ Characteristics of the uncodified constitution (1) ８ Characteristics of the uncodified constitution (2) ９ Characteristics of the uncodified constitution (3) １ ０ Possible arguments both in favour and against the nature of UK constitution (1) １ １ Possible arguments both in favour and against the nature of UK constitution (2) １ ２ Public opinion being taken into account １ ３ Overall polling on the `written constitution' issue １ ４ Key features of the UK constitution １ ５ 総括講義 評価方法 受講状況および報告・質疑応答（５ ０％） 、提出レポート（５ ０％）によって総合的に評価する。 テキスト・参考書（講義時に資料等は配布する） Centre for Political & Constitutional Studies, King' College London “Codifying - or not codifying - the United Kingdom Constitution : the Existing constitution (Series paper 2) " (2012) ―１ ０ ５― 外国書講読Ⅱ 和 知 賢太郎 ―英国憲法改革の行方（２）― １ 年 ２ 単 位 水曜日 １時限 後 期 授業のねらい 外書講読Ⅰで明らかになったように、英国憲法は法典化された憲法（憲法典）という形式の憲法ではないため、 不文（不成典）憲法の特質とその議論を踏まえて、外書講読Ⅱでは、法の支配などの現行憲法の主要な憲法原理お よびその憲法習律などの法源について考えてみる。 これまでの講義を３区分すれば、第一期（２ ０ ０ ８∼１ ０年）は、 「イギリスのコマンド・ペーパーを読み解く」（Command Paper には、White Paper、Green Pater、Government Responses to Select Committee、Enquiry Report などがある）という副題で、緑書「The Governance of Britain」を中心に講読し、さらに第二期（２ ０ １ １∼１ ２年）は 「英国憲法改革の行方」という副題で、Rodney Brazier『Constitutional Reform Reshaping the British Political System』（第３版、２ ０ ０ ８年、オックスフォード出版局）を中心に、憲法改革に関する数多くのテーマの中から英国議 会の上院（貴族院）改革を取りあげてきた。その間に、２ ０ １ ０年には改革を牽引してきた労働党政権に代わり、保守・ 自民連立政権が成立して、上院改革は現在進行形である。２ ０ １ ３年度の講義からは第三期目に入り、２ ０ １ ７年度も憲法 改革行方を考える。 授業方法 下記の文献を中心にして講読し、必要に応じてコマンド・ペーパー等に触れることとする。ネット上には膨大な 情報があり、その中で有益な情報を選択して、有効に活用するためにも、インターネットを利用したイギリスの関 連資料の収集を行う。 授業計画 １ Introduction ２ Representative democracy (1) ３ Representative democracy (2) ４ The rule of law and individual rights (1) ５ The rule of law and individual rights (2) ６ A Constitutional Bill of Rights (1) ７ A Constitutional Bill of Rights (2) ８ Multinational state and its tiers of government (1) ９ Multinational state and its tiers of government (2) １ ０ The doctrine of parliamentary sovereignty (1) １ １ The doctrine of parliamentary sovereignty (1) １ ２ Constitutional Sources- Constitutional conventions １ ３ Royal Prerogatives １ ４ Acts of Parliament and Judicial decisions １ ５ 総括講義 評価方法 受講状況および報告・質疑応答（５ ０％） 、提出レポート（５ ０％）によって総合的に評価する。 テキスト・参考書（講義時に資料等は配布する） Centre for Political & Constitutional Studies, King' College London “Codifying - or not codifying - the United Kingdom Constitution : the Existing constitution (Series paper 2) " (2012) ―１ ０ ６―
